SEPTEMBER 5, 2023 Board members present: Chairman Cory Wright & Vice-Chairman Brett Wachsmith. Excused: Commissioner Laura Osiadacz. Others: Julie Kjorsvik, Clerk of the Board; Mandy Buchholz, Office Administrator; Stephanie Hartung, Chief Civil Deputy Prosecutor; Josh Frederickson, Engineer; Katrina Mankus, Juvenile Court Administrator; Patti Stacey, Facilities & Waste Operations Director; Brian Carlson, Budget & Finance Director; and 1 member of the public. CALL TO ORDER Chairman Wright called the meeting to order. PLEDGE OF ALLEGIENCE Chairman Wright led the Pledge of Allegiance. INTRODUCTION OF NEW COUNTY EMPLOYEES – NONE PROCLAMATIONS PROCLAMATION NATIONAL VOTER REGISTRATION DAY COMMISSIONERS Vice-Chairman Wachsmith moved to approve a Proclamation declaring September 19, 2023, as National Voter Registration Day, and to encourage citizens to check their registration at VoteWA.gov to ensure they are ready and able to vote in the upcoming election. Chairman Wright seconded. Motion carried 3-0. PROCLAMATION CONSTITUTION & CITIZENSHIP DAY COMMISSIONERS Vice-Chairman Wachsmith moved to approve a Proclamation declaring September 17, 2023, as Constitution Day and Citizenship Day in Kittitas County, and encourage all residents to join in a celebration near rotary Pavilion to reaffirm commitment to a strong adherence to the foundational principles put forth in the Constitution and law for naturalization citizenship. Chairman Wright seconded. Motion carried 2- 0. 09/05/2023 MINUTES 2 PROCLAMATION NATIONAL DAY OF SERVICE & REMEMBRANCE COMMISSIONERS Vice-Chairman Wachsmith moved to approve a Proclamation declaring September 11, 2023, as National Day of Remembrance and call upon the citizens of Kittitas County to honor the lives of those lost by participating in community service and remembrance ceremonies on that day and throughout the year. Chairman Wright seconded. Motion carried 2-0. AGREEMENT YAKIMA COUNTY JUVENILE DETENTION FACILITY JUVENILE Approve an Agreement between Kittitas County and Yakima County, for housing of Juveniles at the Yakima County Juvenile Detention Facility, at a rate of $150.00 per day, from January 1, 2024, through December 31, 2024. RESOLUTION 2023-146 INSULIN PRICING LITIGATION PROSECUTOR Approve Resolution No. 2023-146, Authorizing Participation in Insulin Pricing Litigation and to authorize the Kittitas County Prosecutor’s office to engage Keller Rohrback L.L.P. for the representation. RESOLUTION 2023-147 KITTITAS COUNTY EVENT CENTER COMMISSIONERS Approve Resolution No. 2023-147, Authorizing an Internal Contract for Award of LTAC Funding, and the 2023 Operational Agreement between 09/05/2023 MINUTES 4 Kittitas County and the Kittitas County Event Center, in the amount of $206,500.00, from the Kittitas County Lodging Tax Funding, to provide labor and bus costs to the 2023 Kittitas County Fair & Rodeo. RESOLUTION 2023-148 EVENT CENTER & CITY OF ELLENSBURG COMMISSIONERS Approve Resolution No. 2023-148, Adopting the Distribution of the 2023 Tourism-Related Small-Scale Municipality-Owned Capital Project Grant Funds and Agreements between Kittitas County and the City of Ellensburg, in the amount of $50,000.00 for the Unity Park Shade Tents, and between Kittitas County and Kittitas County Event Center, in the amount of $89,600.15, for the 2023 Outdoor LED Lightning project. AGREEMENT DEPARTMENT OF ECOLOGY SOLID WASTE Approve Agreement No. SWMLSWFA-2023-KiCoSW-00195, between the State of Washington Department of Ecology and Kittitas County Solid Waste, in the amount of $354,888.67, to provide funding for waste reduction and recycling activities and household hazardous waste collection and disposal in Kittitas County from July 1, 2023, through June 30, 2025. AGREEMENT J.M. PACIFIC CONSTRUCTION MAINTENANCE Approve an Agreement between Kittitas County and J.M. Pacific Construction, in the amount of $95,280.00, for the Upper District Court Parking Lot project. AGREEMENT KNIT MAINTENANCE Approve a Professional Services Agreement between Kittitas County and KNIT, to provide Architectural Services to assist with projects at the Jail and other County buildings, beginning September 5, 2023, and continuing until completion of the projects. RESOLUTION 2023-149 J.M. PACIFIC CONSTRUCTION MAINTENANCE Approve Resolution No. 2023-149, Awarding a Bid to J.M. Pacific Construction, Inc. for the Kittitas County Upper Courthouse Parking Lot project. CHANGE ORDER CONCORD CONSTRUTION MAINTENANCE Approve Change Order No. 004, with Concord Construction, Inc. for the Kittitas Bloom Pavilion Addition project. REQUEST TO APPROVE A RESOLUTION AUTHORIZING CLOSURE OF THE LIMITED PURPOSE LANDFILL – ITEM MOVED TO BOARD