Cook RECOMMENDATION: Direct staff perform necessary survey actions supporting the acquisition of the Thorp Mill by the Kittitas County Chamber of Commerce. BRIEFING SUMMARY: • Pursuant to Board of County Commissioner (BoCC) direction, Public Works (PW) has been working with the Thorp Mill volunteer group developing a long- term operational model for the Mill. • Feasibility work affirms there is an issue on property title that requires significant survey work resolving identified issues prior to any acquisition of Mill property. • Working with Chamber of Commerce staff, it appears there is interest on the part of the Chamber in acquiring the Mill and managing the site promoting county tourism efforts. • Working in partnership with the Chamber, PW proposes conducting the necessary survey work bolstering property title. • Ongoing support of Chamber tourism activities is consistent with the adopted tourism and recreation plan for the county. BACKGROUND: During 2023, PW conducted feasibility studies evaluating a public restroom in the current Mill parking lot. That work identified numerous issues with the Mill's property title and suggests to us that a larger effort resolving outstanding survey issues is required supporting Mill acquisition by the Chamber. DISCUSSION: The level of survey effort is anticipated to be in the 60-to-90-hour range for County Surveyor Turnbull. The survey issues require research similar to that recently conducted at the fairgrounds on behalf of the Prosecutors Office. Once the work is complete and actions taken in support of clear title, the Chamber will be in position to acquire the Mill site and begin management activities allowing the volunteers to support as needed rather than having to continue leading tourism efforts on their own. The County Surveyor's winter work program allows for the additional work element. Cook RECOMMENDATION: Direct CDSIPW coordinates with Board of County Commission (BoCC) administrative staff soliciting for committee membership. BRIEFING SUMMARY: • Unregulated short term vacation rentals are becoming more prevalent in the county particularly in upper county. * At two recent town hall meetings in Cle Elum and Easton, residents expressed frustration with the lack of regulation. * Community Development Services (CDS) staff are able to staff a BoCC committee first quarter of 2024. • CDS desires having draft code language to the Planning Commission by second quarter 2024. BACKGROUND: Recent town hall meetings have produced consistent concerns from Upper County residents regarding unregulated short-term rentals. The proliferation of internet advertising results in uncaptured lodging tax revenue from unregistered rental owners. Increasingly, county residents are lodging complaints about late night revelry from heavily occupied weekend rentals. Evaluation of how the United States census captures short term rentals in Kittitas County suggests the census data is marginally accurate. Census data reports a decline in short-term rentals during the past decade. DISCUSSION: Forming a BoCC committee of proponents and opponents to short-term rentals will likely inform staff of issues and obstacles to form a draft ordinance for Planning Commission and BoCC consideration second quarter of 2024. The target date will likely require the committee to meet twice monthly in the months of January, February, and March 2024. CDS staff will collect sample legislation from various counties in the state of Washington and utilize existing legislation to engage committee members on feedback regarding expectations of success and issues of implementation. Page 2 of 2 Public Works "Work Session Staff Report", 2023 KITTITAS COUNTY DEPARTMENT OF PUBLIC WORKS PUBLIC WORKS —BOARD OF COUNTY COMMISSIONERS 2023 STUDY SESSION STAFF REPORT STUDY SESSION DATE: November 13, 2023 TOPIC: CONSOR Task Order No. 1 Amendment ACTION REQUESTED: Direct Staff LEAD STAFF: Mark R. Cook RECOMMENDATION: Support Public Works (PW) staff decision amending CONSOR Task Order No. 1. BRIEFING SUMMARY: • PW negotiated a professional services agreement with CONSOR for road levy election support in November 2024. • Subsequently, the Board's attorney determined that the negotiated scope of work was inconsistent with restrictions against lobbying for election initiatives. • PW has amended the scope of work with CONSOR eliminating potential conflict with prohibitions and CONSOR has accepted the changes without additional cost to the contract. BACKGROUND: PW is facing a declining fund balance against increasing maintenance costs that is unsustainable. Our ten-year asset management plan offers two service levels: maintenance and rehabilitation/replacement. The maintenance service levels maintain road and bridge service levels but requires a road levy lift to maintain service levels for the next ten years. Absent supplemental levy funding, service levels will be reduced to rehabilitation/replacement. Given fixed revenues against increasing costs, PW will reduce maintenance levels on existing assets allowing some to move backwards (pavement to gravel) and forcing abandonment of others (bridge closures). Seeking to message well ahead of the road Ievy election, PW hired CONSOR for outreach and election support. DISCUSSION: Revisions to Task Order No. 1 remove focused effort on