PAGE 1 COMMERCIAL BUILDING LEASE THIS LEASE, dated for reference purposes only on the ______ day of __________, 2022, is made and entered into, to commence on the 1st day of __________________, 20__, by and between KITTITAS COUNTY, a subdivision of the State of Washington, hereinafter referred to as the LESSOR, and ______________________LLC, a Washington Limited Liability Company, hereinafter referred to as the LESSEE. W I T N E S S E T H: Lessor does hereby lease to Lessee, and Lessee hereby leases from Lessor, that certain real property (parcel numbers 18374, 133734, 193734, and 043734) legally described in EXHIBIT “A” (legal description) annexed hereto and by this reference incorporated h erein (the “Property”). Said Premises are located in the City of Ellensburg, County of Kittitas, State of Washington. This Lease is made in accordance with chapters 2.81 KCC, Ch. 36.34 RCW; and Ch. 59.12 RCW, and is subject to the terms, covenants and conditions herein set forth. Lessee covenants as a material part of the consideration for this Lease to keep and perform each and all of the said terms, covenants and conditions by it to be kept and performed. 1. TERM. The term of this Lease shall be for five (5) years and will commence on the 1st day of January , 2023 and terminate on the last day of January 2028, except as provided hereunder. 2. USE. a. Lessee, during the term of this Lease, shall use the Premises for a bowling alley, restaurant, bar and entertainment facility. The Premises includes three (3) tax parcels; 133734, 183734 and 043734. The Lessor shall have the right to use the parking areas on Parcels 133734 and 043734 (here inafter the “Parking Lots”) during the term of this lease. Lessor shall not be required to compensate Lessee for the use of the Parking Lots. This right of use of the Parking Lots will last for the entire term of the lease and, assuming Lessor exercises the option to purchase set forth below in section 4, for an additional two (2) years after the termination of this lease. After the end of the seven (7) years of free use Lessor shall have the first option to lease the Parking Lots by paying market rent for the lease of the Parking Lots. Any such lease of the parking lots shall be reduced to writing and shall be for a term not to exceed 15 years.. The Lessor shall have the right to use the meeting rooms within the building on Parcel Number 183734 for up to 24 days per year of the lease term. This right of use of the Meeting Rooms will last for the entire term of the lease and, assuming Lessor exercises the option to purchase set forth below in section 4, for an additional two (2) years after the termination of this lease.
