STUDY SESSION STAFF REPORT
STUDY SESSION DATE: October 9, 2023
TOPIC: No. 81 Road Speed Study Results
ACTION REQUESTED: Schedule a Public Hearing receiving the Engineer's
Report on the Request for Speed Reduction
LEAD STAFF:
Joshua Fredrickson
RECOMMENDATION:
Schedule a public hearing receiving the County Engineer's report on the request
for speed reduction on No. 81 Road (MP 1.00 to MP 2.54)
BRIEFING SUMMARY:
• A resident requested a speed reduction on No. 81 Road (MP 1.00 to MP 2.54) on
August 22, 2023.
• The speed study was conducted on September 13, 2023, to September 20, 2023
• Speed study data collected at MP 1.32.
• Average daily traffic (ADT) of 849 vehicles, with 270 trucks (32%).
• ADT distribution is 50.0% northbound and 50.0% southbound.
• 85% speed at 53.6 Miles Per Hour (MPH) northbound and 57.6 MPH southbound.
• Seven crashes in the past five years.
BACKGROUND:
Responding to a request received on August 22, 2023, to reduce the posted speed on No.
81 Road between Vantage Highway and Snodgrass Road, Public Works deployed traffic
data collectors September 13, 2023, and collected through September 20, 2023. The
segment analyzed was from Vantage Highway to Lyons Road as the next main
intersection. Traff c and speed data was collected at mile post 1.32. This road segment
has 32 percent truck traffic within the average daily traffic distribution of vehicle size.
Traffic at this location is split 50.0% northbound southbound. Overall 85`h percentile
speed at this location is 55.6 MPH, with directional speeds of 53.6 MPH northbound and
57.6 MPH southbound.
DISCUSSION:
The overall 85th percentile speed show traffic is operating at a speed greater than the
current posted speed limit of 50 MPH. The 8P percentile speeds suggest this roadway
segment is more accommodating to speed than the current posted speed limit. The
roadway alignment is tangent through this section. There are 16 approaches along this
section of No. 81 Road, primarily serving residential uses. Other users include
agricultural use.
There were seven recorded crashes along this roadway in the previous five years. The
cause of four crashes was failure to yield the right of way. One crash was reported as a
rear end collision. One crash was reported as a failure to yield to oncoming traffic. And
one crash was reported as a semi -truck unable to navigate a turn.
FISCAL IMPACT:
None

CAUTION: This email originated from outside the Kittitas County network. Do not click links, open attachments,

The attached .pdf file is marked to show the area of interest.
The question is whether a reduction in the speed limit on the road from 50 to 35 mph is warranted between Vantage
Hwy. and the lane to 2451.
There seems to be high traffic usage of the road and at considerable speed. Sight lines on the west side of the
road (and on the north side of Vantage east of No. 81 Road) are often obscured to all but high clearance vehicles
attempting to enter. (Less in this year's drought than last year.)
There also seems to be a lot of traffic entering No. 81 rd. from the two drives of the subdivision.
I think it would be useful to measure traffic in two locations (approximate) as marked on the attachment. Both speed
and vehicle count at both locations would best inform decision making, but if not feasible, then the priority would be for
vehicle count at the more southerly point and the speed measurement at the point farther north.
Please advise.

KITTITAS COUNTY
DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
STUDY SESSION DATE: October 9, 2023
TOPIC: 2023 Annual Report for the 2019 Kittitas County
Hazard Mitigation Plan
ACTION REQUESTED: Issue press release
LEAD STAFF:
Arden Thomas
RECOMMENDATION:
Issue a press release informing citizens about our progress implementing the 2019
Kittitas County Multi -Jurisdictional Hazard Mitigation Plan.
BRIEFING SUMMARY:
• In 2019, Kittitas County adopted the 2019 Kittitas County Multi -Jurisdictional
Hazard Mitigation Plan (Resolution No. 2019-140).
• Since Kittitas County participates in the Community Rating System, we are
required to have an up-to-date Hazard Mitigation Plan and annually report on our
progress implementing the plan.
BACKGROUND:
In 2019, Kittitas County adopted the 2019 YOttitas County Multi -Jurisdictional Hazard
Mitigation Plan (Resolution No. 2019-140). Communities that would like to participate in
the Community Rating System (CRS) or apply for hazard mitigation grants are required
to have an updated Hazard Mitigation Plan.
The Community Rating System (CRS) is a program offered by the National Flood
Insurance Program which rewards communities that implement certain flood
management activities with lower flood insurance rates for their residents.
CRS communities are required to report annually on their progress implementing the
Hazard Mitigation Plan. Kittitas County staff have prepared a progress report for the
County -Wide and Kittitas County mitigation initiatives.
DISCUSSION:
This year Kittitas County has initiated etforts to update our Hazard Mitigation Plan
before it expires on September 15, 2024. Public input is important for Hazard Mitigation
Planning, so we are utilizing the press release to spread the word about the update and an
Page I of 4