creating election campaign materials and redirect efforts towards public education and awareness. A redline version of changes is provided for Board of County Commissioner (BoCC) review (EXHIBIT 1). The revisions have been sent to the Board's legal advisor for concurrence. Our first task is to develop a list of key county stakeholders for CONSOR to interview. PW desires hearing from the BoCC identifying particular stakeholders the BoCC deems appropriate to begin the public outreach campaign. Cook RECOMMENDATION: Direct staff prepare enabling documents recognizing Bureau of Reclamation (BoR) design support. BRIEFING SUMMARY: • Recently, Public Works (PW) staff met with design staff from the BoR reviewing design deliverables supporting ongoing work along the Yakima River from Hanson Pit to Ringer Loop. • BoR staff from the Boise ID office have been working with our Water Resources Manager for the past year evaluating options for de -activating remaining elements of the Hanson Pits levee. • The design products are high quality and are anticipated to improve ecologic function and reduce flooding risk to county residents. • BoR provided this service to PW free of charge. • PW staff desires having the Board of County Commissioners (BoCC) formally acknowledge the BoR design support to BoR regional management. BACKGROUND: For the past several years, the Water Resources Division (WRD) of PW has been contemplating how best to remove the existing remnants of the Hanson Pits levee while managing potential adverse impacts to downstream residents. A team of hydraulic engineers from BoR offered assistance to the WRD and work has been ongoing for the past year. BoR provided this service at no cost to WRD. DISCUSSION: Since PW acquired the Moeur property several years ago, we have been working to design flood alleviation improvements benefiting the property owners downstream of the Hanson Pits levee and improving habitat conditions. Utilizing work conducted in support of the Schakee Levee setback project by BoR, BoR specialists have been able to hydraulically model numerous design approaches supporting Hanson Pits levee removal. The heavily damaged levee presents ongoing risk of avulsion into existing ponds associated with the levee and behind the levee. Page 1 of 2 Public Works "Work Session Staff Report", 2023 Recently, the design team travelled to Ellensburg presenting design and modeling results to the WRD, natural resource entities, and neighboring landowners. The innovative design significantly improves flood protection to county residents downstream of Hanson Pits. The design also improves floodplain function and creates new riparian habitat along the left bank of the Yakima River between Hanson Pits and Ringer Loop. PW desires to formally acknowledge the design team to BoR regional management staff. PW proposes creating acknowledgment by resolution with a letter signed by the BoCC for possible inclusion into the teams BoR personnel files. Page 2 of 2 Public Works "Work Session Staff Report", 2023 KITTITAS COUNTY DEPARTMENT OF PUBLIC WORKS PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS 2023 STUDY SESSION STAFF REPORT STUDY SESSION DATE: November 13, 2023 TOPIC: Bowers Field 2024 Discretionary Grant Constructing the Parallel Taxiway ACTION REQUESTED: Direct Staff LEAD STAFF: Mark R. Cook RECOMMENDATION: Direct staff continue working to build program credibility with the Federal Aviation Administration (FAA). BRIEFING SUMMARY: Recently, airport staff were notified of an FAA decision removing discretionary funding of ELN's parallel taxiway programmed for 2024. • JUB (airport engineer) is on track to deliver plans and specifications for taxiway construction in 2024, as programed for the past five years. Engineering staff from the Seattle Area District Office (SADO) met last month with the Airport Manager and Public Works Director discussing SADO's frustration with the proliferation of 75-year leases at ELN. • Responding to the concern, the Airport Manager briefed the advisory committee, and the committee recommends declaring by resolution the county's land lease policy of not exceeding thirty (30) years with a potential for two 10-year lease extensions. BACKGROUND: The adopted ELN Master Plan and Airport Layout Plan have been advancing the need to build a parallel taxiway to runway 11/29 since master plan adoption in 2018. An FAA design grant is nearing delivery by airport consultant JUB. The design is on schedule and Public Works (PW) was anticipating taxiway construction in 2024 as planned. The recent decision by the FAA canceling the 2024 construction grant was unexpected. DISCUSSION: While the FAA's decision canceling the 2024 parallel taxiway construction grant maintains dangerous conditions on runway 11/29 owing to the amount of back taxing taking place currently, it does not appear that the proposed 2026 reconstruction of runway 11/29 is in jeopardy. Failing to build the taxiway in 2024 does create an unknown impact on Central Washington University's flight program. Keeping the program operating during runway 11/29 2026 reconstruction, in the absence of a parallel taxiway, is an issue demanding problem solving on the part of airport staff, CWU and the SADO. The Page 1 of 4 Public Works "Work Session Staff Report", 2023 absence of constructing the taxiway