BACKGROUND: Public Works received an application to vacate the right-of- way for a portion of I" Street in Easton identified in the Plat of South Easton, Book 1 of Plats page 24 in July 2023. The County Engineer and County Surveyor conducted research pursuant to the request and finds no reason denying the request for vacation. Once vacated, the land will become attached to adjoining properties and add to the taxable land mass of the County. This road, being proposed for vacation, was never constructed and the dedication for public use requires a vacation by the County. INTERACTION: Public Works. RECOMMENDATION: Conduct a Public Hearing and authorize the requested vacation of right-of-way. HANDLING: Return one original to Public Works. ATTACHMENTS: Engineer's Report; Resolution; Location map. The applicant (Nathan Graham) is requesting vacation of platted right-of-way of a portion of I" Street which divides the applicant's and three other parcels (EXHIBIT 2). The plat identifies the parcel as Lots 1, 6, 7 and 12. The right-of-way is located portion of the Section 14, Township 20 North, Range 13 East, Willamette Meridian, Kittitas County, Washington. Kittitas County Code 12.22.040 requires a Director's Report for all vacation requests. Whether County Road right of way should be vacated or abandoned. 2. Whether road is in use or has been in use. 3. The condition of the road. 4. Whether it will be advisable to preserve it for the county road system in the future. 5. Whether the public will benefit by the vacation. 6. A determination by appraisal of the fair market value of the area sought to be vacated. 7. The classification of the road area according to the type of expenditures made. 8. Whether the proposed area to be vacated contains utilities. 9. All other matters which will be of interest to the Board including an itemized list of costs and expenses incurred in the examination, report, appraisal, and all proceedings pertaining to such petition to vacate and abandon. Required Report Elements Pursuant to KCC 12.22.040 (Mirror RCW 36.87.040): 1. Plat of South Easton found in Book 2 of Plats page 24 is dated 1902 (Exhibit 3). The 50- ft. right-of-way is dedicated to the County for public use. The portion of right-of-way being requested for vacation divides the applicant's parcels and terminates at the southern parcel line at lots 7 and 12, adjacent to previously vacated right-of-way. 2. The portion of I" Street right-of-way being sought for vacation has not been in use (road never built). The right-of-way crosses with an alley way which would provide an access route to the property to the east. 3. There is no road condition to report on. 4. As there has been no road constructed, there appears to be no need to preserve the right- of-way for public use. Surrounding parcels have either an existing access constructed, or an easement to their property which does not require the use of right-of-way being proposed for vacation. The alley way is proposed to remain on the plat to present available ingress and egress route to a parcel to the east. 5. The proposed vacation allows for full use of the property by the requestor and will add to the tax parcel calculation providing additional property tax value for the County. 6. There is no fair market valuation associated with this request as there is no adverse financial impact to the County (no historic or current expense to the County for the right- of-way). 7. There is no historic or current expense to the County for the rights -of -way. 8. There are no utilities of record contained in the requested vacation of rights -of -way. 9. The requestor has paid the Public Works "Road Vacation Application Fee" of $3,888.00. The amount is expected to cover all costs associated with processing of the application. The Department of Public Works recommends the Board approve the proposed vacation of portions of Pt Street (EXHIBIT 2) as requested. 411 N. NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the best interest of the public, does hereby authorize the vacation of right-of-way of a portion of 1 s` Street located in Plat of South Easton (attached) and directs the County Engineer to update (as pertinent) the County Road Log and other documents associated with the rights -of -way vacation.
