APPROVEDByDeborahSmithat4:29pm,Sep07,2022DEFENSELOGISTICSAGENCYDISPOSITIONSERVICES74WASHINGTONAVENUENORTHBATTLECREEK,MICHIGAN49037-3092GPLAugust15,2022MEMORANDUMFORLAWENFORCEMENTSUPPORTOFFICE(LESO)PROGRAMPARTICIPATINGLAWENFORCEMENTAGENCY(LEA)SUBJECT:AddendumtoLESOProgramStatePlanofOperation(SPO)ThisaddendumamendstheexistingStatePlanofOperation(datedFebruary2021)betweentheStateandLawEnforcementAgency(LEA)andishereinreferredtoastheSPOAddendum.TheSPOAddendumimplementsrequirementsfoundwithinPresidentialExecutiveOrder(EO)14074(Section12),signedonMay25,2022.InaccordancewithcurrentSPO-Paragraph17,noticeisbeingprovidedofaunilateralchangetotheSPO.UnlessanLEAtakesimmediateactiontoterminatethecurrentSPO,themodificationsoramendmentswillbecomebinding.1)ROLESANDRESPONSIBILITIESTheStateShall:a)EnsureeachLESOProgramparticipatingLawEnforcementAgency(LEA)hassignedtheLESO-approvedSPOAddendumnolaterthanJanuary1,2023.TheSPOAddendumwillbesignedbytheChiefLawEnforcementOfficial(CLEO)(orassigneddesignee)andthecurrentStateCoordinator(SC)(orauthorizedStatePointofContact[SPOC]).b)ProvideLESOwithacomprehensivelistofLEAswhodonotsigntheSPOAddendumbyJanuary1,2023.LESOwillrestricttheLEAtoensureLEAmaynotrequestorreceive"controlled"propertyasdefinedwithinthisaddendum.2)MODIFICATIONTODEFINITIONOF"CONTROLLED"PROPERTYThisSPOAddendumaddsthebelowitemstothe"contro11ed"propertydefinitionscurrentlyfoundinthe2021SPO.TheseitemsareaddedpursuanttoEO14074whichreestablishesEO13688.In2017,theLawEnforcementEquipmentWorkingGroup(establishedbyEO13688),furtheradded,deletedandrefinedthedefinitionsof"controlled"itemsintheirannualequipmentlistreview.Provisionswithinthe2021MOAapplicableto"controlled"propertyapplytotheitemslistedbelow(regardlessofDEMILand/orDEMILIntegrityCode).Titleandownershipofthe"controlled"propertylistedbelowremainswiththeDoDinperpetuityandwillnotberelinquishedtotheLEA(regardlessofDEMILand/orIntegrityCode).TheLESOretainsfinalauthoritytodeterminewhatitemsqualifyas"controlled"property.ThebelowitemslistedinSection1.2ofLawEnforcementEquipmentWorkingGroup(LEEWG)Recommendations(asmodifiedin2017),willbemanagedandissuedascontrolledpropertyunlessotherrestrictionsorconditionsarenoted:a)MannedAircrati,FixedWing:Poweredaircraftwithacrewaboard,suchasairplanes,thatuseafixedwingforlift.(Note:TheseitemswerepreviouslylistedascontrolledinLESOProgram,Anyaircraftwithoutcommercialapplicationareprohibited).b)MannedAircraftRotaryWing:Poweredaircraftwithacrewaboard,suchashelicopters,thatusearotarywingforlift.(Note:TheseitemswerepreviouslylistedascontrolledinLESOProgram.Anyaircraftwithoutcommercialapplicationareprohibited).Page1of9 c)UnmannedAerialVehicles:Aremotelypilotedpoweredaircraftwithoutacrewonboard.(Note:TheseitemsarenotcurrentlyissuedintheLESOProgram),d)ArmoredVehicles,Wheeled:Anywheeledvehicleeitherpurpose-builtormodifiedtoprovideballisticprotectiontoitsoccupants,suchasaMine-ResistantAmbushProtected(MRAP)vehicleoranArmoredPersonnelCarrier(APC).Thesevehiclesaresometimesusedbylawenforcementpersonnelinvolvedindangerousoperatingconditions,includingactiveshooterorsimilarhigh-threatsituations.Thesevehiclesoftenhaveweapon-firingports.(Note:ThesevehicleswerepreviouslyconsideredcontrolledduetoDEMILcodeandarenowprohibitedunlesscertificationrequirementsinSection3aremet).e)TacticalVehicles,Wheeled:Avehiclepurpose-builttooperateon-andoff-roadinsupportofmilitaryoperations,suchasaHighMobilityMulti-parposeWheeledVehicle(HMMWV),2.5-tontruck,S-tontruck,oravehiclewithabreachingorentryapparatusattached.Thesevehiclesaresometimesusedbylawenforcementinroughterrainorinclementweatherforsearchandrescueoperations,aswellasotherlawenforcementfunctions.Thisexcludescommerciallyavailablevehiclesnottacticalinnature,suchaspick-uptrucksorSUVs.