in 2024 also maintains a single circuit for airport lighting and increases the potential for "rat" strikes. A rat strike in 2017 put the airport out of operation for several weeks as staff struggled to locate an appropriate (regulator/transformer) replacing the one that was destroyed in the rat strike. The entire electrical system appears to be direct buried electrical lines (EXHIBIT 2). At a recent update to the advisory committee regarding the cancellation of 2024 discretionary taxiway construction funding, the committee addressed staff s understanding of 75-year lease impacts. The committee recommended that staff prepare a resolution for Board of County Commission (BoCC) consideration setting the maximum lease term at thirty (30) years with two possible ten-year extensions. Staff supports taking this action and providing the signed resolution to the SADO. Staff has requested that SADO staff monitor regional airport improvement projects in 2024 and prioritize funding of the parallel taxiway in the event a programmed airport improvement fails to meet construction obligations. Staff understands that a certain amount of programmed improvements fail to meet delivery schedules every year and there may be an opportunity for re -programming construction funding. We will be in position to build in 2024 as taxiway design is scheduled for completion second quarter of 2024. Construction of east apron improvements appears secure for 2024 construction as the funding source is not FAA discretionary funding. FISCAL IMPACTS: ELN's 2024 capital improvement plan does not contain parallel taxiway construction. Hi Mark, Unfortunately, the 2024 discretionary funds that were planned for the Bowers Field new parallel taxiway grant will not be available for construction in 2024. The overall discretionary funds for 2024 were less than planned and many funding requests fell below the funding line. FAA recognizes the eligibility and need for the taxiway and other storm drainage improvements so we hope to find funds for the project in 2025 or 2026. Cook RECOMMENDATION: Formulate an action plan complementing the State's emergency management plan. BRIEFING SUMMARY: • The Washington State Department of Transportation (WSDOT) is preparing to award a bridge deck replacement contract for the Vantage Bridge along Interstate 90. • Recently, the County Engineer and Director met with fire/life/safety personnel from Chelan, Grant, and Kittitas Counties along with key WSDOT staff from North-Central and South -Central regions. • Safety and emergency response dominated the conversation. • Should we be considering a legislative response to anticipated bypassing traffic? BACKGROUND: WSDOT desires to start bridge deck replacement operations spring of 2024. The three- year project proposes maintaining two lanes of travel — one westbound and one eastbound (EXHIBIT 1 — EMERGENCY MANAGEMENT PLAN). Winter shutdown every year is planned for November 15 — March 15. The following weekends are planned for full bridge access: Memorial Day, July fourth (full week), and Labor Day. One -hour delays are forecast to be common on most weekends with holiday weekends pushing to 90 minutes. Weekend bypassing traffic onto Vantage Highway is likely. DISCUSSION: It is our understanding that WSDOT does not propose staffing the project 2417. It appears that the contractor will be responsible for having a contractor, Traffic Control Supervisor (TCS), present 24 hours during working days. It is possible that there will be no TCS available on weekends unless the contractor is working. Traffic model predictions affirm westbound delays to be likely during weekends with peak westbound traffic on Sunday afternoons. Delays resulting from heavy truck traffic climbing the Vantage grade will likely result in bypassing traffic onto Vantage Highway. Similarly, if eastbound traffic delays approach one -hour, bypassing traffic onto Vantage Highway is expected. A known "hole" in radio coverage exists in Vantage. Page 1 of 3 Public Works "Work Session Staff Report", 2023 Communication with Grant County responders depends on line of sight communication. During our meeting on October 26, 2023, we notified WSDOT of our communication restrictions and requested deployment of portable repeaters be given consideration. We also discussed various emergency response scenarios and all present recognized the difficulty getting to an accident at midspan with only two lanes of travel on the bridge. The narrow travel lanes (11 feet) and the proposed travel speed of 40 miles per hour appear to be problematic and likely to result in multiple accidents throughout deck replacement operations. We also discussed the possibility of a follow-on project — painting the bridge super -structure. Our recent painting experience of Thorp Bridge over the Yakima River suggests painting the Vantage Bridge will be multiple years with ongoing road closures. Alternative routes to I-90 are north to Wenatchee and south to Tri-cities. Added travel time is slightly over one hour in each direction (east and west). Given the project duration is three to four years, it may be prudent to evaluate county legislative solutions dealing with anticipated bypassing traffic. A Transportation Benefit District (TBD) could be formed allowing the use of various traffic control tools