online questionnaire for County residents. Since we experienced a drought this year, we
also emphasized progress advancing hazard mitigation measures for drought in the plan.
Key aspects of plan implementation continue to be addressed through Kittitas County's
normal work program. A key area for improvement would be to annually convene a
multi jurisdictional steering committee. We plan to address this need during the Hazard
Mitigation Plan update process.
FISCAL IMPACTS:
Hazard Mitigation Plan annual reporting and specific Flood Control Zone District project
funding is included in the Flood Control Zone District annual budget.

Kittitas County Continues to Prepare for and Respond to Emergencies and
Calls on Residents to Prepare and Provide Feedback.
Kittitas County continues to invest to make our communities more resilient to natural hazards
such as wildfire, flood, and drought. This year Kittitas County has also started updating the
County's Hazard Mitigation plan and is requesting feedback from the public.
To remain eligible for Hazard Mitigation Assistance from the Federal Emergency Management
Agency, Kittitas County must update its Hazard Mitigation Plan every 5 years. Kittitas County
residents can help with this update by participating in a brief mitigation and preparedness survey
located online at www.tin url.com/KittitasCoHMP. Tambien disponible en Espanol,
www.tinvurl-com/KittitasCol-IMP-Espanot.
This year, Kittitas County was affected by drought and the Department of Ecology issued a
drought declaration. Junior surface water users were curtailed and proratable users received
reduced allotments. The 2023 Progress Report details that significant progress has been made to
address drought conditions through efforts led by Yakima Basin Integrated Plan partners. These
drought mitigation measures include work to increase water storage and efforts by irrigation
districts, farmers, and homeowners to adopt water conveyance and irrigation efficiency
measures.
Additional information about specific actions Kittitas County has taken is available in the 2023
Progress Report available on the Kittitas County's Hazard Mitigation Website
(hgps://www.co.kittitas.wa.us/ ublic-works/hazard-miti ation- 1
As Kittitas County works to make our community more resilient to natural disasters, we also call
on our residents to prepare your home and family for a disaster. More information is available at
the www.ready.gov/plan website. Residents are also encouraged to sign up for alerts through the
Kittitas County Emergency Management Alerts (Everbridge) system. When the Kittitas County
Sheriff's office issues notifications about a potential safety hazard or situation involving
locations identified at registration, system users will be notified. To learn more and sign up for
these notifications, visit: httys://member.everbridge.net/index/337829242601599
For more information, please contact the Kittitas County Public Works at 509-962-7523.

KITTITAS COUNTY
DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
2023 STUDY SESSION STAFF REPORT
STUDY SESSION DATE: October 9, 2023
TOPIC: Noise Ordinance Update
ACTION REQUESTED: Direct Staff
LEAD STAFF:
Mark R. Cook.
RECOMMENDATION:
Direct staff.
BRIEFING SUMMARY:
• Deputy Prosecuting Attorney (DPA) Hartung has completed a review of the
county's noise ordinance against state requirements.
• Local governments are not required to adopt state standards (numeric decibel -
based systems).
• Any change to the County's ordinance is purely voluntary.
• Will changing to a decibel -based system create more staff workload and cost?
BACKGROUND:
Responding to a commissioner request, staff researched noise ordinances in the State of
Washington in addition to verifying Department of Ecology noise standards. Staff
presented results to the Board of County Commissioners (BoCC) on September 18, 2023.
DPA Hartung was in attendance and agreed to provide follow-up legal services. DPA
Hartung recently prepared a memorandum presenting the results of her work (attached as
EXHIBIT 1).
DISCUSSION:
Staff previously represented our concern over compliance in the wake of the recent order
of invalidity from the Growth Hearings Management Board on the Mardee Lake non -
project rezone matter. The analysis provided by DPA Hartung suggests that the staff
concerns are not material in the matter of the county's current noise ordinance being
compliant with state law. Given Ms. Hartung's analysis, it seems that any amendment to
our current ordinance (Chapter 9.45) will be completely voluntary in nature and not
required by state law. The matter for discussion is whether there is a need sufficient
enough to offset the workload amending the current ordinance. It is reasonable to assume
moving to decibel standard (used by the state and many WA counties), will add code
enforcement costs and could lead to neighbors using the county to mitigate neighborhood
disputes.

