DATE: September 5, 2023
ACTION REQUESTED: Consider approval of a Resolution Authorizing
Participation in Insulin Pricing Scheme Litigation.
BACKGROUND: The Kittitas County Prosecutor’s Officer was contacted by
attorneys at Keller Rorhback L.L.P regarding eligibility for
representation in a multi-municipality legal action against
insulin manufactures and pharmacy benefit providers that
acted unlawfully to increase the price of insulin. Kittitas
County may be entitled to damages as a result of expenses
paid toward employee health care plans used to purchase
the unlawfully inflated priced medication. Keller Rorhback
is the firm that the County engaged for the Opioid
litigation. They are well versed in pharmaceutical litigation
and well equipped to represent the county in this action on
a fully contingent basis. Time is of the essence as there is a
court hearing on September 12, 2023, and it is best for the
County to join before that date if the County decides to
join. This is a low risk/low burden law suit for the County.
INTERACTION: The Prosecutor’s office drafted the attached resolution and
upon approval from the Board, will sign the attorney
engagement and contingency fee agreement with Keller
Rohrback L.L.P.
RECOMMENDATION: Approve the resolution and authorize the Kittitas County’s
Prosecutor’s Office to execute an engagement and
contingency fee agreement with Keller Rohrback L.L.P.
