Amendment 1 to Interlocal Agreement between the City of Ellensburg and Kittitas County - Page 1 AMENDMENT 1 TO THE INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY OF ELLENSBURG AND KITTITAS COUNTY This AMENDMENT 1 to the Interlocal Cooperation Agreement effective December 20, 2021 (“Agreement”) is made and entered into effective the ___ day of December, 2022 between the County of Kittitas (hereinafter referred to as the “County”), a political subdivision of the State of Washington, and the City of Ellensburg (hereinafter referred to as the “City”), a Washington Municipal Corporation, pursuant to the Interlocal Cooperation Act, RCW 39.34. The City and County are sometimes referred to herein collectively as “Parties.” RECITALS WHEREAS, the Washington Interlocal Cooperation Act, Chapter 39.34 of the Revised Code of Washington (“RCW”), permits public entities to cooperate with one another on the basis of mutual advantage to make the most efficient use of their powers, thereby providing services and facilities in a manner that accords best with geographic, economic, population, and other factors influencing the needs and development of local communities, and allows public agencies to enter into agreements with one another for joint cooperative action; and WHEREAS, on December 20, 2021, the Parties entered into a Interlocal Cooperation Agreement Concerning Annexation and Development within the Ellensburg Urban Growth Area (“ILA”); and WHEREAS, the ILA establishes a deadline of December 31, 2022 for the County to meet certain requirements of the ILA; and WHEREAS, the Parties desire to extend that implementation deadline (related to Sections 5.1, 6.1, 10.2 and 13.1 of the ILA) to allow time for the County (1) to provide training on the new zoning requirements, (2) to develop urban road standards, and (3) to develop impact fee methodologies and processes. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the Parties hereby agree as follows: AMENDMENT 1 A. The current deadline of December 31, 2022 for the County to comply with implementation of Sections 5.1, 6.1, 10.2 and 13.1 of the ILA is hereby amended to be June 30, 2023, including implementation of any other sections of the ILA that specifically incorporate reference to these specific sections; B. The County and City agree that any proposed changes to the ILA will have to be accepted by the Parties through mutual written agreement by amendment as provided in Section 16 of the ILA.
