RECOMMENDATION:
to consider approving a resolution authorizing leasing execution.
BRIEFING SUMMARY:
- The Airport Director asked the prosecutor’s office for a resolution to delegate
specific leasing authority from the board.
- The Prosecutor’s office drew up a resolution allowing the BoCC to delegate to the
Airport Director the authority to enter into 1 year T-Hangar leases and to approve
the lease amendments for tenant’s 5 year rent escalation clauses contained within
their agreed upon leases.
- Request a public hearing to consider approving the resolution to delegate the
listed authority on specific leases to the Airport Director.
BACKGROUND:
During a recent study session, the proposition of delegating some leasing authority to the
Airport Director was discussed to reduce the amount of administrative actions that had to
be brought before the BoCC. After working with the Prosecutor’s office an Ordinance
Amendment has been drafted to give the board the authority to delegate some of these
leasing actions in the future to the Airport Director.
Per the verbiage in the above approved Ordinance, the Airport Director requests a public
hearing to seek approval of the Resolution authorizing the Airport Director to execute
specific lease agreements.
DISCUSSION:
The proposed Resolution will allow the board to delegate specific leasing authority to the
Airport Director.
According to the Resolution, the Airport Director will be allowed to execute 1 year
County owned T-Hangar leases and approve amendments for 5 year rent escalations. The
rent increases are already built into the original lease, so the tenant has technically agreed
to the escalator every 5 years. Delegating this administrative action of approving the
amendments for the rent increases will eliminate these being brought before the BoCC
throughout the year.
This Resolution will only allow the Airport Director the limited leasing authority listed.
The Airport Director will still be required to bring all new land leases and amendments
that change current leases before the BoCC for consideration and approval.
FISCAL IMPACTS:
There are no fiscal impacts to the County.
