At 1:34 pm Chairman Laura Osiadacz opened the Public Works Study
Session.
TOWNS TO TEANAWAY IMPLEMENTATION
Mark Cook updated the Board of County Commissioners of Public Works
involvement with the Towns to Teanaway Trail Network and it is
consistent with supporting the County recreation plan. Mark Cook
stated that Public Works sponsoring the Towns to Teanaway Trails
allows grants to be pursued through the county. Discussion was held
regarding liability of the county as legal and physical sponsor.
Staff was directed to review/brief the board on the Counties
liability for people recreating on the easements and affirms support.
At 1:41 pm Chairman Laura Osiadacz announced the Board would recess
into Executive Session with Mark Cook, Public Works Director, and
Chris Horner Prosecutor, for 15 minutes - to consider the selection
of a site or the acquisition of real estate by lease or purchase when
public knowledge regarding such consideration would cause a
likelihood of increased price. There was no action anticipated.
At 1:56 p.m. the Board reconvened out of Executive Session. No
Action.
At 1:56 p.m. Chairman Osiadacz announced the Board would recess back
into Executive Session for 10 minutes - to consider the selection of
a site or the acquisition of real estate by lease or purchase when
public knowledge regarding such consideration would cause a
likelihood of increased price. Action anticipated.
At 2:07 p.m. the Board reconvened out of Executive Session. Staff was
directed to prepare the notice of intent to terminate sales
agreement.

RECOMMENDATION:
Affirm Public Works commitment implementing the Towns to Teanaway Trail network.
BRIEFING SUMMARY:
• Public Works (PW) has agreed to accept the Towns to Teanaway trail network
into our asset management system.
• Public Works will assist maintaining the trail system once easements are executed
on an as needed basis and in cooperation with volunteers.
• PW is also budgeting for 2022 development of trailhead parking supporting the
trail network.
• PW will serve as the legal and fiscal sponsor of the project.
• PW will provide necessary liability insurance deemed appropriate by the County's
Risk Manger beyond those required at Revised Code of Washington 4.24.210.
BACKGROUND:
During 2021, PW assisted the Board of County Commissioners (BOCC) revising the
county's recreation and tourism plan. The revised plan recognizes the county's desire to
lead development of a countywide trail system. Supporting that plan element, PW
budgeted the construction of trailhead parking (Towns to Teanaway) and accepting the
trail network into PW asset portfolio.
DISCUSSION:
Acquiring the Towns to Teanaway trail system is consistent with County recreation plan
Objectives. PW has committed resources to build trailhead parking and take on ongoing
maintenance of the trail system. Supplemental efforts towards trail maintenance, acting
as the fiscal and legal sponsor of the trail network, holding easements, sponsoring grant
applications, and tracking any legal expenditures through our fiscal division are all
activities that we are ready to accept on behalf of the Board.
FISCAL IMPACTS:
Trailhead parking is budgeted in the 2022 PW road maintenance budget.

Good Morning Mr. Cook,
As we move towards solidifying the adoption of Towns to Teanaway by Public Works, I thought it might be helpful to
clearly write out the Implementation Group's asks of your department. It is not our intention to create additional
burdens on your very limited staff!
We hope that Public Works will:
Serve as the legal and fiscal sponsor for the project, such that we can:
o Pursue grants using the county as the applying entity
o Accept grant funds into an account managed by Public Works, from which we can issue checks to pay
contractors for trailwork
Provide us with account statements so we can operate transparently
Hold trail easements purchased from or donated by private land owners
Extend liability insurance coverage to the trail system. HOWEVER, recreation on private lands in the State of
Washington is also protected under RCW 4.24.210, so becoming the legal and fiscal sponsor for T2T should not
place an undue legal burden on the county.
We do NOT expect Public Works to:
• Put manpower or resources towards the construction of the trails, unless a specific project is negotiated with
the county (Ex: improvements to the Ronald Coal Mines Trail parking area, which was discussed some time
before we applied for project sponsorship)
• Otherwise fund the implementation of the T2T master plan
o Although, again, if the County would like to provide match on certain projects, that would be
wonderful!
• Take over maintenance of the trail system. Thus far we have conducted maintenance through volunteer efforts,
with some professional assistance from Greenway Trust trail crews and the local EMBA chapter.
• Conduct outreach to the community regarding new trail construction, trail closure, recreational etiquette, or
really anything at all. The Implementation Group has maintained communication channels and is happy to
continue doing so.
• Provide signage, or put any resources towards developing or implementing a signage plan
If, as Public Works grows and gains resources to manage recreational infrastructure, you are interested in using the T2T
system as a case to train staff or test out the department's ability to oversee and complete rec projects, we would be
very happy to work with you on that! But please know that we do not expect the county to come in and make T2T real
on our behalf.