(Note1:ThisisLEEWGmodifieddefmitionfrom2017.Note2:Alltacticalvehicleswillnowbeconsideredcontrolled,andtitlewillnotpass.Note3:ArmoredvehiclesinthiscategorywillbeconsideredprohibitedunlesscertificationrequirementsinSection3aremet).f)CommandandControlVehicles:Anywheeledvehicleeitherpurpose-builtormodifiedtofacilitatetheoperationalcontrolanddirectionofpublicsafetyunitsrespondingtoanincident.CommandandcontrolvehiclesprovideavarietyofcapabilitiestoincidentCommander,including,butnotlimitedto,theprovisionforenhancedcommunicationsandothersituationalawarenesscapabilities.CommandandControlVehiclesaresimilartoarecreationalvehicleandcanaccommodatemultiplepeopleatmultipleworkstationsinthecommandcenter.ThiscategorydoesnotincludeSUVsandisnotintendedforothertypesofvehiclesthatcouldserveasacommand-and-controlcenter.(Note1:ThisistheLEEWGmodifieddefinitionfrom2017.Note2:ArmoredvehiclesinthiscategorywillbeconsideredprohibitedunlesscertificationrequirementsinSection3aremet).g)SpecializedFirearmsandAmmunitionUnder.50-Caliber(excludesfirearmsandammunitiondesignedforregularlyassignedduties)andlesslethallaunchers:Weaponsandcorrespondingammunitionforspecializedoperationsorassignment.Thisincludeslaunchersspecificallydesignedandbuilttolaunchlesslethalprojectiles.Thisexcludesweaponssuchasserviceissuedhandguns,riflesorshotgunsthatareissuedorapprovedbytheagencytobeusedbyallswornofficers/deputiesduringthecourseofregularlyassignedduties.(Note1:ThisistheLEEWGmodifieddefinitionfrom2017.Note2:TheLESOProgramonlyissuesweaponsunder.50caliberthataredesignedforregularlyassignedduties).h)ExplosivesandPyrotechnics:Includes"flashbangs"aswellasexplosivebreachingtoolsoftenusedbyspecialoperationsunits.(Note:TheseitemswerepreviouslyprohibitedintheLESOProgramandarenowspecificallyprohibitedinEO14074).i)BreachingApparatus:Toolsdesignedtoproviderapidentryintoabuildingorthroughasecureddoorway.Thesetoolsmaybemechanicalinnature(abatteringramconnectedtoavehicleorapropellant),ballistic(slugs),orexplosive.Thiscategorydoesnotincludedualpurposetoolssuchasasledgehammerorboltcutter.(Note:ThisistheLEEWGmodifieddefinitionfrom2017).j)Riot/CrowdControlBatons:Non-expandableofgreaterlength(morethan24inches)thanservice-issuedtypesandareintendedtoprotectitswielderduringcrowdcontrolsituationsbyprovidingdistancefromassailants.Thiscategoryincludesallbatonswithadvancedfeaturessuchasteargasdischarge,electronicor"stun"capabilities.(Note:ThisistheLEEWGmodifieddefinitionfrom2017).Page2of9 iii)LEAsthatdonothaveacurrentSPOAddendumonfilebyJanuary1,2023orwhofailtoannuallycertifythatthevehicle(s)useisexclusivelyfordisaster-relatedemergencies;activeshooterscenarios;hostageorothersearchandrescueoperations;oranti-terrorismpreparedness,protection,prevention,response,recovery,orreliefmustreturnvehicle(s)toDLADispositionServices.4)ACQUIRING(ORRETAINING)CONTROLLEDPROPERTYTheStateshall:a)Review,verifyandonlysubmittoLESOforapproval,requestsforcontrolledpropertybyLEAswhohavecurrentSPOandSPOAddendumonfilewiththestate.b)EnsureLEAsreturncontrolledpropertytoDLADispositionServicesiftheDepartmentofJustice(DOJ)determinesoraFederal,State,Tribal,local,orterritorialcourtentersafinaljudgmentfindingthattheLEAhasengagedinapatternorpracticeofcivilrightsviolations.c)Ensurethatpriortorequesting/acquiringanycontrolledproperty,theLEAs:i)Providewrittenorelectronicnotificationtothelocalcommunityofitsintenttorequestcontrolledproperty.ThenotificationmustbetranslatedintoappropriatelanguagestoinformindividualswithlimitedEnglishproficiency.TheLESOProgramwouldrecommendthatLEAsprovideanoticeofintenttorequestcontrolledpropertytothelocalcommunityonorbeforeJanuary1,2023andatthebeginningofeachfiscalyear(Octoberlst)thereafter.Thisnotificationshouldincludeacomprehensivelistofanycontrolledpropertythatmayberequestedthroughouttheyear