At 1:30 PM Chairman Cory Wright opened the Community Development
Services Study Session.

REQUEST TO APPROVE A RESOLUTION APPOINTING TWO HEARINGS EXAMINERS TO
SUPPORT THE BOARD OF EQUALIZATION
Jamey Ayling briefed the Board of County Commissioners on the Board of
Equalization and requested support for Resolution 2023-163 appointing
two Hearings Examiners and updating wages. Vice Chairman Brett Wachsmith
moved to approve Resolution 2023-163. Chairman Cory Wright seconded the
motion. Motion approved.
TITLE 16 CODE AMENDMENT DISCUSSION
Jamey Ayling requested the Board of County Commissioners review and
consider accepting the changes proposed to county code. Jamey Ayling
stated the proposal includes new language for notifications. The Board
directed staff to prepare documents for consideration at the next agenda
session.

ACTION REQUESTED: Request to Approve a Resolution Appointing Two
Hearings Examiners to Support the Board of Equalization.
BACKGROUND: The Board of County Commissioners recently assigned the
Board of Equalization from the Commissioners' Office to
Community Development Services. With this move, staff
began researching the potential to hire a Hearings Examiner
to advise the Board of Equalization on appraisal appeals.
Washington Administrative Code 458-14-436 specifically
addresses the use of a Hearings Examiner to support the
Board of Equalization. With the sufficient staffing of the
citizen Board of Equalization, staff has prepared a job
description for the Hearings Examiner and a Request for
Proposal to support the hiring of the Examiner.
A Request for Proposals was advertised for a three-week
period and proposals were due for consideration by
Thursday, August 31, 2023, at 5:00pm. Staff did not
receive any Request for Proposals by the published
deadline.
At a recent Board of Equalization meeting, staff solicited
current members for interest in supporting the Board of
Equalization by submitting qualifications to serve as
Hearings Examiner. Two members expressed interest,
appear highly qualified and staff is recommending moving
forward with the hiring of two Hearings Examiners to
support the current workload.
Ensuring future success of the BOE Hearings Examiner
process, the proposed legislation also provides for BOE
member training creating the opportunity for fixture
hearings examiners. The revised process is expected to
result in shortening the BOE annual process.
INTERACTION: Community Development Services.
RECOMMENDATION: Approve the Resolution to Hire Two Hearings Examiners
to Support the Board of Equalization.
HANDLING: Return one original to Public Works for Community
Development Services.

AUTHORIZING THE HIRING OF TWO HEARINGS EXAMINERS SUPPORTING THE
BOARD OF EQUALIZATION
WHEREAS: Kittitas County Public Works advertised a Request for Proposals to support the
hiring of a Hearings Examiner for the Board of Equalization (BOE) in August
2023;and
WHEREAS: Submittals were due on August 31, 2023; and
WHEREAS: No submittals were received by the advertised due date; and
WHEREAS: Kittitas County Public Works staff solicited current BOE members for interest in
supporting the Board of Equalization to serve as Hearings Examiner and to
submit qualifications; and
WHEREAS: Staff received interest from two highly qualified members expressing interest to
serve as Hearings Examiners to support the current BOE workload; and
WHEREAS: Kittitas County Public Works recommends hiring two BOE Hearings Examiners
at this time and compensation shall be $75.00 per hour; and
WHEREAS: BOE members desire being trained as future Hearings Examiners and the
compensation for training shall be $35.00 per hour.
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the best
interest of the public, does hereby authorize the hiring of two Hearings
Examiners supporting the BOE setting the hourly rate at $75.00 per hour and
offering $35.00 per hour for BOE trainees.

STUDY SESSION DATE: September 25, 2023
TOPIC: Title 16 Code Amendment
ACTION REQUESTED: Authorize CDS staff to proceed with code amendment out of
docket cycle.
LEAD STAFF:

RECOMMENDATION:
Amend Title 16 adding section 16.24.270 adding a Certificate of City of Ellensburg for final
plats receiving city utilities inside the Urban Growth Boundary of the City.
BRIEFING SUMMARY:
In working with the newly adopted ILA with City of Ellensburg staff, we are conducting joint
review of projects with no mechanism to document said reviews. A solution verifying joint city
county reviews has been recognized with a need for a process besides email, which can
sometimes be overlooked. Staff suggests amending KCC Title 16 to require a signature block for
City departments to sign off on mylars for plats within the urban growth area of the City
receiving city utilities.
BACKGROUND:
City staff contacted County staff with concerns that a plat within the UGA had been recorded
without City review. After reviewing records, it was determined that the City had been notified
but failed to review and respond to the request for comment. In order to avoid these situations in
the future, staff considered alternative methods of notification and decided that a City signature
line on the plats would be a viable solution.
DISCUSSION:
Planning Manager Ayling met with the City of Ellensburg City Engineer Derek Mayo and
proposed the attached code language to remedy the plat review conflicts. The City is in
concurrence that this is a viable solution.
FISCAL IMPACTS:
No fiscal impacts are anticipated.

In the event that the property described in such plat, or any part thereof shall be located in the urban
growth area of the City of Ellensburg and receives city utilities, the Public Works Director or his
designee shall review such plat before the approval of the Board of County Commissioners. The
following form of certificate shall be filled out on said plat and signed by the City Engineer and
Community Development Director.
