This land is managed by The Nature Conservancy, with the intent to permanently transfer the land to an entity that will maintain the conservation value of the land. The Checkerboard Partnership, which includes The Nature Conservancy, has identified the Department of Natural Resources as the preferred permanent landowner, with the intent to manage the land as a community forest. The Board has expressed a desire to communicate a County position to The Nature Conservancy regarding the potential for motorized use on these lands. The Nature Conservancy has expressed interest in gaining Board of County Commissioner support for the transfer of land to the Department of Natural Resources for management as a community forest. BACKGROUND: The Nature Conservancy (TNC) manages 9,600 acres of forest land on Cle Elum Ridge, which is owned by Central Cascades Forest LLC (CCF). TNC has been working to transfer ownership to an entity, public or private, that will manage the lands to maintain conservation values. The Nature Conservancy, after consultation with stakeholders about potential ownership models, has identified the State Department of Natural Resources as the preferred owner. Under the proposed model, these lands would be managed as a Community Forest on Cle Elum Ridge, essentially expanding the adjacent Teanaway Community Forest. DISCUSSION: Individually, as County Commissioners, Commission members have expressed many of the concerns reflected in the proposed Cle Elum Ridge Economic Analysis, which would be funded by the Nature Conservancy. TNC seeks to provide the Board of County Page 1 of 3 PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT Commissioners with additional information, with the aim of addressing concerns so that the Board can support the proposal. Given TNC's offer to expend funds, the Board may desire to communicate a County position to The Nature Conservancy regarding the potential for motorized use on the Cle Elum Lands. FISCAL IMPACTS: The potential impacts to Kittitas County of transferring the 9,600 acres of forest land to permanent public ownership for management as a community Forest is not well understood. The proposed Cle Elum Ridge Economic Analysis seeks to clarify those impacts. We understand that this analysis is intended, in part, to provide our Board of County Commissioners with additional information to evaluate the proposed transfer of Central Cascades Forest LLC (CCF) Cle Elum Ridge lands to the Department of Natural Resources as a Community Forest'. We have not taken a position on this community forest proposal and appreciate The Nature Conservancy's efforts to support an evaluation of the impact on Kittitas County residents and visitors. The Nature Conservancy (TNC), working in partnership with Yakima Basin Integrated Plan participants, including staff -level county representation and individual County Commissioner feedback, has worked to develop the Cle Elum Ridge Economic Analysis Request for Proposals. Individually, as County Commissioners, Commission members have expressed many of the concerns reflected in the proposed scope of work. These concerns include impacts to our tax base associated with the ongoing transfer of land from private to public ownership and the strain on County resources associated with both the rapid growth in recreational uses and residential housing demand in the Upper County. We appreciate efforts to date to identify sources of on- going revenue to help the County meet these needs, such as potential transfer of lands in the Cabin Creek Forest Legacy grant area to DNR as county state forest lands. To the degree that the proposed Economic Analysis can identify economic impacts and actionable mitigations and responses, this effort will be helpful. 'The Nature Conservancy (TNG) manages 9,600 acres of forest land on Cle Elum Ridge, which is owned by Central Cascades Forest LLC (CCF). TNC has been working to transfer ownership to an entity, public or private that will maintain conservation values in its management of the lands. The Nature Conservancy, after consultation with stakeholders about potential ownership models, has identified the State Department of Natural Resources as the preferred owner. Kittitas County Courthouse • 205 West 5* Avenue, STE 108 • Ellensburg, WA 98926 (509) 962-7508 -FAX (509) 962-7679 We, acting as a full Board of Commissioners, want to clearly communicate the importance of motorized vehicle opportunities to many of our constituents. We request that TNC directly consider what motorized opportunities could be supported in the Cle Elum Ridge lands while still meeting the conservation value goals for the property. In particular, we request an evaluation of opportunities to improve accessibility of these lands by a diverse user group, allow for the future development of emergency evacuation routes, and promote connectivity from our Upper County Communities to State and Forest Service lands. To summarize, we view the proposed economic analysis as helpful and want to request direct consideration of motorized opportunities on the Cle Elum Ridge lands. Given that this is a critical issue for the Board of County Commissioners, we wanted to clarify and emphasize the scope of our concern. Cook RECOMMENMATION: Direct staff bring a temporary land use moratorium on Elk Meadows to the Board for consideration. Direct staff contact Elk