.Ifthisnoticeofintentdoesnotincludeaspecificcontrolledpropertyitem,suchitemmaynotberequestedintheLESOProgramuntil30-daysafteranupdatednoticeispublished.ii)ProvidewrittenorelectronicnotificationtothecitycouncilorappropriatelocalCivilianGoverningBody(CGB)ofitsintenttorequestcontrolledpropertyandallow"reasonableopportunitytoreview"(normally30-days).TheLESOProgramwouldrecommendthatLEAsprovideanoticeofintenttotheCGBonorbeforeJanuary1,2023andatthebeginningofeachfiscalyear(Octoberlst)thereafter.Thisnotificationshouldincludeacomprehensivelistofanycontrolledpropertythatmayberequestedthroughouttheyear.Ifthisnoticeofintentdoesnotincludeaspecificcontrolledpropertyitem,suchitemmaynotberequestedintheLESOProgramuntil30-daysafteranupdatednoticeispublished.RequestsforcontrolledpropertymustcomportwithallapplicableapprovalrequirementsoftheCGB.(1)TheaboverequirementincludeselectedSheriff'swhoalsoshallnotifytheirCGBorcityorcountygovernmentwithintheirjurisdiction.(2)IncasesofdisagreementbetweenrequestingLEAsandCGB,theGovernorappointedLESOProgramStateCoordinator(SC)willobtainanadvisoryopinionfromtheStatesAttorneyGeneral'sOfficeonwhetherCGBsareauthorizedbystatelawtodenytherequest.iii)CampusLEAsoperatinginInstitutionsofHigherEducation(IHE)-LEAsoperatinginlHEsotherwisereferredtoas"CampusPolice"or"CampusLEAs"mustalsoadheretotherequirementsidentifiedbelow:(1)ObtaintheIHEBoardofGovernors(oranequivalentbody)explicitapprovalfortheacquisitionofcontrolledproperty.SuchapprovalmustbeevidencedintheCampusLEAsrequestsubmittedtotheLESOProgram.SilenceorinactionbytheCampusLEAsBoardofGovernorsdoesnotconstituteevidenceofapproval,andthe"reasonableopportunitytoreview"(normally30-days)standarddoesnotapplytoCampusLEAapplications.Page4of9 (2)Certifythattheirpoliciesandtrainingincludespecificprovisionsonusingcontrolledpropertyinawaythatdoesnotchillspeech,isnotdisruptivetotheeducationalenvironment,anddoesnotfosterahostileclimateamongstudents.(3)CampusLEAswhoreceivecontrolledvehiclesarerequiredtoremovethemilitaristicappearance(i.e.,paintingthevehicleadifferentcolor).5)REGIONALSHARINGAGREEMENTSLESOProgramparticipantswhoarepartofaregionalsharingagreementmustalsoadheretothefollowingrequirements.LEAsshall:a)Provideinformationregardingthesizeoftheregion,includingthenumberandsizeoftheLEAwithaccesstotherequestedcontrolledpropertyandtheestimatedpopulationserved.b)EnsureanycontrolledpropertyprovidingsupportinaregionalsharingagreementisutilizedinaccordancewiththeLESOProgramSPOandthisSPOAddendum.c)EnsurethatonlyLESOProgramparticipantswithintheregionalsharingagreementutilizethecontrolledproperty.Agencies/activitieswhoarenotLESOProgramparticipantsmaynotutilizeordirecttheuseofcontrolledpropertyobtainedviatheLESOProgram.d)ObtainSC/SPOCapprovaltotemporarilyconditionallyloanpropertytoanotherLESOProgramparticipantwithintheregionalsharingagreement(ifmissionrequires).IftheSC/SPOCapprovesthetemporaryconditionalloan,itshallbedoneusinganacceptableEquipmentCustodyReceipt(ECR).Attheendofthetemporaryconditionalloan,theitem(s)shallbereturnedtotheoriginalLEAforaccountability.Allrequestsforconditionalloanswillbebasedonbonafidelawenforcementrequirements.i)TheLESOProgramparticipantwithcontrolledpropertyontheirinventorymustcertifythattheotherLESOProgramparticipantintheregionalsharingagreementrequestingthepropertyunderaconditionalloan:(1)Hasadoptedrequisiteprotocols(inSection6below)orwilladoptthoseprotocolsbeforetheirpersonnelusethecontrolledproperty,(2)Haveprovidedrequisitetraining(inSection7below)orwillprovidethattrainingbeforetheirpersonnelusethecontrolledproperty,and(3)Willadheretotheinformationcollectionandreteritionrequirements(inSection8below).ii)TheLEAconditionallyloaningthecontrolledpropertywillremainaccountabletotheLESOProgramtoensuretheaboveprovisionsaremet.6)POLICIES/PROCEDURESLEAsmustestablishpolicies/proceduresthatareconsistentwiththestandardslistedbelow,inordertorequestormaintaincontrolledproperty.LEAsmust:a)Adoptandcomplywithgeneralpolicingstandards.i)CommunityPolicing-LEApolicies/proceduresshouldreflecttheconceptthattrustandmutualrespectbetweenpoliceandthecommunitiestheyservearecriticaltopublicsafety.CommunitypolicingfostersrelationshipsbetweenlawenforcementandthelocalcommunitywhichpromotespublicconfidenceinLEAsthereforeincreasingLEAabilitytoinvestigatecrimesandkeepthepeace.Page5of9 