LEAD STAFF: Joshua Fredrickson RECOMMENDATION: Informational briefing — no Board of County Commissioners (BOCC) action is required. BRIEFING SUMMARY: • Right -of -Way (ROW) for Bear Road was dedicated to the County through the Elk Haven Plat. • Road was never built. • Ten lots have frontage to Bear Road. • New access should be directed to an internal road network. • North half of Elk Haven Road was previously vacated, resolution no. 95-165. BACKGROUND: The Elk Haven Plat was approved and recorded in September 1969. This plat created 49 lots in an area north and south of Upper Peoh Point (Exhibit 1). Public ROW was dedicated to provide access to the lots, including Bear Road. A 1995 resolution vacated a portion of Elk Haven Road from Bear Road to the north boundary line. Bear Road has not been constructed. The property owner of lots 4,5, and 11 has dedicated public ROW separating their lots (Exhibit 2). Because the ROW is dedicated for public use, if vacation is sought PW is required to vacate pursuant to County Code and State law. DISCUSSION: Ten lots have frontage to Bear Road ROW in the Elk Haven Plat. These lots have five separate owners. Kittitas County Code 12.05.03 directs new access onto internal roadways. Property owners have interest in no longer being burdened by the ROW. Parcels need to have reasonable access available to prevent from becoming land locked. Property owners may seek to vacate the roadway by submitting a road vacation application. This action would allow parcels on the north and south of Bear Road to be joined and no longer burdened by the right-of-way. Lot owners on the north side of Bear Road may seek access easements from the lots on the south side of Bear Road. This would also require a variance through the Road Variance Committee to allow direct access onto Upper Peoh Point. They may also seek to establish Bear Road. Construction and maintenance of Bear Road is directed on the plat dedication to be the responsibility Page 1 of 4 Public Works "Work Session Staff Report" 2023 of a non-profit corporation composed of the owners of the lots. Two Type N streams cross the Bear Road ROW. Future build of Bear Road may be impacted by critical areas. FISCAL IMPACTS: Road Vacation Application of $3,888.00. Traffic and speed data was collected at mile post 0.55. This road segment has 28 percent truck traffic within the average daily traffic distribution of vehicle size. Traffic at this location is split 50.1% northbound and 49.9% southbound. Overall 85`h percentile speed at this location is 48 MPH, with directional speeds of 46 MPH northbound and 50 MPH southbound. DISCUSSION: 85`h percentile speeds show traffic is operating at a speed greater than the current posted speed limit of 35 MPH. The 85ih percentile speeds suggest this roadway segment is more accommodating to an increased speed than the current posted speed limit. The roadway alignment is tangent through this section. There are 16 approaches along this section of Wilson Creek Road, primarily serving residential uses. Other users include agricultural use. Two of the approaches serve private roads which connect to this section of roadway. These private roads provide access to an additional 15 approaches. There were five recorded crashes along this roadway in the previous five years. The cause of the crashes included icy conditions; driver error; tires off roadway; animal in road; and an impact to bridge rail. FISCAL IMPACT: None ATTACHMENTS: Exhibit 1: Speed Increase Request Exhibit 2: Speed Study Results Exhibit 1: Speed Increase Request From: pat kelleher <psk98926@vahoo.com> Sent: Thursday, June 8, 2023 1:46 PM To: Mark Cook <mark.cook@co.kittitas.wa.us>; Caleb Sprous <csprous@kvnews.com>; pat kelleher <psk98926jpyahoo.com> Subject: Citizen request to increase speed limit from 35 mph to 50 mph on Wilson Creek Road CAUTION: This email originated from outside the Kittitas County network. Do not click links, open attachments, fulfill requests, or follow guidance unless you recognize the sender and have verified the content is safe. Mark I would like to request an increase of the speed limit from 35 mph to 50 mph on Wilson Creek Road from Game Farm Road to Judge Ronald Road. The speed limits on county roads are 50 mph unless otherwise posted. This is the speed limit persons expect to drive on county roads in rural areas unless conditions or hazards require reduced speeds. Traffic studies show that simply lowering posted speed limits has little effect on actual speeds. Lowering posted speeds usually only reduces the prevailing speeds by one to two miles per hour and increases the difference in speeds, which is a common cause of crashes. In general, drivers choose their speed based on what they think is safe and reasonable for the conditions present. An unreasonable posted speed gets little consideration from drivers. A variety of factors are considered when determining safe and reasonable speed limits. The prevailing speed is a major consideration in setting speed limits. Engineers recommend setting limits where 86% of the freely flowing traffic travels at or below that speed. (the 85th percentile). Another consideration is the highest safe speed for which the road was designed. This takes into account road type, road geometry and adjacent land use. Other factors include presence of non vehicular road users, driver or vehicle characteristics, enforcement capability , and public attitudes. I suspect a speed study on Wilson Creek Road with the counter placed south of the Game Farm Road end 35 mph speed limit sign will yield an 85th percentile speed well in excess of the posted limit and more aligned with the RCW 46.61.400 (2) (b) maximum limit for county roads.
