ACTION REQUESTED: Request to Approve a Resolution to Authorize the Chair's
signature for Right -of -Way Procedures Staffing Update

BACKGROUND: In 2013 Public Works adopted the Policy on Right -of -Way
Acquisition Procedures, Personnel Qualifications, Waiver
of Appraisal and Administrative Settlement Procedures
through Resolution 2013-129. In 2017 this policy was
updated through Resolution 2017-145.
Personnel within Public Works has changed since the
adoption of Resolution 2017-145. Washington State
Department of Transportation (WSDOT) requires an update
by the County to reflect current Public Works staff for
capital improvement projects associated with right-of-way.
WSDOT and the Federal Highway Administration require
the County perform the specific right-of-way functions of
Program Administration and Property Management. All
other functions such as appraisals, acquisitions, and
relocations will be consulted out by the Public Works
Department as needed.
This list of identified staff must be up to date and in place
for Public Works to deliver projects with Federal funding
such as the Liberty Road bridge replacement project, that
may have right-of-way impacts associated with them.

AUTHORIZING THE CHAIR'S SIGNATURE FOR RIGHT-OF-WAY PROCEDURES
STAFFING UPDATE WSDOT FORM LPA-OO1B
WHEREAS: Resolution number 2013-129 approved the Government Agreement for Aid,
Policy on Right -of -Way Acquisition procedures, Personnel Qualifications,
Waiver of Appraisal and Administrative Settlement Procedures for acquisition of
real estate for Federal Aid funded projects; and
WHEREAS: Resolution number 2017-145 updated the policy; and
WHEREAS: Personnel within Public Works has changed prompting the need to amend the
policy to reflect current staff; and
WHEREAS: Public Works is required to perform the specific right-of-way functions of
Program Administration and Property Management; and
WHEREAS: Public Works will seek to utilize consultant support for all other specific right-of-
way functions; and
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the best
interest of the public, does hereby approve the Chair's signature updating the
right-of-way procedures staffing update form.

- Familiar and able to comply with the requirements of Title 49 CFR Part 24—the Uniform
Relocation Assistance and Real Property Acquisition Policies Act (URA)
Justin Turnbull, PLS, RWP, County Surveyor
- 16 years in private industry working in researching, searching, and retracing right of way.
- 8 years in Public Works design, construction and management.
- Experience in Highway condemnation proceedings (Caltrans) and retracing old right of way.
- Right of Way Professional certification from IRWA
- Familiar and able to comply with the requirements of Title 49 CFR Part 24 — the Uniform
Relocation Assistance and Real Property Acquisition Policies Act (URA)