ii)ConstitutionalPolicing-LEApolicies/proceduresmustemphasizethatallpoliceworkshouldbecarriedoutinamannerconsistentwiththerequirementsoftheU.S.Constitutionandfederallaw.Policies/proceduresmustincludeFirst,Fourth,andFourteenthAmendmentprinciplesinlawenforcementactivity,aswellascompliancewithFederalandStatecivilrightslaws.LEAcertifiedlawenforcementofficersreceivetrainingontherightsembodiedbysuchConstitutionalAmendmentsandhowtheseamendmentsinformpolicingpolicies/procedures.iii)CommunitylnputandImpact-LEApolicies/proceduresmustidentifymechanismsthatLEAswillusetoengagethecommunitiestheyservetoinformthemandseektheirinputaboutLEAsactions,rolein,andrelationshipswiththecommunity.LEAsshouldmakeparticulareffortstoseektheinputofcommunitieswherecontrolledpropertyislikelytobeusedsoastomitigatetheeffectthatsuchusemayhaveonpublicconfidenceinthepolice.ThiscouldbeachievedthroughtheLEAsregularinteractionswiththepublicthroughcommunityforums,townhalls,ormeetingswiththeChief,orcommunityoutreachdivisions.b)Adoptandcomplywithcontrolledpropertystandards.i)AppropriateUseofControlledProperty-LEApolicies/proceduresmustdefmeappropriateuseofcontrolledproperty;officerswhoareauthorizedtousecontrolledpropertymustbetrainedonthesepolicies/procedures.LEAsshouldexaminescenariosinwhichcontrolledpropertywilllikelybedeployed,thedecision-makingprocessesthatwilldeterminewhethercontrolledpropertyisused,andthepotentialthatbothuseandmisuseofcontrolledpropertycouldcreatefearanddistrustinthecommunity.Policies/proceduresshouldconsiderwhethermeasurescanbetakentomitigatethateffect(i.e.,keeparmoredvehiclesatastagingareauntilneeded)andanyalternativestotheuseofsuchpropertyandtacticstominimizenegativeeffectsonthecommunity,whilepreservingofficersafety.ii)SupervisionofUse-LEApo]icies/proceduresmustspecifyappropriatesupervisionofpersonneloperatingorutilizingcontrolledproperty.Supervisionmustbetailoredtothetypeofcontrolledpropertybeingusedandthenatureoftheengagementoroperationduringwhichthepropertywillbeused.Policies/proceduresmustdescribewhenasupervisorofappropriateauthorityisrequiredtobepresentandactivelyoverseeingthepropertybeingused.iii)EffectivenessEvaluation-LEApolicies/procedures1:nustarticulatethattheLEAwillregularlymonitorandevaluatetheeffectivenessandvalueofcontrolledpropertytodeterminewhethercontinueddeploymentanduseiswarrantedonoperational,tactical,andtechnicalgrounds.LEAsshouldroutinelyreviewafter-actionreportsandanalyzeanydataon,forexample,howoftencontrolledpropertyisusedorwhethercontrolledpropertyisusedmorefrequentlyincertainlawenforcementoperationsorinparticularlocationsorneighborhoods.iv)AuditingandAccountability-LEAmustestablishpolicies/proceduresthataredesignedtopreventmisuse,unauthorizeduseand/orlossofcontrolledproperty.LEAwillholdpersonnelaccountabletoagreeandcomplywithState,local,TribalandFederalcontrolledpropertyusepolicies/procedures.v)TransparencyandNotice-LEApolicies/proceduresmustarticulatethatLEAwillengagethecommunityregardingcontrolledproperty,policies/proceduresgoverningitsuse,andreviewof"significantincidents"(asdefinedinSection8),withtheunderstandingthattherearereasonablelimitationsondisclosuresofcertaininformationandlawenforcementsensitiveoperationsandprocedures.Page6of9
