WSPContractNo.CRDOO160LAESSNANTONNAPSAUSRERL)EMENTThisAgreement,enteredintobetweentheWashingtonStatePatrol(hereinafterreferredtoas"WSP"),anagencyoftheStateofWashington;andKittitasCountySheriffsOffice,(hereinafterreferredtoas"theUser"),witnessesthat:TheWSPisanagencyoftheStateofWashingtonauthorizedbylawtoestablishandoperateanAutomatedBiometricIdentificationSystem(ABIS)capableof,butnotlimitedto,reading,classifying,matching,andstoringfingerprints,andmaintaininginformationbasedonfingerprintidentification.ABISforwardsthecriminalhistoryrecordinformationtotheWashingtonStateIdentificationSystem(WASIS)whereitisstoredandmaintainedbytheWSP.TheWSPhasenteredintoagreementwiththeWesternIdentificationNetwork(WIN)forABISservices.TheWINsupportsABISprocessingforthefollowingeightstates:Alaska,Idaho,Montana,Nevada,Oregon,Utah,Washington,andWyoming.TheUsermayutilizeLivescanequipmenttocapturebiometricfingerprintimagesandrecordrelatedpersonalidentifiableinformationandsubmittoABISforauthorizedpurposesasallowedbystateandfederalstatutes.NOWTHEREFORE,inlightoftheforegoingrepresentationsandthepromises,conditions,andothervaluableconsiderationsmorefullysetoutorincorporatedhereinbyreference,theparties,bytheirdulyauthorizedofficials,domutuallyagreeasfollows:I.PERIODOFPERFORMANCEThisagreementreplacesanypreviousLivescantoWINABISUserAgreementbetweentheWSPandtheUser.ThisagreementiseffectiveonthedateofthelastsignatureandcontinuesuntilstatusofservicesortheUsersignatorychanges.II.DEFINITIONSAsusedthroughoutthisAgreement,thefollowingtermsshallhavethemeaningssetforthbelow:"ConfidentialInformation"meansinformationthatmaybeexemptfromdisclosuretothepublicorotherunauthorizedpersonsundereitherchapter42.56RCWorotherstateorfederalstatutes.ConfidentialInformationincludes,butisnotlimitedto,PersonalIdentifiableInformation(PII),agencysourcecodeorobjectcode,andagencysecuritydata,includingLivescandataasdescribedherein."SubcontractofmeansonenotintheemploymentofapartytothisAgreement,whoisperformingallorpartofthoseservicesunderthiscontractunderaseparatecontractwithapartytothisAgreement.Theterms"subcontractor"and"subcontractors"meansubcontractor(s)inanytier.III.SECURITYREQUIREMENTSThissectionwilloutlinesecurityrequirementsinreferencetoLivescandevicesdefinedasdevicesthatcollect,process,store,communicate,retrieve,display,orprintLivescaninformation.ApprovedastoFormbytheWashingtonAttorneyGeneral2018LivescantoWINABISUserAgreement05/08/2018Page1of7