DISCUSSION & DECISION 09/05/2023 MINUTES 5 AGREEMENT WISE PUBLIC HEALTH Approve a Professional Services Agreement between Kittitas County and WISE, in an amount not to exceed $35,000.00, to provide training and technical assistance specific to Developmental Disabilities programs, from July 1, 2023, through June 30, 2024. AGREEMENT ELMVIEW PUBLIC HEALTH Approve a Professional Services Agreement between Kittitas County and Elmview, to provide employment and day services for people with development disabilities in Kittitas County, from July 1, 2023, through June 30, 2024. AGREEMENT KITTITAS COUNTY HEALTH NETWORK PUBLIC HEALTH Approve a Professional Services Agreement between Kittitas County and the Kittitas County Health Network, in the amount of $30,000.00, to provide needs of general public, parents, and children or adults diagnosed with developmental disabilities, from July 1, 2023, through June 30, 2024. AGREEMENT KITTITAS VALLEY OPPORTUNITIES PUBLIC HEALTH Approve a Professional Services Agreement between Kittitas County and Kittitas Valley Opportunities, in the amount of $26,360.00, to provide the needs of general public, parents, and children or adults diagnosed with developmental disabilities, from July 1, 2023, through June 30, 2024. PUBLIC NOTICE BOARD OF HEALTH PUBLIC HEALTH Approve a Public Notice advertising for a representative from public health, public health care facilities, and providers to fill a vacancy on the Kittitas County Board of Health, to be accepted until September 21, 2023, at 5:00 p.m. and to authorize the Clerk to publish said notice. AGREEMENT JANIS FOWLER dba PLANNING DREAMS PUBLIC HEALTH Approve a Professional Services Agreement between Kittitas County and Janis Fowler dba Planning Dreams, to provide employment and day services for people with developmental disabilities in Kittitas County, from July 1, 2023, through June 30, 2024. SET PUBLIC HEARING 6-YR TIP & ANNUAL CONSTRUCTION PUBLIC WORKS Approve Setting a Public Hearing to consider the Adoption of the Six- Year Transportation Improvement Program for 2024-2029 and the Annual 09/05/2023 MINUTES 6 Construction Program for 2024, to be held on Tuesday September 19, 2023, at 2:00 p.m. in the Commissioners Auditorium, Room 109, Kittitas County Courthouse 205 West 5th Avenue Ellensburg, WA and to authorize the Clerk to publish said notice. SET PUBLIC HEARING ROAD VACATION – 1ST STREET PUBLIC WORKS Approve Setting a Public Hearing to consider a Road Vacation request for Vacating a Portion of 1st Street Public Right-of-Way in Easton, to be held on Tuesday September 19, 2023, at 2:00 p.m. in the Commissioners Auditorium, Room 109, Kittitas County Courthouse 205 West 5th Avenue Ellensburg, WA and to authorize the Clerk to publish said notice. RESOLUTION 2023-150 CONSOR NORTH AMERICA, INC. PUBLIC WORKS Approve Resolution No. 2023-150, Authorizing Chair’s Signature on Task Order No. 1 with Consor North America, Inc. in the amount of $85,840.00 for Public Outreach Campaign Services, for a 2024 Road Fund Levy Election. RESOLUTION 2023-151 CITY OF ROSLYN PUBLIC WORKS Approve Resolution No. 2023-151, Authorizing the Chairman’s Signature on the Kittitas County’s American Rescue Plan Act Grant Program Agreement with the City of Roslyn, in the amount not to exceed $275,000.00, for the Cemetery Water Main Extension Project. RESOLUTION 2023-152 FAUST ROAD BRIDGE PUBLIC WORKS Approve Resolution No. 2023-152, Awarding a Contract for the Faust Road Bridge #88212 Over the Town Ditch Replacement Project (CRP 316-22) and to Authorize the County Engineer to Execute the Same. ADMINISTRATIVE MATTERS – NONE CITIZEN COMMENTS ON NON-AGENDA ITEMS - NONE BOARD DISCUSSION/DECISION ITEMS RESOLUTION 2023-143 CLOSURE OF LIMITED PURPOSE LANDFILL SOLID WASTE Vice-Chairman Wachsmith moved to approve Resolution No. 2023-143, Authorizing the Closure of the Limited Purpose Landfill. Chairman Wright seconded. Motion carried 2-0. BUDGET 2024 BUDGET REQUESTS AUDITOR Brian Carlson, Budget & Finance Director, provided an update on preliminary figures from compiled Countywide budgets. He said the next 09/05/2023 MINUTES 7 update would be at his Finance Study Session scheduled for September 21, 2023. MISCELLANEOUS - NONE EXECUTIVE SESSION At 10:34 a.m. Chairman Wright announced the Board would recess into Executive Session for 15 minutes with Stephanie Hartung, Chief Civil Deputy Prosecutor, and Mark Cook, Public Works/CDS Director, under RCW 42.30.110 (i) to discuss with legal counsel representing the agency matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. Action was anticipated. At 10:59 a.m. the Board reconvened out of Executive Session. No action was taken.
