and <br />ADDENDUM TO AGREEMENT FOR PROFESSIONAL SERVICES <br />(Hearing Examiner) <br />THIS ADDENDUM TO AGREEMENT FOR PROFESSIONAL SERVICES, by and <br />between Kittitas County, Washington ('oCounty"), duly organized and operated under and by virtue <br />of the Constitution and the laws of the State of Washington, acting by and through its duly <br />authorized officers and, Andrew L. Kottkamp ("Kottkamp"), in his individual capacity. <br />Recitals: <br />WHEREAS, the County is authorized pursuant to RCW 36.32.245 to enter into this <br />Agreement for professional services for performance of the duties of the land use hearing <br />examiner; and <br />WIIEREAS, on August 5, 2008, the Board of Kittitas County Commissioners appointed <br />Andrew L. Kottkamp as the Kittitas County Hearing Examiner; and <br />WHEREAS, the original contract forprofessional services remains in full force and effect; <br />WHEREAS, the County and Kottkamp wish to amend the Agreement for Professional <br />Services to modify the compensation to be paid to Kottkamp; and <br />WHEREAS, Kottkamp has agreed to this change, <br />NOW, THEREFORE, that August 5, 2008, Agreement for Professional Services is <br />hereby amended as follows: <br />AMENDMENT <br />SECTION 7: COMPENSATION is hereby amended as follows: <br />Under this Agreement Provider shall be compensated at the rate of $200 an hour for all <br />professional services performed for hearing. Provider shall also be compensated $125 an <br />hour for traveling time to and from Kittitas County, as well as for site visits, if deemed <br />necessary. Provider shall submit bills on a monthly basis to the Counfy. Such bills shall be <br />paid on a timely basis. Provider agrees and acknowledges that he is an independent <br />contractor and provider shall timely pay all federal, state and local income, self- <br />employment, business and occupation taxes that may accrue and come due as a result of <br />compensation under this Agreement. <br />The remainder of the Agreement for Professional Services dated August 5, 2008 is hereby <br />reinstated and incorporated herein by this reference. <br />ADDENDUM TO AGREEMENT FOR PROFESSIONAL SERVICES, <br />IIEARING EXAMINER Page I
