RESOLUTION TO AUTIIORIZE CONTRACT AMENDMENT EXECUTION
WHEREAS, Kittitas County and Contractor entered into a professional services contract in April 2021;
and
WHEREA$ the contract expiration date is September 30, Z02l and
WHEREAS, both the County and the Contractor desire to amend the agreement to allow for a contract
extension until March 2022 as detailed in the amendment that is attached hereto and
hereby incorporated by this reference;
NOW THEREFORE' BE IT RESOLVED that the Board of County Commissioners of Kittitas County,
Washington, authorizes execution of the contract amendment allowing for a contract
extension until March 2022 as detailed in the attached amendment.

CONTRACT FOR BUILDING USE

Ellensburg First United Methodist Church (EUMC) seeks to further its ministry to the
community by welcoming individuals and groups into its facilities and programs. We are
committed to community outreach by sharing our meeling facilities with community
agencies, organizations, and programs that support the mission and vision ol this
congregation.
Building use activities fall under the auspices of the Church Leadership Team and the des-
ignated Building use coordinators. No commitment for building use will be
finalized until these designees and/or the representative of thacontracted entity agree to
this building use agreement. lf the terms of the building use agreement or this contract are
not met during the contracted period, EUMC reserves the right to stop/dissolve the
agreement and/or to issue financial charges that have been incurred tor building mainte-
nance and/or custodial services as a result of the breach in the agreement. The
programs and people of EUMC are the top priority when building use requests are consid-
ered/issued. EUMC contracts with community groups for extended, long-term use as
well as short-term usage.
Approval of the use of the grounds and facilities of EUMC does not constitute or imply en-
dorsement of a group, their mission, or their positions. Groups approved to use facilities at
EUMC must not advertise lhe event in such a way as to imply endorsement by the congre-
gation, No activities or advocacy may take place within EUMC, its buildings, orgrounds if
the activities or advocacy conllict with the Discipline and the practices of this congregation
and the United Methodist Church.
Effective Dates of Agreement
1. Parties to Agreement: EUMC and the Kittitas County Public Health Department
(](CPHD).
2. Areas of Building to be Used: Classroom 2
3. Days and Times of the Use: This will be dedicated space for the Kittitas County
Health Department to use at their discretion Monday . Fridays.
4' Term of Use: For the following time period: beginning and ending dales Aprit 2021
- september 30,2021. This, agreement is contingent on KCpHD securing funding
through an agreement with the University of Washington, This agreement will not be-
come effective until KCPHD notifies EUMC in writing that the agreement with the Uni-
versity of Washington has been secured,
5. Purpose of Use: Classroom for KCPHD/U\I/ research project.

7. Special conditions: KCPHD will be responsible for cleaning the classroom. Empty

B. Termlnation:
This agreement shall cgntinue for the agreed lerm, or untileither party terminates this
agreement by giving at least thirly (30) days written notice. User shallvacate the
Premises imrnediately upon termination of tlre agreement.
9. Notices and Contact lnformation:
All notices pertaining to this agreement shall be made in writing to the parlies
at the lollowing addresses and phone numbers: Church otfice (EUMC, Z10 N. Ruby
Street, Ellensburg, WA 98926, 509-962-9257). Building Use Managers:

