Home My WebLink AboutExecuted YTC 22-06- Kittitas County Sheriff's OfficeYTC22-06DEPARTMENTOFTHEARMYLICENSEYAKIMATRAININGCENTERMILITARYINSTALLATIONYAKIMAANDKITTITASCOUNTIES,WASHINGTONTHESECRETARYOFTHEARMY,hereinafterreferredtoastheSecretary,ordulyauthorizedrepresentativeunderauthorityoftheGeneralAdministrativePowersofSecretary,herebygrantstoKittitasCountySheriff'sOfficeMulti-AgencySpecialResponseTeam,hereinafterreferredtoasthegrantee,anon-exclusivelicenseforbilleting,diningfacilities,trainingareas,firingranges,andSelahAirstripforemergencyvehicleoperationstrainingover,across,inanduponlandsatYakimaTrainingCenterMilitaryReservation,Washington,hereinafterreferredtoasthepremises.THISLICENSEisgrantedsubjecttothefollowingconditions.1.TERMThislicenseisgrantedforatermofoneyear,beginning1AUGUST2022andending31JULY2023,butrevocableatwillbytheSecretaryoftheArmy.Itisauthorizedfornomorethanseven(7)consecutivedaysandnomorethan30daysfortheterm.2.CONSIDERATIONa.ThegranteeshallpayinadvancetotheUnitedStatestheamountofWaivedandNO/100DOLLARS($0.00),(infullforthetermhereof)(payable)totheorderoftheFinanceandAccountingOfficer,District,anddeliveredtob.AllconsiderationandotherpaymentsdueunderthetermsofthislicensemustbepaidonorbeforethedatetheyaredueinordertoavoidthemandatorysanctionsimposedbytheDebtCollectionActof1982,(31U.S.C.Section3717).ThisstatuterequirestheimpositionofaninterestchargeforthelatepaymentofdebtsowedtotheUnitedStates,anadministrativechargetocoverthecostsofprocessingandhandlingdelinquentdebts;andtheassessmentofanadditionalpenaltychargeonanyportionofadebtthatismorethan90dayspastdue.Theprovisionsofthestatutewillbeimplementedasfollows:(1)TheUnitedStateswillimposeaninterestcharge,theamounttobedeterminedbylaworregulation,onlatepaymentofdebts.Interestwillaccruefrom(theduedate)(thelateroftheduedateorthedatenotificationoftheamountdueismalledtothegrantee).Anadministrativechargetocoverthecostofprocessingandhandlingeachpaymentwillalsobeimposed. (2)Inadditiontothechargessetforthabove,theUnitedStateswillimposeapenaltychargeofsixpercent(6%)perannumonanypaymentorportionthereof,morethanninety(90)dayspastdue.Thepenaltyshallaccruefromthedateofdelinquencyandwillcontinuetoaccrueuntilthedebtispaidinfull.(3)Allpaymentsreceivedwillbeappliedfirsttoanyaccumulatedinterest,administrativeandpenaltychargesandthentoanyunpaidrentalorotherpaymentbalance.Interestwillnotaccrueonanyadministrativeorlatepaymentpenaltycharge.3.NOTICESAllnoticesandcorrespondencetobegivenpursuanttothislicenseshallbeaddressed,iftothegrantee,toKittitasCountySheriff'sOfficeMulti-AgencySpecialResponseTeam,307UmptanumRoad,EIIensburg,WA,98926.POC,ChiefDeputyBenKokjer,WorkPhone:509-962-7525,Email:ben.kokjer@co.kittitas.wa.us,andIftotheUnitedStates,toPublicWorks,ATTN:AMIN-LMP-M,Box339500,MS17,JointBaseLewis-McChord,Washington98433-9500;orasmayfromtimetotimeotheravisebedirectedbytheparties.Noticeshallbedeemedtohavebeendulygivenifandwhenenclosedinaproperlysealedenvelopeaddressedasaforesaid,anddeposited,postageprepaid,inapostofficeregularlymaintainedbytheUnitedStatesPostalService.4.AUTHORIZEDREPRESENTATIVESExceptasotherwisespecificallyprovided,anyreferencehereinto"Secretary","InstallationCommander",or"saidofficer"shallincludetheirdulyauthorizedrepresentatives.Anyreferenceto"grantee"shallincludeanydulyauthorizedrepresentatives.5.SUPERVISIONBYTHEINSTALLATIONCOMIVIANDERTheuseandoccupationofthepremisesshallbesubjecttothegeneralsupervisionandapprovaloftheInstallationCommanderhereinafterreferredtoassaidofficer,andtosuchrulesandregulationsasmaybeprescribedfromtimetotimebysaidofficer.6.APPLICABLELAWSANDREGULATIONSThegranteeshallcomplywithallapplicableFederal,state,countyandmunicipallaws,ordinancesandregulationswhereinthepremisesarelocated.7.CONDITIONALUSEBYGRANTEETheexerciseoftheprivilegeshereingrantedshallbe:a.withoutcostorexpensetotheUnitedStates;b.subjecttotherightoftheUnitedStatestoimprove,useormaintainthepremises. c.subjecttootheroutgrantsoftheUnitedStatesonthepremises.d.personaltothegrantee,andthislicense,oranyinteresttherein,maynotbetransferredorassigned.8.CONDITIONOFPREMISESThegranteeacknowledgesthatithasinspectedthepremises,knowsitscondition,andunderstandsthatthesameisgrantedwithoutanyrepresentationsorwarrantieswhatsoeverandwithoutanyobligationonthepartoftheUnitedStates.9.COSTOFUTILITIESThegranteeshallpaythecost,asdeterminedbytheofficerhavingimmediatesupervisionoverthepremises,ofproducingand/orsupplyinganyutilitiesandotherservicesfurnishedbytheGovernmentorthroughGovernment-ownedfacilitiesfortheuseofthegrantee,includingthegrantee'sproportionateshareofthecostofoperationandmaintenanceoftheGovernment-ownedfacilitiesbywhichsuchutilitiesorservicesareproducedorsupplied.TheGovernmentshallbeundernoobligationtofurnishutilitiesorservices.Paymentshallbemadeinthemannerprescribedbytheofficerhavingsuchjurisdiction.10.PROTECTIONOFPROPERTYThegranteeshallkeepthepremisesingoodorderandinaclean,safeconditionbyandattheexpenseofthegrantee.ThegranteeshallberesponsibleforanydamagethatmaybecausedtopropertyoftheUnitedStatesbytheactivitiesofthegranteeunderthislicense,andshallexerciseduediligenceintheprotectionofallpropertylocatedonthepremisesagainstfireordamagefromanyandallothercauses.AnypropertyoftheUnitedStatesdamagedordestroyedbythegranteeincidenttotheexerciseoftheprivilegeshereingrantedshallbepromptlyrepairedorreplacedbythegranteetoaconditionsatisfactorytosaidofficer,orattheelectionofsaidofficer,reimbursementmadethereforebythegranteeinanamountnecessarytorestoreorreplacethepropertytoaconditionsatisfactorytosaidofficer.11.INDEMNITYTheUnitedStatesshallnotberesponsiblefordamagestopropertyorinjuriestopersonswhichmayarisefromorbeincidenttotheexerciseoftheprivilegeshereingranted,orfordamagestothepropertyofthegrantee,orfordamagestothepropedyorinjuriestothepersonofthegrantee'sofficers,agents,oremployeesorotherswhomaybeonthepremisesattheirinvitationortheinvitationofanyoneofthem,andthegranteeshallholdtheUnitedStatesharmlessfromanyandallsuchclaimsnotincludingdamagesduetothefaultornegligenceoftheUnitedStatesoritscontractors. 12.RESTORATIONOnorbeforetheexpirationofthislicenseoritsterminationbythegrantee,thegranteeshallvacatethepremises,removethepropertyofthegrantee,andrestorethepremisestoaconditionsatisfactorytosaidofficer.If,however,thisIlcenseisrevoked,thegranteeshallvacatethepremises,removesaidpropertyandrestorethepremisestotheaforesaidconditionwithinsuchtimeastheInstallationCommandermaydesignate.Ineitherevent,ifthegranteeshallfailorneglecttoremovesaidpropertyandrestorethepremises,then,attheoptionofsaidofficer,thepropertyshalleitherbecomethepropedyoftheUnitedStateswithoutcompensationtherefor,orsaidofficermaycausethepropertytoberemovedandnoclaimfordamagesagainsttheUnitedStatesoritsofficersoragentsshallbecreatedbyormadeonaccountofsuchremovalandrestorationwork.ThegranteeshallalsopaytheUnitedStatesondemandanysumwhichmaybeexpendedbytheUnitedStatesaftertheexpiration,revocation,orterminationofthislicenseinrestoringthepremises.13.NON-DISCRIMINATIONThegranteeshallnotdiscriminateagainstanypersonorpersonsorexcludethemfrompanicipationinthegrantee'soperations,programsoractivitiesbecauseofrace,color,religion,sex,age,handicapornationaloriginintheconductofoperationsonthepremises.ThegranteewillcomplywiththeAmericanswithDisabilitiesActandattendantAmericanswithDisabilitiesActAccessibilityGuidelines(ADAAG)publishedbytheArchitecturalandTranspodationBarriersComplianceBoard.14.TERMINATIONThislicensemaybeterminatedbythegranteeatanytimebygivingtheinstallationCommanderatleasttendays'noticeinwritingprovidedthatnorefundbytheUnitedStatesofanyconsiderationpreviouslypaidshallbemadeandprovidedfurther,thatintheeventthatsaidnoticeisnotgivenatleasttendayspriortotherentalduedate,thegranteeshallberequiredtopaytheconsiderationfortheperiodshownintheConditiononCONSIDERATlON.15.ENVIRONMENTALPROTECTIONa.Withinthelimitsoftheirrespectivelegalpowers,thepartiestothislicenseshallprotectthepremisesagainstpollutionofitsair,groundandwater.Thegranteeshallcomplywithanylaws,regulations,conditions,orinstructionsaffectingtheactivityherebyauthorizedifandwhenissuedbytheEnvironmentalProtectionAgency,oranyFederal,state,interstateorlocalgovernmentalagencyhavingjurisdictiontoabateorpreventpollution.Thedisposalofanytoxicorhazardousmaterialswithinthepremisesisspecificallyprohibited.Suchregulations,conditions,orinstructionsineffectorprescribedbysaidEnvironmentalProtectionAgency,oranyFederal,state,interstateorlocalgovernmentalagencyareherebymadeaconditionofthislicense.Thegranteeshallnotdischargewasteoreffluentfromthepremisesinsuchamannerthatthe4 dischargewillcontaminatestreamsorotherbodiesofwaterorotherwisebecomeapublicnuisance.b.Thegranteewilluseallreasonablemeansavailabletoprotecttheenvironmentandnaturalresources,andwheredamagenonethelessoccursfromthegrantee'sactivities,thegranteeshallbeliabletorestorethedamagedresources.c.Thegranteemustobtainapprovalinwritingfromsaidofficerbeforeanypesticidesorherbicidesareappliedtothepremises.16.HISTORICPRESERVATIONThegranteeshallnotremoveordisturb,orcauseorpermittoberemovedordisturbed.anyhistorical,archeological,architecturalorotherculturalartifacts,relics,remainsorobjectsofantiquity,Intheeventsuchitemsarediscoveredonthepremises,thegranteeshallimmediatelynotifysaidofficerandprotectthesiteandthematerialfromfurtherdisturbanceuntilsaidofficergivesclearancetoproceed.17.DISCLAIMERThislicenseiseffectiveonlyinsofarastherightsoftheUnitedStatesinthepremisesareconcerned;andthegranteeshallobtainanypermitorlicensewhichmayberequirebyFederal,state,orlocalstatuteinconnectionwiththeuseofthepremises.ItisunderstoodthatthegrantingofthislicensedoesnotprecludethenecessityofobtainingaDepadmentoftheArmypermitforactivitieswhichinvolvethedischargeofdredgeorfillmaterialortheplacementoffixedstructuresinthewatersoftheUnitedStates,pursuanttotheprovisionsofSection10oftheRiversandHarborsActof3March1899(33USC403),andSection404oftheCleanWatersAct(33USC1344).18.SPECIALCONDITIONSa.AccesstotheYakimaTrainingCenterMilitaryReservationwillbecoordinatedwithRangeOperationspriortoallentriesontosaidmilitaryreservationlands.b.AcopyofthislicenseandtheapprovedlandrequestfromRangeOperationswillbecarriedbythegranteewhileonYakimaTrainingCenterMilitaryReservation.c.Thegranteeshallcomplywithalllanduserequirementsinplacewheninuse.d.UsemustbescheduledinadvancewithRangeOperations.e.AlluseofYakimaTrainingCenterranges,aswellasallhandling,movementandstorageofexplosivesandotherhazardousmaterialsonYakimaTrainingCenter,issubjecttoU.S.Army,InstallationManagementCommand,andYakimaTrainingCenterregulationsandrangeStandingOperatingProcedures.Granteeshallconformtothose
