BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />ORDINANCE NO. 2021-____ <br />AN ORDINANCE AMENDING KITTITAS COUNTY CODE CHAPTER 4.08-PROCESSING FEES <br />WHEREAS:Kittitas County is authorized by RCW 84.34.030(2) to charge a reasonable processing fee for processing applications for current use classification of farm and agricultural lands, <br />if established by the Kittitas County Board of Commissioners; and <br />WHEREAS:Kittitas County is authorized by RCW 84.33.130(2) to charge a reasonable processing fee for processing applications forclassification asdesignated forest land, if established <br />by the Kittitas County Board of Commissioners; and <br />WHEREAS:The Kittitas County Board of Commissioners have, by separate Resolution, established these processing fees; and <br />WHEREAS:The establishment of an application processing fee for current use classification of farm and agricultural lands has been codified in Kittitas County Code Section 4.08.010; and <br />WHEREAS:Kittitas County Code Sections 4.08.010 needs to be amended as the processing fee amount referenced in this section has changed, but it would be more efficient to completely remove <br />reference to specific processing fee amounts from the code, as this fee amount may continue to changein the future;and <br />WHEREAS:The establishment of application processing fee for classification as designated forest land has not yet been codified in county code, so a new section should be added Kittitas <br />County Code Chapter 4.08-Processing Fees, to do so; and <br />WHEREAS:Kittitas County Code Section 4.08.020 can be eliminated in its entirety as it is out of date, as the current use classification of open space use and timber land has been significantly <br />modified by state law, and this classification is now addressed in a different chapter of county code; and <br />WHEREAS:Kittitas County strives to implement reasonable fees to minimize the impact ofprocessing permits to the taxpayer's general fund which supports more general governmentservices; <br />NOW, THEREFORE, BE IT ORDAINED, Kittitas County Code Chapter 4.08 shall be amended to read as follows(additions to this text are shown by underline and deletions by strikeout): <br />Sections <br />4.08.010 Farm and agricultural use classification applications. <br />4.08.015 Designated forestland applications. <br />4.08.020 Open space use classification applications. <br />4.08.030 Ratification of prior acts. <br />4.08.010 Farm and agricultural use classification applications. <br />Commencing January 1July 20, 19902021, the county assessor'sCounty Assessor’soffice is hereby authorized and required to collect a nonrefundable processing fee of $100.00for each application <br />received on farm and agricultural current use classification applications, as contemplated byRCW 84.34.030as amended.The fee shall be set by resolution of the Board of County Commissioners. <br />(Ord. 99-05; Ord. 8912 § 1, 1989). <br />4.08.015 Designated forestland applications. <br />Commencing July 20, 2021, the County Assessor's office is hereby authorized and required to collect a nonrefundable processing fee for each designated forestland application, as contemplated <br />by RCW 84.33.130. Fee shall be set by resolution approved by the Board of County Commissioners. <br />4.08.020 Open space use and timber land use classification applications. <br />Commencing January 1, 1990, the county board of commissioners is hereby authorized and required to collect a nonrefundable processing fee of $300.00 for each open space current use classification <br />application as contemplated by RCW 84.34.030 as amended. (Ord. 2015-001, 2015; Ord. 99-05; Ord. 8912 § 2, 1989). <br />4.08.030 Ratification of prior acts. <br />Any act consistent with the authority and prior to the effective date of the ordinance codified in this chapter is hereby ratified and confirmed. (Ord. 99-05; Ord. 89-12 § 3, 1989). <br />BE IT ALSO ORDAINED, the Information Technology Department is charged with incorporatingand updating the amendment authorized herein on the Kittitas County web page. <br />BE IT FURTHER ORDAINED, the Prosecuting Attorney's Office is charged with correcting anyscrivener's errors arising out of the amendment process.
