COMMISSIONERS' MINUTES KITTITAS COUNTY, WASHINGTON AGENDA SESSION REGULAR MEETING
TUESDAY 10:00 A.M. SEPTEMBER 7, 2021
Board members present: Chairman Brett Wachsmith; Vice-Chairman Laura
Osiadacz & Commissioner Cory Wright (via Webex).

Per Governor Inslee’s Proclamation 20-28 et seq., the public was
encouraged to join the meeting virtually or in person.
CALL TO ORDER
Chairman Wachsmith called the meeting to order.
PLEDGE OF ALLEGIENCE
Chairman Wachsmith led the Pledge of Allegiance.
INTRODUCTION OF NEW COUNTY EMPLOYEES - NONE PROCLAMATIONS PROCLAMATION CONSTITUTION DAY & CITIZENSHIP DAY COMMISSIONERS
Vice-Chairman Osiadacz moved to approve a Proclamation declaring
September 17, 2021, as “Constitution Day and Citizenship Day” and
encourages citizens of Kittitas County to attend a celebration at Rotary
Park to reaffirm our commitment to a strong adherence to the
foundational principles put forth in the Constitutions and laws for
naturalization citizenship. Commissioner Wright seconded. Motion carried
3-0.

APPROVAL OF AGENDA
Vice-Chairman Osiadacz moved to approve the Agenda, as presented.
Commissioner Wright seconded. Motion carried 3-0. CONSENT AGENDA
The Board reviewed each item individually prior to making any motions.
At the conclusion of reviewing each item Vice-Chairman Osiadacz moved to
approve the Consent Agenda, as amended by removing Consent Items H, I, J
and Q. Commissioner Wright seconded. Motion carried 3-0. MINUTES

SET PUBLIC HEARING AMEND KCC CODE CHAPTER 2.09 LOWER DISTRICT COURT
Approve Setting a Public Hearing to consider Amendments to Kittitas
County Code Chapter 2.09, to be held in the Commissioners Auditorium,
Room 109, Kittitas County Courthouse 205 West 5th Ave. Ellensburg, WA and
to authorize the Clerk to publish said notice.
SET PUBLIC HEARING AMEND KCC CODE CHAPTER JUVENILE
Approve Setting a Public Hearing to consider Amendments to Kittitas
County Code Chapter 2.55.080, to be held in the Commissioners

APPOINTMENT MATTHEW STALDER COMMISSIONERS
Approve appointing Matthew Stalder to the Homelessness & Affordable
Housing Committee, for a term effective immediately and expiring
December 31, 2021.
RESOLUTION 2021-140 HOPESOURCE COMMISSIONERS
Approve Resolution No. 2021-140, Authorizing a Professional Services
Agreement between Kittitas County and HopeSource in the amount of
$3,500.00 for the Provision of the Youth Recreational Scholarship
Program from January 1, 2021, through December 2022.
RESOLUTION 2021-141 COMMUNITY BUILDERS COMMISSIONERS
Approve Resolution No. 2021-141, Authorizing a Professional Services
Agreement between Kittitas County and Community Builders, in the amount
of $2,000.00 in 2021 and 2022, to provide the Upper Kittitas County
Youth Activities Summer Program.
AGREEMENT KITTITAS COUNTY HEALTH NETWORK SHERIFF
Approve a Modification of the Existing Personal Services Agreement
between Kittitas County and Kittitas County Health Network for the MAT
Program, from July 6, 2021, through September 30, 2023.
REQUST TO APPROVE A RESOLUTION AUTHORIZING AN INTERLOCAL AGREEMENT BETWEEN THE KITTITAS COUNTY PUBLIC HEALTH DEPARTMENT AND THE DEPARTMENT OF ECOLOGY (SOLID WASTE) – ITEM REMOVED FROM THE AGENDA REQUEST TO APPROVE A CONTRACT AMENDMENT BETWEEN THE KITTITAS COUNTY PUBLIC HEALTH DEPARTMENT AND THE KITTITAS COUNTY HEALTH NETWORK – ITEM REMOVED FROM THE AGEDA REQUEST TO APPROVE A RESOLUTION AUTHORIZING AN INTERLOCAL AGREEMENT BETWEEN THE KITTITAS COUNTY PUBLIC HEALTH DEPARTMENT AND THE DEPARTMENT OF ECOLOGY (WELL DELEGATION) – ITEM REMOVED FROM THE AGENDA RESOLUTION 2021-142 MANASTASH RD BANK STABILIZATION PROJECT PUBLIC WORKS
Approve Resolution No. 2021-142, Awarding Hydraulics and Hydrology
Design Support for the Manastash Road Bank Stabilization Project to
Natural Waters and to Authorize the Public Works Director to Negotiate
Scope of Work and Fee for Said Project.

