2023 AGENDA STAFF REPORT
AGENDA DATE: August 1, 2023
ACTION REQUESTED: Request to approve a Resolution to select Baer Testing for
Material Testing Professional Services Contract supporting
Public Works for up to a Three -Year period and authorize the
County Engineer to execute said contract.
BACKGROUND: On September 6, 2022, Public Works received approval to
advertise a request for Statement of Qualifications to solicit
for professional services which included material testing.
Submittals were due October 14, 2022. No submittals
received were specific to material testing. Public Works
subsequently determined to solicit material testing on a
project specific basis. Public Works requested proposals for
materials testing for the Manastash Bank Stabilization project
in accordance with RCW 39.04.155 Small Works Roster
Contract Procedures. Submittals were due to Public Works
July 21, 2023. No submittals were received by Public Works.
Recognizing the need for outside material testing on projects
and having not received any submittals for material testing the
previous two solicitations Public Works proposes waiving
competitive bidding requirements in accordance with RCW
39.04.280 and contract directly with Baer Testing &
Engineering, Inc. for material testing. Baer Testing has
performed material testing in the past for the County, without
issue.
INTERACTION: Public Works.
RECOMMENDATION: Approve a Resolution to select Baer Testing for Material
Testing Professional Services Contract supporting Public
Works for up to a Three -Year period and Authorize the
County engineer to execute said contract.
HANDLING: Return one original to Public Works.

RESOLUTION NO. 2023 -
SELECTING BAER TESTING AS PUBLIC WORKS ON -CALL TASK ORDER
CONSULTANTS FOR UP TO A THREE-YEAR PERIOD OF SERVICE AND
AUTHORIZE THE COUNTY ENGINEER SIGNATURE ON SAID CONTRACT
WHEREAS: The Department of Public Works (PW) prepared a solicitation for engineering and
professional services including material testing consistent with state law and
county code in September 2022; and
WHEREAS: The Department of Public Works did also solicit for material testing for a specific
road construction project consistent with state law and county code in July 2023;
and
WHEREAS: The Department of Public Works did not receive any submittals for material
testing; and
WHEREAS: Material testing is an integral part of the construction process to ensure materials
meet construction specifications; and
WHEREAS: Competitive bidding requirements may be waived per RCW 39.04.280 due to
market conditions;
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the
best interest of the public, does hereby waive competitive bidding requirements and direct Public
Works to enter a standard professional contract with Baer Testing & Engineering, Inc. for
materials testing;
BE IT FURTHER RESOLVED the County Engineer is directed to sign said contracts on
behalf of the Board of County Commissioners.