Meadows leadership defining a preferred alternative for noticing state and federal regulatory agencies. BRIEFING SUMMARY: • At a previous study session (0412412023) staff agreed to return to the Board of County Commissioners (BoCC) with alternatives managing McElroy Bridge. • Public Works (PW) staff have prepared three alternatives for BoCC and Elk Meadows consideration. • Regardless of the alternative selected, staff recommend moving forward with a temporary land use moratorium limiting any development on the far shore of the Yakima River. BACKGROUND: Staff have been working to finalize re -modeling of Yakima River tloodplain in the Easton Reach. Model results confirm the existing McElroy Bridge is not compliant with adopted floodplain regulations. The bridge is also non-compliant with county private bridge standards. A proposed temporary land use moratorium is on hold pending the outcome of today's discussion. DISCUSSION: Three alternatives for removing, replacing, or remediating the existing McElroy Bridge have been prepared by PW for Elk Meadows leadership consideration. The "Do Nothing" alternative requires code enforcement to obtain an abatement order from Superior Court. The cost of the abatement would likely be spread amongst all property owners and the county may need to lien properties to obtain cost recovery. Remediation of the existing structure may be possible. This is the least impactive alternative for the water district. "Buy Out" is the largest unknown alternative for PW at this time. This alternative will require significant problem -solving with the water district. All three alternative descriptions are provided as EXHIBIT 1. Page 1 of 3 Public Works "Work Session Staff Report", 2023 Staff recommends moving forward with a temporary land use moratorium preventing panic selling off of existing lots. A resolution implementing a temporary land use moratorium has been prepared by the Prosecuting Attorney's Office for BoCC consideration. Upon direction, staff will bring the resolution to BoCC business meeting for action. FISCAL IMPACTS: Alternative 1: $8-10,000 in estimated Flood Control Zone District expense. Alternative 2: $28,000 - $30,000 in estimated Flood Control Zone District expense. Alternative 3: $22,000 - $24,000 in estimated Flood Control Zone District expense. ATTACHMENTS: EXHIBIT 1: ELK MEADOWS MCELROY BRIDGE ALTERNATIVES Page 2 of 3 Public Works "Work Session Staff Report", 2023 EXHIBIT 1: ELK MEADOWS MCELROY BRIDGE ALTERNATIVES Page 3 of 3 Public Works "Work Session Staff Report", 2023 2023 Elk Meadows Compliance Plan for McElroy Bridge April 26, 2023 May 02, 2023 MRC Alternative 1: Do nothing. This alternative is not acceptable to Kittitas County Flood Control Zone District, nor to Kittitas County Department of Public Works. Continued participation in the Community Rating System and National Flood Insurance Program is deemed essential by the Board of County Commissioners. Public Works (PW) has been imposing private bridge development standards since 2019. Consistency in regulatory application is deemed essential by the Board of County Commissioners. Doing nothing to mitigate the risk of bridge failure during regulatory flood events continues placing Elk Meadows (EM) residents and emergency responders at physical risk. In summary, the "Do nothing" alternative is not an option for EM or Kittitas County (KC). In the absence of action on the part of EM, KC will likely utilize the code violation process requesting Superior Court order abatement of the bridge. This option does not provide any assistance from the County to the water district. Reguired County resources. 80 hours code enforcement staff and 80 hours of prosecutor staff. Undetermined cost of abatement. Likely imposition of a special district leaning all properties retiring the cost of abatement. Using average employee wage and benefit rate of $501hour; $8,000 to $10,000 is the current estimated cost range for county services. Alternative 2: _Modifications to McElroy Bridge. Two minimum performance standards must be met modifying the existing McElroy Bridge: • Creating three feet of freeboard under bridge superstructure with no resulting flood rise • Creating a minimum single lane fire code width of twenty feet. This alternative requires a variance from existing county road standards relative to required minimum bridge width. The variance to width will require support from the Kittitas County Fire Chiefs Association and County Engineer. This option requires EM to accept recent county flood modeling of the Easton reach of the Yakima River completed by its consultant Watershed Science and Engineering. The recent remodeling work, once accepted by the Federal Emergency Management Agency (FEMA), will become the new regulatory standard for Easton Reach. Time is of the essence, and the county desires to focus time, money, and effort towards assisting in the modification of the McElroy Bridge and not seeking remedies diminishing or altering flood study outcomes. This alternative affords continued use of the bridge for water district water supply deliver and access to the district's water supply reservoir. The county will provide permitting assistance to EM as a part of this alternative. Page 1 of 2 Required resources. 120 hours of staff time reviewing necessary bridge modifications and permitting coordination with resource agencies. 