A RBSOLUTION AUTHORTZING AN AMENDMENT OF THE MERRILL LEASE
EXECUTED DECEMBER 2I, 2O2I TO REFLECT THE CORRECT LEGAL
DESCRIPTION AND ANNUAL LEASE PRICE OF THE REAL PROPERTY LEASED
AT THE BOWERS FIELD AIRPORT
WHEREAS: Kittitas County Code (KCC) 2.81.060(4) requires that all leases of real properly be
approved by the Board of County Commissioners (Board); and
WHEREAS: The Board of County Commissioners and Mark and Linda Merrill previously
executed a lease on Decemb er 21,2021, for the lease or real property located at the Bowers Field
Airport; and
WHEREAS: The legal description of the real property listed in the lease was incomect; and
WHEREAS: The Parties desire to amend the lease to reflect the correct legally identified piece
of real property at the Bowers Field Airporl; and
WHERBAS: The amendment correctly reflects this legal description of the property as lot H-
24; and
WHEREAS: the size of lot H-15B is 6,960 square feet and the size of lot H-24 7,480 square
feet; and
WHERBAS: the annual rent for the lease will change from $1,113.60 to $I,254 per year based
on the increased space leased; and
WHERBAS: the parties wish to correct that eror such that the Tenant's lease is for lot H-24 for
the annual rent of $1,254.00.
NOW' THEREFORE' BE IT R-ESOLVED:
The Board of County Commissioners hereby authorizes the execution of the lease amendment
attached hereto and incorporated herein by this reference.

AIRPORT HANGAR GROUND LEASE AMENDMENT
WHBREAS: on December 1,2021, Kittitas County ("County") and Linda and Mark Merrill
(hereinafter "Tenant") entered into an "Airport Hangar Ground Lease" (hereinafter'lease') for
real property at the Bowers Field Airport, as authorized by Resolution 2021-195; and
WHEREAS: the legal description erroneously set forth lot H-158 rather than lot H-24; and
WHEREAS: the size of lot H-158 is 6,960 square feet and the size of lot H-24 is 7,480 square
feet; and
WHBREAS: the annual rent for the lease will change from $1,113.60 to $1,254 per year based
on the increased space leased; and
WHEREAS: the parties wish to correct that error such that the Tenant's lease is for lot H-24 for
the annual rent of $1,254.00.
NOW, THEREFORE, BE IT RESOLVED:
The Tenant and County agree to amend said lease by (1)correcting the legal description to
reference lotH-24, which is 7,480 square feet, (rather than lot H-158 that is 6,960 square feet)
and (2) specifying that the annual rent is $1,254.00 (rather than $1,1 13.00).
All othertertns aud conditions of the lease shall reurain in firll force and effect.