such as tolling or intermittent road closures. A deeper legislative dive is required before staff can fully advise the Board of County Commissioners. In the absence of evaluating a TBD, staff will develop a companion road closure plan for deployment when WSDOT closes eastbound traffic at Exit 115 in Kittitas. FISCAL IMPACTS: Staff has updated our mutual aid agreement with WSDOT in advance of the work starting on the bridge. The agreement allows cost share for agreed upon traffic control response measures. KITTITAS COUNTY DEPARTMENT OF PUBLIC WORKS PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS STUDY SESSION STAFF REPORT STUDY SESSION DATE: November 13, 2023 TOPIC: 2023 Road Standards Review Committee ACTION REQUESTED: Direct Staff LEAD STAFF: Joshua Fredrickson RECOMMENDATION: Affirm Public Work's decision to disband an informal group of stakeholders which reviewed proposed changes to Public Work's Road Standards BRIEFING SUMMARY: The Board of County Commissioners gave direction formulating an informal review committee in 2018. • The effort in 2019 stalled and Public Works reformulated an informal group of stakeholders in November 2023 to vet proposed changes to County Road standards. • The review committee has met and provided their input. • Proposed changes have been submitted to the Planning Commission and will be submitted for BOCC consideration. • With the review completed, the informal committee may be disbanded. BACKGROUND: PW recommended an informal committee of road standards reviewers comprised of the following stakeholders: • Land Developer • Land Use Planning Consultant • Local Engineering firm • Local Attorney and Land Use Developer • Local Realtor • City staff representative • County Engineer • Public Works Director County Road Standards (Title 12 of Kittitas County Code) were completely revised in 2018 using consulting services from KPG (PW Civil Consulting roster). The informal committee met and reviewed urban standards for inclusion into the Interlocal Agreement with the City of Ellensburg. Public Works is appreciative of the time and effort made by the informal committee to review the updated standards. DISCUSSION: The informal road standards review committee began meeting in December 2022 and concluded in the summer of 2023. Proposed revisions and adjustments to the road standard were submitted to Community Development Services for presentation to the Planning Commission. It is anticipated that code updates will be presented to the Kittitas Board of County Commissioners for consideration. With completion of the review process by the informal committee, Public Works proposes to disband the informal committee. This data prompted additional consideration and data collected at the intersection of Kittitas Highway and No. 6 Road. Due to considerations regarding this intersection, data reporting was delayed. Based on the characteristics of the roadway, traffic and speed data was collected at three locations: mile post 1.45, 1.73 and 2.14. The first segment, with data collected at mile post 1.45, has 18 percent truck traffic within the average daily traffic distribution of vehicle size. Traffic at this location is split 50.2% eastbound and 49.8% westbound. Overall 85th percentile speed at this location is 51.8 MPH with directional speeds of 52.6 MPH westbound and 51.1 MPH eastbound. The second segment, with data collected at mile post 1.73, has 20 percent truck traffic within the average daily traffic distribution of vehicle size. Traffic at this location is split 57.8% eastbound and 42.2% westbound. Overall 85th percentile speed at this location is 55.1 MPH with directional speeds of 54.0 MPH westbound and 56.3 MPH eastbound. The third segment, with data collected at mile post 2.14, has 17 percent truck traffic within the average daily traffic distribution of vehicle size. Traffic at this location is split 49.5% eastbound and 50.5% westbound. Overall 85th percentile speed at this location is 55.1 MPH with directional speeds of 54.9 MPH westbound and 55.3 MPH eastbound. DISCUSSION: 85th percentile speeds show traffic is operating at a speed greater than the current speed limit of 50 MPH. There are 38 approaches along this full segment of Kittitas Highway, primarily serving residential and agricultural uses. There were 38 recorded crashes along this roadway in the previous five years. The majority were located at the east end of the study segment, the intersection of Kittitas Highway at No. 6 Road. Dear .losh, As a resident of Kittitas County, living on the Kittitas Highway I am requesting a speed study be done so the speed limit can be reduced from the city boundary to the #6 Road. After seeing another accident at Mathews Road and Kittitas Highway today I feel the need is growing daily to reduce the speed. The traffic on this road has risen exponentially over the years. We have lived on this highway for over 32 years so I'm not a newbie to the situation. Driving a tractor and pulling equipment is becoming more dangerous all the time, also. BACKGROUND: Responding to concerns regarding the number of crashes reported at the intersection of Kittitas Highway at No. 6 Road, Public Works collected traffic and speed data of the intersection approaches. Public Works deployed traffic data collectors October 5, 2023, and collected through October 