40 hours of staff time coordinating with federal and state floodplain regulatory agencies. $20,000 of consultant support paid by the Flood Control Zone District. Using average employee wage and benefit rate of $50/hour; $28,000 to $30,000 is estimated for county services. Alternative Three: Buy out of properties on the far shore. Kittitas County will work with FEMA and the Washington State Department of Ecology (WADOE) developing a land purchase option of impacted properties on the far shore of the Yakima River. WADOE, FEMA and KC will develop a compliance program and EM will assume operational risk associated with the existing bridge as the buy out program is implemented. This option requires separate analysis and actions necessary stabilizing the water district water supply to the remaining Elk Meadows properties. KC will provide support to the Water District addressing ongoing access to the reservoir and any regulatory implications to the water treatment plant. Likely outcomes include an undercrossing of the Yakima River for the water supply and acquisition and deployment of a barge supporting water district ongoing operations of the existing storage facility on the far shore. This alternative also addresses additional flood risks identified by the flood hazard analysis conducted by Watershed Sciences and Engineering. These hazards include high velocity hazards and risk that part of the Yakima River will cut through the community and create an island. Required resources. 120 hours of staff time developing the buy out program with state and federal regulatory agencies. 80 hours of staff time conducting property owner outreach. 80 hours of staff time researching grant opportunities. 80 hours of staff time permitting support. 80 hours of staff time logistic support of the water district. Using average employee wage and benefit rate of $50/hour; $22,000 to $24,000 is estimated for county services. Page 2 of 2 KITTITAS COUNTY DEPARTMENT OF PUBLIC WORKS PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS STUDY SESSION STAFF REPORT STUDY SESSION DATE: May 8, 2023 TOPIC: Thomas Road Speed Study Results ACTION REQUESTED: Schedule a Public Hearing receiving the Engineer's Report on the Request for Speed Reduction LEAD STAFF: Joshua Fredrickson RECOMMENDATION: Schedule a public hearing receiving the County Engineer's report on the request for speed reduction on Thomas Road (MP 0.00 to MP 1.51) BRIEFING SUMMARY: • A resident on Thomas Road requested a speed reduction on Thomas Road (MP 0.00 to MP 1.51) on December 29, 2022 • The speed study was conducted on April 11, 2023 to April 18, 2023 • Speed study data collected at MP 0.78 • Average daily traffic (ADT) of 150 vehicles, with 33 trucks (23%) • ADT distribution is 53% eastbound and 47% westbound • 85% speed at 40 Miles Per Hour (MPH) eastbound and 42 MPH westbound • Two crashes in the past five years BACKGROUND: Responding to a request received on December 29, 2022, to reduce the posted speed on Thomas Road, Public Works deployed traffic data collectors April 11, 2023 and collected through April 18, 2023. Traffic and speed data was collected at mile post 0.78. This road segment has 23 percent truck traffic within the average daily traffic distribution of vehicle size. Traffic at this location is split 53% eastbound and 47% westbound. Overall 85th percentile speed at this location is 41 MPH, with directional speeds of 40 MPH eastbound and 42 MPH westbound. DISCUSSION: 85th percentile speeds show traffic is operating at a speed less than the current speed limit of 50 MPH. The 85th percentile speeds suggest this roadway segment is more accommodating to a lower speed than the current posted speed limit. The roadway alignment includes horizontal curves beginning near mile post 0.75 through mile post 1.25. There are 36 approaches along Thomas Road, primarily serving residential uses. One access serves commercial use. There were two recorded crashes along this roadway in the previous five years. One crash was reported when a driver lost control of their vehicle. The second reported crash was a driver collided with guard rail which was reported as suspected driving under the influence. 't ks V5 a s I live on Thomas Road, which is approximately 10 miles north of Ellensburg. I moved to 1321 Thomas Road in 1989 before the road surface was even paved. Due to the extensive riparian forest and numerous creeks in the Thomas Road area between Wilson Creek Road and Naneum Road, there is a resident herd of deer, who's herd existence predates the neighborhood itself. These deer are frequently in the road, as they make their daily movements throughout the Thomas Road neighborhood. Fast forward to 2022/2023. Thomas Road has a faster paved road surface, there is a closed through -road below us (Bar 14), a party barn above us on Chariton Road, and an increasingly popular Naneum State Forest access just north of Thomas Road. These factors have converged to cause increased traffic on Thomas Road, and people driving way too fast. If the current kill rate of the resident deer herd is indicative, Thomas Road has gone from a quiet neighborhood road to a kill zone. There have been 6 deer killed that I have observed along an 854 yard stretch of Thomas Road since August 2422. This level of deer death also means there is increased danger for dog walkers, kids, other non -motorized users, and