JANUARY 6, 2023 <br /> <br />Board members present: Chairman Cory Wright; Vice-Chairman Brett <br />Wachsmith; and Commissioner Laura Osiadacz. <br /> <br />Others: Julie Kjorsvik, Clerk of the Board; Kelly Bacon, Staff <br />Planner; Dan Carlson, CDS Director; Mark Cook, Public Works <br />Director; Neil Caulkins, Deputy Prosecutor; and 5 members of the <br />public. <br /> <br />PUBLIC HEARING SUNCADIA PHASE 2 DIVISION 8 CDS <br /> <br />At 2:00 p.m. CHAIRMAN WRIGHT opened a Public Hearing continued from <br />January 3, 2023, to consider the Suncadia Phase 2 Division 8 <br />Preliminary Plat (LP-22-00005). He noted the record was open. <br /> <br />VICE-CHAIRMAN WACHSMITH said after the previous Public Hearing, he <br />walked out with Mr. Wedin and although some may have viewed it as <br />ex-parte contact, he explained how there was no discussion of any <br />details relating to the matter. He indicated he does not have any <br />financial gain, nor own any land in Suncadia. There were no <br />objections or concerns. <br /> <br />DAN CARLSON, CDS DIRECTOR, said Staff had been working with the <br />Prosecutors Office, Public Works Department, and Suncadia and <br />they’ve come up with conditions where people could provide <br />complaints and how to track them. They were not able to come to an <br />agreement on the language and therefore recommended approving the <br />condition of approval which was previously proposed. An email from <br />Ira Astrachan was acknowledged and had been included into the <br />record. MARK COOK, PUBLIC WORKS DIRECTOR, reviewed the condition <br />contained in the Resolution and the discussions that went on between <br />the parties. STEVE LATHROP, ATTORNEY REPRESENTING THE APPLICANT, <br />said it there was any intent on any amendments to the Development <br />Agreement it needed to be pointed out, specifically within the <br />documentation. NEIL CAULKINS, CHIEF CIVIL DEPUTY PROSECUTOR, <br />reviewed the enforcement provision in the Development Agreement. <br /> <br />THERE BEING NO ONE REQUESTING TO TESTIFY, THE PUBLIC PORTION OF THE <br />HEARING WAS CLOSED. <br /> <br /> <br /> <br /> <br />
