AGENDA STAFF REPORT
AGENDA DATE: September 7, 2021
ACTION REQUESTED: Request to set a public hearing to consider amendments to
Kittitas County Code 2.55.080.
BACKGROUND: The Board had previously adopted provisions in the Code
that provided for internal review of any denial or
withholding of Public Records requested pursuant to the
Public Records Act, RCW 42.56. A similar provision in
San Juan County was found by the Washington Supreme
Court in Kilduff v. San Juan County, 194 Wn. 2d 859
(2019) to violate the Public Records Act.
INTERACTION: Deputy Prosecuting Attorney Doug Mitchell brought to the
attention of the RMC that the ordinance was not in
compliance with the recent Supreme Court decision.
Therefore on behalf of the RMC we are requesting to set a
public hearing on September 21, 2021 to consider
amendments to Kittitas County Code 2.55.080.
RECOMMENDATION: To set a public hearing on September 21, 2021 at 2pm.