10. Conditions of Use:
a. Rental Fees shall be submitted by the 1st week of every month or the comple-
lion ol the contractualterms above. Please remit to paymenls to EUMC in care of
Bill tseals, lreasurer.
b. Church policy requires no smoking or firearms on the premises.
c. Alcoholic beverages shall not be brought onto the premises unless the user
group has been given permission well in advance ol the event from the Buildinq
Use Managers,
d. The premises shallbe a violence-free zone.
e. User shallnot discriminate on the basis of gender, race, age, sexualorientation,
national origin, mental or physical disabilities, marital slatus or economic condition.
f. All children within the church building or grounds MUST be supervised by the
User group and not allowed to be in any areas of the building or its premises with-
out an adult supervisor. This practice is consistent with the "Safe Sanctuaries" for
children and youth policy adopted by this congregation.
The following guidelines of the Safe Sanctuary policy are particularly important:
i. The Safe Sanctuaries policy typically requires no fewer than two adults to be
present at alltimes during a program or event involving ohildron. The Kittitao
County Public Heallh Department is authorized to have a single staff person with
all required state background checks overseeing the children of clients without a
second adult present.
ii. At least one of the adults present should be competenVcurrently certifiod in
First Aid and CPR.
iii. The program staff rnust readlhe$afe Sanctuary policy and agree to its terms
as mandated reporters of child abuse. lf a case ol child abuse is observed by
KCPHD Staff within their group, or by other groups on the church premises, while
KCPHD Staff is present, the incident must be reported to the Church Secretary in
addition to the reporting process used by the KCpHD.
iv. Any questions regarding this Sale Sanctuary policy should be directed to the
Building Use Coordinators (Failure to adequately supervise children willbe a vio-
lation of this rental agreement.)
g. lf usage day, times, area, or number of participants changes for this User, the
responsible party for the User must report these changes to the Building Use Managers
or the Office Secretary.
h. Please place all recyclables in blue bins around the church. Place trash in the large
receptacle provided in the courtyard, oulside the classroom door.
i. No cooking is permitted in the Courtyard Classrooms. Food and beverage may only
be consumed on the hard surfaces of the classrooms, no food or beverage (other than
water) on carpeted areas.
j' Classroorn Users are expected to check the restrooms for general cleanliness and
ensure that loilets are flushed and laucets and lights are turned otf. problems
should be reported to the Church Secretary.
k. Users are expected to turn otf all lights in the classroom before exiting the facilities
and to leave the area neat and tidy.
L Church functions and activities have priority over other renters. Rental applications
are considered in the order received.
m. ln the case of ongoing use, such as weekly or monthly rental of facilities, the Church
reserves the right to pre-empt use of the premises. ln such cases, at least a one week
advance notice will be given to the User group representative.
n, All requests for additional usage o{ premises outside of times and locations listed in
this contract must be made by the user at least one week in advance of the
requested usage date. A fee may be charged for this extra usage.
o. Decorations must not be taped to the walls in any areas of the building.
11. Other Conditions of Use:
a. Outdoor restrooms must be locked after each use.
b. User will not duplicate building keys. Any anempts to do so will be considered a
breach of this Contract. lf additionalkeys are needed, a requesl must be made to the
Building Use Managers.
c. Failure to comply with these Conditions may result in termination of this Contract.
12. Hold Harmless Agreement:
Ellensburg United Methodist Church, indemnifies, holds harmless and delends the
Kittitas Public Health Deparlment and its agents and employees from all suits and actions,
including reasonable attorneys'fees and all costs ol litigation and judgment of every name
and description against the Kittitas County Public Health Deparlment as a result of loss,
damage or injury to person or property by reason of our actions or omission by our organi-
zation for the purpose of ,renting an educational facility. Kittitas County Public Health De-
partment indemnifies, holds harmless and defends the Ellensburg United Methodist Church
and its agents and employees from all suits and actions, including reasonable attorneys'
fees and all costs of litigation and judgment of every name and description against the
Church as a result of loss, damage or injury to person or property by reason of our actions
or omission by our organization for the purpose of providing an educalional program.
13. Emergency lssues and Church Response

to conduct routine maintenance. We will work to notify and deconflict this maintenance
witlt tlie rentet. Should the maintenance be urgent, we will work to notify the rontor but
will enter the space as needed to conduct the maintenance.
ln the event that a nonomergency maintenance issue is identified by the renter please e-
mail secretary@ellensburgumc.org and provide a detailed description of the issue. lf
emergency mainlenance is required please call Andrew Van Den Hoek at the following
numbers immediately, cell- (520) 508-5223, office - (509) 963-3520. lf he cannot be

that order.
14. Breach of Agreement:
ln case of breach of agreernents, the other parly shallgive notice to the party in breach,
stating the nature of the violation. The breaching party shall have fourteen (14) days from
dale of receipt of the notice to remedy the breach, lf the condition is not corrected within
that period, the other party may terminate this agreement immediately, provided that
notice of termination shall be sent to the parly in violation.
1 5. Mandatory Mediation:
a. lf a dispute arising between the two parties ol this contra-et oeeurs, both parties agree
that before entering into litigation, they willfirst submit such dispute for resolution to the
Dispute Resoluti'cn Cenier (509-925-5123) or its successor organization, and will make
a good faith effort to reach agreement through that process. Either party may initiate
the mediation process upon written notice to the other party. Each party shall bear its
own costs for the service. ln the event that the DRC no longer exists and has no suc-
cessor organization, the initiating party shall submit a list of three mediation seruices/
individuals to the other party. The second party shall have ten working days to select
one provider from the list. lf the responding party tails to select one of the three within
that time, the initiating parly shallselect from the three.
b, This agreement {or mandatory mediation does nol apply to claims for personal injury
or claims that arise out of lhe commission of a crime; nor shall it atfect the amount ot
coutl-ordered restitution to be paid by one party to the other in a criminal case.