even for the speeding drivers on Thomas Road. Thomas Road has poor visibility due to curves and the riparian forest, and there is no posted speed, except for on the curves. For the safety of the neighborhood residents. the wildlife, and drivers, we in the Thomas Road neighborhood are requesting that a) the speed be reduced from the current 50 MPH to 35 MPH from Wilson Creek Road to Naneum Road; b) the new speed limit be posted at the straight stretches starting at Wilson Creek Road on the west end, and Naneum Road on the east end. If you have any questions, please call Cyndy Kuebel at 509.899.3015 Thank you for your consideration, i< 0-,! U " i k. Traffic and speed data was collected at mile post 1.19. This road segment has 25 percent truck traffic within the average daily traffic distribution of vehicle size. Traffic at this location is split 53% eastbound and 47% westbound. Overall 85th percentile speed at this location is 55.9 MPH with directional speeds of 56.1 MPH eastbound and 55.7 MPH westbound. DISCUSSION: 85t' percentile speeds show traffic is operating at a speed greater than the current speed limit of 50 MPH. The 85th percentile speeds suggest the road segment is easily capable of managing design speed and the current speed limit. There are 22 approaches in 1.19 miles along Tjossem Road, primarily serving residential and agricultural uses. Access to a solar farm is located within this roadway section. There were ten recorded crashes along this roadway in the previous five years. Two crashes were attributed to driver error (tiredness) and one crash attributed to driver error (braking too hard). One crash was attributed to driving under the influence. One crash was a rear end collision due to a turning movement. Five crashes were impacts to guardrail due to turning movement. FISCAL IMPACT: None ATTACHMENTS: Exhibit 1: Speed Reduction Request Exhibit 2: Speed Study Results Exhibit 1: Speed Reduction Request Kittitas County Public Works 411 North Ruby Street, Suite 1 Ellensburg, WA 98926 Attention Candie Leader PFr"'F_D _.; . Subject: Speed Reduction on Tjossem Road, Ellensburg WA in Kittitas County This memorandum is to officially request that a section of Tjossem Road located in Ellensburg, WA in the county of Kittitas have a speed reduction implemented. The requested location is between where Tjossem Road crosses over HWY 82197 then crosses Number 6 Rd. The current speed limit is fifty miles per hour. Within this particular section of county road there is a business named Ellensburg Pet Lodge that boards animals primarily dogs. The volume of customers arriving with dogs to drop off and pickup has been increasing over the months and years. This has increased the potential of road accidents and incidences that could occur within this section of road way. The current speed of fifty miles per hour with the added curve and rise of the road section over the 82197 HWY causes the possibility of collision with people, dogs, other animals and vehicles. With in the months of December 2022 and January 2023 two cats have been hit and fatally injured at this location, and this was during the icy cold season when drivers should have reduced their speed but did not. During these two incidents no drivers stopped to investigate what they hit. As stated in RCW 46.61.404 (1 ) No person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under conditions and having regard to the actual and potential hazards then existing. In every event speed shall be so controlled as may be necessary to avoid colliding with any person, vehicle or other conveyance on or entering the highway in compliance with legal requirements and the duty of all persons to use care. Another safety concern is for the postal carrier that has to deliver mail located in this area. The location they drop off mail is very dangerous and someday could cause a collision. With the added customers arriving and leaving the business Ellensburg Pet Lodge and having the postal carrier arrive adds more potential of accidents. And garbage pickup weekly blocks visibility during customers dropping off or picking up their animals at Ellensburg Pet Lodge, a slower speed would help reduce possible collisions. We have witnessed semi -trucks traveling the corner almost tipping over on multiple occasions in the location where Ellensburg Pet Lodge customers get in and out of their vehicles. This bend in the roadway driving at a speed of fifty plus miles per hour makes it difficult for the drivers to see customers and animals at this location. During busy harvest time of hay there are slow moving tractors entering and exiting Tjossem road on a regular bases at this location. The vehicles that are traveling at the speeds of fifty miles per hour and greater have a very short time to avoid the slow moving tractors. In conclusion we are asking that Kittitas County Public Works proceed in taking the next steps in processing this request. Thank You, Cayla J. Dahl Ellensburg Pet Lodge owner 2111 Tjossem Rd Ellensburg, WA 98926 509-899-6134 Attachments; * (1) Map of location discussed in this memorandum * (2) Signed petition by residences in this location and customers of Ellensburg Pet Lodge. m Attachment#1 Proposed Speed Reduction location on Tjossem road. n MdDdWu <3 200h&--.,.,,..,2 G Proposed Speed Reducdon oni7ossem Exhibit 2: Speed Study Results 13 i 2 y w Lu is A b m ,n Ln ?.
