Kittitas County <br />Prosecutor <br /> <br />Agenda Staff Report <br /> <br />AGENDA DATE: <br />11/2/2021 <br /> <br />ACTION REQUESTED: <br />Discuss and decide next steps regarding Shady Acres Mobile Home Park <br /> <br />BACKGROUND: <br />Kittitas County is the landlord for the Shady Acres Mobile Home Park. The written leases it has (many <br />tenants have refused to sign written leases and so are month-to-month tenants) will be expiring in December <br />of 2021. RCW 59.20.050 requires the County to offer a written lease of at least a year's term at the date of <br />these lease expirations. Pursuant to RCW 59.20.090, should a tenant with a written five-year lease refuse to <br />sign the offered one-year lease, their five-year lease would renew automatically. RCW 59.20.080 prohibits <br />not renewing leases unless (among other possibilities not applicable here) the landlord is going to close the <br />park. Under (1)(e) of that RCW a closure requires a one-year notice prior to the closure. (1)(e)(iii) of that <br />RCW provides that, after providing said closure notice, the landlord may compensate the tenant for the <br />assessed value of their mobile home and give them not less than 90 days to vacate. The tenant is still <br />obligated to pay rent until such vacation. <br /> <br />INTERACTION: <br />Options: <br />1. Renew leases for ___ number of years. <br />2. Decide to close the park, issue a closure notice of at least one year. <br />3. After issuance of closure notice, compensate tenants for assessed value of mobile homes and issue <br />written notice of at least 90 days to vacate. <br />The county could to 1, 1 and 2, or 1, 2, and 3. <br />It is possible that NWJP will re-file their lawsuit claiming fair housing act violations. <br /> <br />RECOMMENDATION: <br />None. <br /> <br />HANDLING: <br />None <br /> <br />LEAD STAFF: <br />Neil Caulkins <br />