Re: County Noise Ordinance
Date: October 3, 2023
Legal Issues: What is the local government's role in regulating noise?
205 W 5th AVE suite 213
Ellensburg WA 98926
509-962-7520
prosecutor&a.kittitas. wa. us
Short Answer: Currently, there is no RCW or WAC that mandates a County impose a local
noise ordinance.
Legal Analysis: Local governments throughout the state have a varied approach to noise
regulations. Some entities utilize a decibel -based approach (similar to the Department of
Ecology) while others choose to regulate the actual noises themselves.
Chapter 70A.20 RCW contains the Noise Control Act. Additionally, the following three WACs
apply:
-Chapter 173-58 WAC
-Chapter 173-60 WAC
-Chapter 173-62 WAC
Local government is authorized, but not required to adopt a noise ordinance and set local noise
standards. Local government also has some discretion in how that noise ordinance is to be
enforced. Enforcement responses can include:
1) No response.
2) A visit from law enforcement informing the person of the complaint.
3) Seeking voluntary compliance.
4) Official noise measurement (if delineated in code, and proper equipment purchased -
which requires training and proper maintenance).
5) Issuing a citation which can be escalated to a misdemeanor after a certain number of
violations. (requires resources from law enforcement, prosecutor's office, courts, and
code enforcement).

If a local government opts not to impose a local noise ordinance, Washington State Department
of Ecology's rules apply. The same range of options for enforcement listed above would also
apply.
Local government can adopt Ecology's rules or adopt an entirely new ordinance. It the local
ordinance differs from Ecology's rules, the local government must submit its proposed ordinance
to Ecology for approval. Ecology has 90 days to either approve or deny the local ordinance. If
Ecology fails to respond within 90 days, the ordinance is considered approved.
Ecology's noise pollution rules contemplate setting maximum decibel levels, (dBA levels) for
residential, commercial, and industrial areas. To know whether the maximum dBA level has
been exceeded, the noise must be measured using an instrument called a sound -level meter. The
County does not currently own such a device. If a code were to be adopted that requires decibel
measurements, the County would need to purchase and maintain the equipment and train any
staff that will be using the device in its proper usage. If the County opts to adopt Ecology's
rules, the sound -level meter would also be required.
WAC 173-60-050 provides a list of exemptions for certain sounds during certain times. Those
exemptions include but are not limited to the following examples:
1) Aircraft engine testing
2) Sounds created by discharging firearms at shooting ranges
3) Sounds created by emergency vehicles
4) Sounds originating from officially sanctioned events, like parades
5) Residential construction
The County could choose to recognize more exemptions than afforded in the above -cited WAC
(again my examples were select and not the comprehensive list provided in the WAC).
The County codifies its noise control ordinance in Chapter 9.45 of the Kittitas County Code.
The code was amended pursuant to Ordinance No. 2016-009, which is attached hereto for your
reference. Included with that ordinance is a letter of approval from the Department of Ecology.

It appears that the County's current noise ordinance is valid and complies with State law. It can
always be amended if desired, but amendments will need to be approved by Ecology.

DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
2023 STUDY SESSION STAFF REPORT
STUDY SESSION DATE: October 9, 2023
TOPIC: Baker's Acres Petition Request
ACTION REQUESTED: Direct Staff
LEAD STAFF:
Mark R. Cook.
RECOMMENDATION:
Direct staff.
BRIEFING SUMMARY:
• Ongoing Suncadia construction traffic cutting through Evergreen Estates and
Baker's Acres is creating community frustration.
• Public Works (PW) has received a community petition requesting a gate be
installed at the intersection of Bakers/Winston Roads (approximately 50
residents).
Snow removal operations and access to a privately managed rock pit require
consideration.
BACKGROUND:
For the past several years, PW has placed barricades at the end of Winston Road
attempting to thwart Suncadia construction traffic from cutting through Evergreen Estates
and Bakers Acres subdivisions. Thus far, we have not been able to achieve total success
as offenders create new routes around every barricade placement. Attempts to secure
new berm construction along Swiftwater Drive have not resulted in any action on the part
of Suncadia. PW has successfully opened Swiftwater Drive at Highway 903 allowing
construction access at this location.
DISCUSSION:
Contractors continue short -cutting Swiftwater Drive at Highway 903 by using local
roadways in Evergreen Estates and Bakers Acres. It is possible to install ecology blocks
and a gate at the end of public right of way on Winston Road. It will then be necessary to
provide a fire access box and possibly a key to the owner of the private rock pit located
between the proposed gate location and Swiftwater Drive. The gate would then be
opened by PW staff during winter snow removal operations allowing for continued use of
the right of way for snow storage. It is presumed that once PW begins stacking snow in
the right of way no contractor will attempt accessing Swiftwater Drive.
Prior to installing the proposed gate, PW will reach out to local fire districts and Suncadia
management informing them of our pending action. In the past, a local resident has
Page 1 of 3
Public Works "Work Session Staff Report", 2023
complained about restricted access to the Cle Elum River. Since then, PW has worked
with Suncadia permanently opening Swiftwater Drive at Highway 903.
FISCAL IMPACTS:
The gate is anticipated to cost in the range of $8-10,000 and would be paid for by the PW
road maintenance budget.

PETITION to Kittitas County Public Works to CLOSE BAKERS AND WINSTON ROADS TO
SUNCADIAISWIFTWATER DRIVE TRAFFIC AT THE INTERSECTION OF
BAKERSNVINSTON ROADS WITHIN THE BAKERS ACRES NEIGHBORHOOD.
We, the undersigned, do hereby petition for approval to close *'"access to our neighborhood
from Swiftwater Drive traffic where Bakers Road intersects with Winston Road, so as to prevent
our small, residential neighborhood from becoming a SHORTCUT thoroughfare to highway 903
for Suncadia residents and vacationers, especially upon the NELSON LAKES development
completion.
Whereas Suncadia and its newest Nelson Lakes development already enjoy Swiftwater Drive to
highway 903 AND Bullfrog Road access, and whereas Nelson Lakes will bring hundreds, and
eventually thousands of vehicles and vacation renters to to the area adjacent to Bakers Acres,
we implore the County to close off our neighborhood to Swiftwater Drive traffic immediately by
simply moving the existing ecology blocks to the intersection of Winston and Bakers Roads.
G
*Bakers Acres and Evergreen Valley will retain their two points of access they have always had
at Morel Rd/903 and Winston Rd/903.
*In addition to the ecology blocks, a knox box gate for the Fire Department at the intersection
of Winston and Bakers Roads would provide two-way emergency access NOT currently enjoyed
by first responders.

KITTITAS COUNTY
DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
2023 STUDY SESSION STAFF REPORT
STUDY SESSION DATE: October 9, 2023
TOPIC: Interstate 90 Bridge Repair Update
ACTION REQUESTED: Direct Staff
LEAD STAFF:
Mark R. Cook
RECOMMENDATION:
Support staff efforts complementing Washington State Department of Transportation
emergency closure plan for Interstate 90.
BRIEFING SUMMARY:
• Washington State Department of Transportation (WSDOT) is finalizing the bidding
process supporting repairs to the Interstate 90 (I 90) Bridge at Vantage.
o Given the repair duration (estimated currently at three years) staff are working with
WSDOT developing an emergency closure plan for 190 and associated impacted
local roadways in Kittitas County.
• County Engineer Fredrickson and Director Cook are participating in a tabletop
exercise with WSDOT and law enforcement in Wenatchee on October 26, 2023.
• Staff will continue updating the Board of County Commissioners as we move
through the process with WSDOT.
BACKGROUND:
The 190 Vantage Bridge has been deteriorating for several years and requires full deck
replacement. Preliminary impacts to 190 traffic have suggested three years will be likely
supporting the repairs. The schedule will be finalized once the bid award and final contract
negations conclude.
DISCUSSION:
It is likely that WSDOT will close eastbound access at Exit 115 (Kittitas) during
emergencies. We will need to follow that closure at Vantage Highway, or it is likely that
traffic will cycle onto Vantage Highway and load up at the Vantage interchange. Staff is
hoping the October 26' tabletop exercise in Wenatchee will shed additional light on
necessary road closures. During an October 2, 2023, meeting with WSDOT project staff,
several options were discussed for using local roadways during declared emergency events.
FISCAL IMPACTS:
Undetermined at this time.

Why is WSUrT doing this?
The bridge deck, columns and struts are showing signs of significant deterioration. Since 2019, WSDOT has discovered
dozens of through -deck holes requiring emergency repairs.and lane closures. In 2020, three holes were discovered in
one day. Approximately $518,000 has been spent over the last several years to repair the bridge deck, many of which
were emergency repairs resulting in multiple travel impacts and a total of 85 days of lane closures. The Vantage Bridge
was built in 1962 and the last time the, bridge received a major overhaul was in 1982.
What do travelers need to know?
During construction, the bridge will be reduced to one lane in each direction and the speed limit will be reduced.
Travelers will experience long delays and congestion during construction. Contractor crews will open up traffic to
four lanes for the following weekends: Memorial Day, Fourth of July, Watershed (early August), and Labor Day
Project timeline
Construction start: Fall 2023
Construction completion: Fall 2027
