KITTITAS COUNTY
DEPARTMENT OF PUBLIC WORKS
2023 AGENDA STAFF REPORT
AGENDA DATE: January 17, 2023
ACTION REQUESTED: Conduct a Public Hearing to consider a request for on -
system road establishment for roads within the Black Horse
at Whiskey Creek Planned Unit Development.
BACKGROUND: Final Plat was approved December 21, 2021, for the first
phase of the Black Horse at Whiskey Creek Planned Unit
Development (Black Horse). This included 80 lots located
north of 291h Avenue. The final plat dedicates the roads and
ways to the public for all roads north of 291h Avenue.
Public Works received an On -System County Road
Establishment application for the roads serving the north
half of the plat. Roads being considered for on -system
establishment include 29th Avenue, Mustang Court,
Morgan Court, Longhorn Loop and the portions of
Roundup Drive, Wrangler Drive and Bridle Way located
north of 291h Avenue.
Kittitas County Code 12.01.160 identifies the steps for a
road to become part of the county road system. This
includes planning, design, right-of-way, construction,
inspection, acceptance through resolution and warranty
period.
Roads constructed within the Black Horse at Whiskey
Creek PUD were planned to meet the public standard and
have been verified in the field to meet this requirement.
These roads have met the design and construction criteria
for a public road. The roads were paved in 2021 and a top
course in 2022. The developer has provided testing data to
meet the required material standards. Current county code
only allows for a ten percent maintenance bond for the road
system. Staff has determined the risk is low enough that
collecting and managing the ten percent maintenance bond
is likely more trouble than the bond is worth.
