KITTITAS COUNTY <br /> <br />2021 AGENDA STAFF REPORT <br /> <br /> <br />AGENDA DATE: July 6, 2021 <br /> <br />ACTION REQUESTED: Approve the transfer of development rights and <br />responsibilities supporting the sale of New Suncadia to <br />Real Capital Solutions, LLC (dba New Suncadia Resort) <br /> <br /> <br />BACKGROUND: New Suncadia desires selling interest in the Master Planned <br />Resort (MPR) to Real Capital Solutions (dba New Suncadia <br />Resort). Over the past several weeks, the Prosecuting <br />Attorney’s Office and several departments of the Board <br />have worked addressing specifics of the proposed <br />ownership transfer agreement. Affected Jurisdictions have <br />been contacted and staff has assisted the PA’s Office <br />vetting the viability of the proposed purchaser. Transfer <br />documents are now ready for Board action. The documents <br />inventory outstanding issues in the “restated” development <br />agreement for noticing purposes to New Suncadia Resort. <br />Approval of transfer documents is anticipated to “reset” the <br />County’s relationship with MPR owner and management <br />interests. <br /> <br />INTERACTION: Public Works. <br /> <br />RECOMMENDATION: Approve transfer documents. <br /> <br />HANDLING: Return one original to Public Works. <br /> <br />ATTACHMENTS: Resolution Authorizing the Transfer of the Suncadia <br />Property and Development Agreement and Its Entitlements, <br />Obligations, Covenants and Conditions <br /> <br /> Agreement Ratifying and Confirming Development <br />Agreement By and Between Kittitas County, Washington <br />and New Suncadia, LLC and Suncadia Resort, LLC. <br /> <br />LEAD STAFF: Dan Carlson, Director, CDS <br />Mark R.
