AGENDA DATE: April 20, 2021
ACTION REQUESTED: Request to Approve a Special Event Application authorizing
Richard Hoyt to host the 2021 Washington State Sporting
Clay Championships from July 1,2,3, & 4, 2021.
BACKGROUND: The Commissioners office received a Special Event
Application from Richard Hoyt to host the 2021 Washington
State Sporting Clay Championships from July 1,2,3, & 4,
2021.
INTERACTION: The applicant is requesting a waiver to the Penal Bond -
Kittitas County Code Chapter 5.20.100 – Penal Bond – Bond
of Indemnity.
The applicant is not requesting a waiver to Kittitas County
Code Chapter 5.20.160 – Closing Hours.
The permit fee has been paid and Staff has routed the
application and received a recommendation of approval or
contingent approval from the following departments: Sheriff,
Public Health, Public Works, Solid Waste, Prosecutor,
Treasurer and Fire Marshal. (Specific comments may be seen
in the Department Memo’s attached).
RECOMMENDATION: Approve the Special Event Application Richard Hoyt to host
the 2021 Washington State Sporting Clay Championships
from July 1,2,3, & 4, 2021. With the following
contingencies:
Public Health/EH: Reminder
As long as there is follow through with the
stewardship plan and all applicable COVID
restrictions be adhered to for the current re-opening
phase in Kittitas County they approve the event.
Public Works: Information
Will be in the area for chip sealing operations that
week but will schedule Westside Road accordingly to
not be in the area to add to the increase of daily
traffic.
***Fire Marshal: Contingent
Mr. Hoyt must schedule an inspection 48 hours prior
to the event with a passing inspection. Also a 4lb or
larger ABC fire extinguisher is required at each
structure. It is recommended that an AGW (water)
fire extinguisher be available on premise.
Treasurer: Information
Based upon review of the application for the 2021
Washington State Sporting Clay Championships from
July 1,2,3, & 4, 2021, this event would be exempt
from the collections of Admission tax based upon
Kittitas County Code 3.2 Admissions Tax section
3.22.030 exemptions (d) which states:
d. The admissions tax imposed by this ordinance shall not
apply to a charge or fee paid by contestants in order to
participate in an event or activity, if the charge or fee paid is
actually used to fund cash payouts to the contestants. Any
portion of such charge or fee that is not used to fund cash
payouts to the contestants is still subject to the admissions
tax. This exemption does not apply to charges or fees paid
by spectators to the event or activity, even if such charge or
fee is used to fund cash payouts.
However, if admission is going to be charged to spectators,
then admission tax needs to be collected and remitted. Also
as stated above, if any portion of such charge or fee that is
not used to fund cash payouts to the contestants is still
subject to the admissions tax.
In 2019, there was not any admissions tax online-registration
or remittance of any tax collected, leaving me with the
assumption, the event did not have any additional funds.
2020 was cancelled to due COVID-19 Pandemic.
Staff recommends approval noting that the obligations are
met by the Fire Marshal and the County Treasurer.
HANDLING: Staff will notify the applicant of the Board’s decision & send
a copy to the Sheriff, Public Works, Public Health, Solid
Waste, Prosecutor, Fire Marshal, Auditor, Treasurer, Code
Enforcement and KITTCOM.