REQUEST FOR PROPOSALS BARN & GARAGE DEMOLITION PUBLIC WORKS
Approve a Request for Proposals for demolition services removing one
barn and one garage, salvaging associated materials, disposing of
unsalvageable materials, and removing all materials within the
identified vicinity of the structures, to be submitted by 4:00 p.m. on
October 1, 2021, at the Kittitas County Public Works Department 311 N.
Ruby Street, Suite 1, Ellensburg, WA and to authorize the Clerk to
publish said notice.
SET PUBLIC HEARING REAL ESTATE EXCISE TAX PUBLIC WORKS
Approve Setting a Public Hearing to consider amending Kittitas County
Code Chapter 3.09 (0.10) Real Estate Excise Tax, to be held at 2:00 p.m.
on September 21, 2021, in the Commissioners Auditorium, Room 109,
Kittitas County Courthouse 205 West 5th Ave. Ellensburg, WA and to
authorize the Clerk to publish said notice.
RESOLUTION 2021-144 WA STATE DEPT. OF TRANSPORTATION PUBLIC WORKS
Approve Resolution No. 2021-144, Authorizing the Chair’s Signature on
Title VI Standard Assurances and the Letter of Intent to Comply with the
Washington State Department of Transportation Title VI Plan.
RESOLUTION 2021-143 LAB ENGINEERING AND/OR TESTING SERVICES PUBLIC WORKS
Approve Resolution No. 2021-143, Authorizing the Chairman’s Signature on
the Washington State Department of Transportation (WSDOT) Reimbursable
Agreement No. GCB3557 for State Materials Lab Engineering and/or Test
Services.
SET PUBLIC HEARING SURPLUS EQUIPMENT PUBLIC WORKS
Approve Setting a Public Hearing to consider equipment surplus to the
Kittitas County’s needs, to be held at 2:00 p.m. on September 21, 2021,
in the Commissioners Auditorium, Room 109, Kittitas County Courthouse
205 West 5th Ave. Ellensburg, WA and to authorize the Clerk to publish
said notice.
REQUEST TO APPROVE A PERSONAL SERVICES AGREEMENT BETWEEN KITTITAS COUNTY AND PHIL BACKLUND – ITEM REMOVED FROM THE AGENDA.

John Jensen provided information to the Board and thanked them for their

letter to the City of Cle Elum regarding the 47 Degree North project.

At 10:35 a.m. Chairman Wachsmith announced the Board would recess into
Executive Session for 20 minutes with Greg Zempel, Prosecutor; Jodi
Hammond, Chief Criminal Deputy; Elishia Harvill, Chief Administrator;
Jim Goeben, IT Director, to consider, if in compliance with any required
data security breach disclosure under RCW 19.255.010 and 42.56.590, and
with legal counsel available, information regarding the infrastructure
and security of computer and telecommunications networks, security and
service recovery plans, security risk assessments and security test
results to the extent that they identify specific system
vulnerabilities, and other information that if made public may increase
the risk to the confidentiality, integrity, or availability of agency
security or to information technology infrastructure or assets. No
action anticipated.
At 10:55 a.m. the Board reconvened out of Executive Session. No action
was taken.
At 10:55 a.m. Chairman Wachsmith announced the Board would recess back
into Executive Session for 10 minutes to consider, if in compliance with
any required data security breach disclosure under
RCW 19.255.010 and 42.56.590, and with legal counsel available,
information regarding the infrastructure and security of computer and
telecommunications networks, security and service recovery plans,
security risk assessments and security test results to the extent that
they identify specific system vulnerabilities, and other information
that if made public may increase the risk to the confidentiality,
integrity, or availability of agency security or to information
technology infrastructure or assets. No action anticipated.
At 11:05 a.m. the Board reconvened out of Executive Session. No action
was taken.
At 11:05 a.m. Chairman Wachsmith announced the Board would recess back
into Executive Session for 5 minutes to consider, if in compliance with
any required data security breach disclosure under

Based upon a possible breach of security, the IT Department and
Prosecutors office will work together to notify the people if needed to
establish a scope of work, if there is any potential breach.