12, 2023. Data was collected at each leg of the intersection, including Kittitas Highway mile post 2.23 and 2.49, and No. 6 Road mile post 0.89 and 1.15. Reported crash data for the previous year was also reviewed for crashes which are susceptible to correction by a multi -way stop installation. Traffic and crash data were compared to guidance provided in the MUTCD. DISCUSSION: The 2009 Manual on Uniform Traffic Control Devices (MUTCD) section 2B.07 Multi - Way Stop Applications provides guidance on intersection control. MUTCD guidance includes review of crash data and traffic volumes of both the primary street (Kittitas Highway) and the minor street (No. 6 Road) of the intersection. Crash data reviewed was found to meet Criteria 2B.07(B) of five or more reported crashes in a 12-month period that are susceptible to correction by a multi -way stop installation. There were nine reported crashes in the previous 12-month period. Seven of these crashes are susceptible to correction by a multi -way stop installation. One crash was a rear end collision, and one crash was attributed to a vehicle malfunction. FISCAL IMPACT: The cost of posting the intersection of Kittitas Highway at No. 6 Road as an all -way stop is expected to be $10,000. ATTACHMENTS: Exhibit 1: 2009 MUTCD Section 2B.07 Exhibit 2: Speed Study Results Exhibit 3: Crash Data Count Exhibit 1: 2009 MUTCD Section 2B.07 Page 52 Section 2B.06 ST(& Sign Applltcations Guidance: 2009 Edition of At intersections where a full stop is not necessary at all times, consideration should first be given to using less restrictive measures such as YIELD signs (see Sections 2B.08 and 2B.09). 02 The use of STOP signs on the minor -street approaches should be considered if engineering judgment indicates that a stop is always required because of one or more of the following conditions: A. The vehicular traffic• volumes on the through street or highway exceed 6,000 vehicles per day; B. A restricted view exists that requires road users to stop in order to adequately observe conflicting traffic on the through street or highway, and/or C. Crash records indicate that three or more crashes that are susceptible to correction by the installation of a STOP sign have been reported within a 12-month period, or that five or more such crashes have been reported within a 2- ear period. Such crashes include right-angle collisions involving road users on the minor -street approach jailing to yield the right-of-way to traffic on the through street or highway. Support: 03 The use of STOP signs at grade crossings is described in Sections 8B.04 and 8B.05. Section 2B.07 MMuJ9 Wav Stap Application Support: of Multi -way stop control can be useful as a safety measure at intersections if certain traffic conditions exist. Safety concerns associated with multi -way stops include pedestrians, bicyclists, and all road users expecting other road users to stop. Multi -way stop control is used where the volume of traffic on the intersecting roads is approximately equal. 02 The restrictions on the use of STOP signs described in Section 2B.04 also apply to multi -way stop applications. Guidance: 03 The decision to install multi -way stop control should be based on an engineering stud v. 04 The following criteria should be considered in the engineering study for a multi -way STOP sign installation: A. Where traffic control signals are justified, the multi -way stop is an interim measure that can be installed quickly to control traffic while arrangements are being made for the installation of the traffic control signal. B. .Five or more reported crashes in a 12-month period that are susceptible to correction by a multi -way stop installation. Such crashes include right -turn and left -turn collisions as well as right-angle collisions. C. Minimum volumes: L The vehicular volume entering the intersection from the major street approaches (total of both approaches) averages at least 300 vehicles per hour for any 8 hours of an average day; and 2. The combined vehicular, pedestrian, and bicycle volume entering the intersection from the minor street approaches (total of both approaches) averages at least 200 units per hour for the same 8 hours, with an average delay to minor -street vehicular traffic of at least 30 seconds per vehicle during the highest hour; but 3. If the 85tr' percentile approach speed of the major -street traffic. exceeds 40 mph, the minimum vehicular volume warrants are 70 percent of the values provided in sterns l and 2. D. Where no single criterion is satisfied, but where Criteria B, C.], and C.2 are all satisfied to 80 percent of the minimum values. Criterion C.3 is excluded from this condition. Option: 05 Other criteria that may be considered in an engineering study include: A. The need to control left -turn conflicts; B. The need to control vehicle/pedestrian conflicts near locations that generate high pedestrian volumes; C. Locations where a road user, after stopping, cannot see conflicting traffic and is not able to negotiate the intersection unless conflicting cross traffic is also required to stop; and D. An intersection of two residential neighborhood collector (through) streets of similar design and operating characteristics where multi -way stop control would improve traffic operational characteristics of the intersection.