RECOMMENDATION:
Direct staff prepare enabling documents formalizing land transfer from the Solid Waste
Fund to the Road Fund.
BRIEFING SUMMARY:
• Solid Waste (SW) acquired approximately 50 acres adjacent to Highway 97
supporting transfer station relocation in 2018.
• Preparing for site development, Public Works (PW) secured design services
(University Way/Reecer Creek traffic signal) after consulting with City of
Ellensburg engineering staff.
• SW began short plating the property in 2020 and finalized the short plat in 2021
creating two parcels (10.97 acres and 38.84 acres).
• PW began University Way/Reecer Creek signal construction in 2021 allowing
SW constructed site improvements (water, sewer, and access) to proceed in 2021.
• PW finalize funding of University Way/Reecer Creek signal improvements in
2022.
• Final land, traffic signal construction and land improvement costs now allow a
reconciliation between the two funds.
BACKGROUND:
Following a significant public outreach effort, SW purchased approximately 50 acres on
land adjacent to Highway 97. During land use application to the City of Ellensburg, the
City burdened construction of the traffic signal at University and Reecer upon the
County. Assisting SW, PW began signal design and then transferred construction the city
in 2020. SW constructed site improvements in 2020 and PW finalized signal funding
early in 2022. PW supported the platting of the SW site allowing approximately 10 acres
for PW acquisition. The Equipment Rental and Replacement Fund (ER&R) manages
Road Fund properties. The Board of County Commissioners (BOCC) has expressed
interest in supporting low-income housing on the current Road Maintenance Shop in
Ellensburg. PW recently completed the required Department of Ecology land use
covenant on the Lower County Shop property clearing the path to acquisition on the part
of Hope Source. All costs and land use actions are now complete for PW acquisition of

SW land and the two departments of the BOCC (SW and PW) are ready to reconcile fund
expenditures.
DISCUSSION:
Early in the SW land acquisition process, PW committed $500,000 towards acquisition of
approximately 10 acres of land adjacent to the new transfer station (pro -rata contribution
based on land area allocation and initial property cost). Co -location allows for efficient
use of PW resources supporting the transfer station (personnel, equipment, and
equipment maintenance). Recently, SW presented a final cost for the 10 acres of land
with apportioned costs of site development. The requested acquisition price is now
$1,074,717.97 (EXHIBIT 1). PW has expensed $779,188.42 (EXHIBIT 2) towards
traffic signal costs. The difference in expenditures between the two funds is:
$295,529.55.
PW is requesting the BOCC expense $295,529.55 of American Recovery Act funding
towards acquisition of the approximate 10 acres from SW needed to relocate the Lower
County Maintenance Shop. PW proposes paying SW $500,000 in addition to the Board's
expenditure of $295,529.55 for a total of $795,529.55 to SW for the land. ER&R will
then transfer the existing shop properties to the General Fund clearing the way for
ultimate disposal as the BOCC sees fit. Previous discussions with the BOCC suggested a
much larger general fund contribution was required from the General Fund for SW land
acquisition by PW of $574,717.97.
FISCAL IMPACTS:
Payment from the General Fund (American Recovery Act) to ER&R allowing acquisition
of approximately ten (10) acres of SW land to PW for approximately $295,530. PW has
previously committed $500,000 towards SW land acquisition. Combining the Board's
contribution of $295,530 with PW's $500,000 affords approximately $795,530 to SW for
the land purchase.
