2023 AGENDA STAFF REPORT
AGENDA DATE: April 4, 2023
ACTION REQUESTED: Request to Approve a Resolution to Rescind the selection
of East Slopes Earthworks for the Manufactured Home,
Barn, Arena, and Garage Demolition and Salvage Project.
BACKGROUND: Kittitas County Public Works advertised a request for
services to demolish four buildings on Flood Control Zone
District property and make the salvage rights available to
encourage material reuse. This solicitation followed
Chapter RCW 39.26.120 requirements. Public Works
received nine (9) qualified proposals. An internal Public
Works review team reviewed the proposal and
recommended award to East Slopes Earthworks. After the
Board approved the selection of East Slopes Earthworks,
one of the project respondents protested. In response to
this protest, we requested legal review by council. The
result of this review was a determination that building
demolition is subject to Chapter 39.04 RCW and not RCW
39.26.
INTERACTION: Public Works.
RECOMMENDATION: Approve the Resolution to rescind the selection of East
Slopes Earthworks for the Manufactured Home, Barn,
Arena, and Garage Demolition and Salvage Project.
HANDLING: Return one original to Public Works.

NO. 2023 -
RESCIND THE SELECTION OF EAST SLOPES EARTHWORKS FOR THE
MANUFACTURED HOME, BARN, ARENA, AND GARAGE DEMOLITION AND SALVAGE
PROJECT
WHEREAS: Public Works prepared a request for proposals for manufactured home, barn, arena, and
garage demolition and salvage services in January 2023 consistent with Chapter RCW
39.26.120; and
WHEREAS: Nine (9) qualified proposals were received; and
WHEREAS: On February 21', 2023, at the recommendation of an internal Public Works review team,
the Board of County Commissioners of Kittitas County selected East Slopes Earthworks
for the manufactured home, barn, arena, and garage demolition and salvage project; and
WHEREAS: Kittitas County reviewed the procurement process in response to a protest made by a
respondent to the project solicitation; and
WHEREAS: Kittitas County determined that that building demolition is subject to Chapter 39.04 RCW
and not RCW 39.26 and that services should be resolicited utilizing the correct
procurement process.
NOW THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Kittitas County,
Washington, in the best interest of the public, does hereby rescind the selection of East
Slopes Earthworks for the Manufactured Home, Barn, Arena, and Garage Demolition and
Salvage Project.
