David Ohl, Airport Director <br /> <br /> <br />3110 Airport Rd, Ste. #1 TEL (509) 933-8219 <br />Ellensburg, WA 98926 <br /> <br />KITTITAS COUNTY <br />AIRPORT DEPARTMENT <br /> <br />04/04/2023 <br /> <br />AIRPORT HANGAR GROUND LEASE AMENDMENT <br /> <br />WHEREAS: on December 1, 2021, Kittitas County (“County”) and Linda and Mark Merrill <br />(hereinafter “Tenant”) entered into an “Airport Hangar Ground Lease ” (hereinafter ‘lease’) for <br />real property at the Bowers Field Airport, as authorized by Resolution 2021 -195; and <br /> <br />WHEREAS: the legal description erroneously set forth lot H -15B rather than lot H-24; and <br /> <br />WHEREAS: the size of lot H-15B is 6,960 square feet and the size of lot H -24 is 7,480 square <br />feet; and <br /> <br />WHEREAS: the annual rent for the lease will change from $1,113.60 to $1,254 per year based <br />on the increased space leased; and <br /> <br />WHEREAS: the parties wish to correct that error such that the Tenant’s lease is for lot H -24 for <br />the annual rent of $1,254.00. <br /> <br />NOW, THEREFORE, BE IT RESOLVED : <br /> <br />The Tenant and County agree to amend said lease by (1) correcting the legal description to <br />reference lot H-24, which is 7,480 square feet, (rather than lot H -15B that is 6,960 square feet) <br />and (2) specifying that the annual rent is $1,254.00 (rather than $1,113.00). <br /> <br />All other terms and conditions of the lease shall remain in full force and effect. <br /> IN WITNESS WHEREOF, County and Tenant have signed their names and affixed their <br />seals the ____ day of _______________, 2023. <br /> <br /> <br />COUNTY: <br /> <br /> BOARD OF COUNTY COMMISSIONERS <br /> KITTITAS COUNTY, WASHINGTON <br />ATTEST: <br /> <br /> ______________________________________ <br /> Chair <br />Clerk of the Board <br /> <br /> ______________________________________ <br />Approved as to form: Commissioner <br /> <br /> <br /> ______________________________________
