DEPARTMENT OF PUBLIC WORKS
2021 AGENDA STAFF REPORT
AGENDA DATE: April 20, 2021
ACTION REQUESTED: Conduct a Public Hearing for Partial Vacation of Rights of
Way in Division 1 of Timber Valley
BACKGROUND:
Public Works received an application to vacate portions of
rights of way in Division 1 of Timber Valley in February
2021. The County Engineer and Surveyor conducted
research pursuant to the request and finds no reason
denying the request for vacation. Once vacated, the land
will become attached to the applicant and add to the taxable
land mass of the County. The interior roads (being
vacated) were never constructed and the dedication for
public use requires a vacation by the County.
INTERACTION:
Public Works.
RECOMMENDATION:
Conduct a Public Hearing and authorize the requested
vacation of right of way.
HANDLING:
Return one original to Public Works.
ATTACHMENTS:
Director's Report; Legal description and Map.

DIRECTOR'S REPORT
PROPOSED VACATION OF PLATTED RIGHT OF WAY WITWN TIMBER
VALLEY DIVISION 1 PLAT
An application for a road vacation of platted right of way within Timber Valley Division 1 was received
by Public Works on February 16, 2021 (EXHIBIT 1). The applicant (Josh Benson) is requesting partial
vacation of platted right of way as follows: Nelson Creek Road, Little Creek Road and Timber Road
(EXHIBIT 2). The rights of way are located in portions of the SW'/2 of Section 26, Township 20 North,
Range 14 East, WM Kittitas County, WA.
Kittitas County Code 12.22.040 requires a Director's Report for all vacation requests.
The adjoining property of the proposed vacation falls to a single ownership, the details of which are as
follows:
Parcel ID: 501334
Map No.: 20-14-26053-0087
Owner Name: BENSON, JOSHUA E, HULL, LACEY M
Requirements of RCW 36.87.040 Director/Engineers Report:
1. Whether County road right of way should be vacated or abandoned.
2. Whether road is in use or has been in use.
3. The condition of the road.
4. Whether it will be advisable to preserve it for the county road system in the future.
5. Whether the public will benefit by the vacation.
6. A determination by appraisal of the fair market value of the area sought to be vacated
7. Whether the proposed area to be vacated contains utilities.
8. All other matters which will be of interest to the board including an itemized list of costs and
expenses incurred in the examination, report, appraisal and all proceedings pertaining to
such petition to vacate and abandon.
Required Report Elements Pursuant to KCC 12.22.040 (Mirror RCW 36.87.040):
1. Timber Valley Division 1 plat was recorded in April 1973 (EXHIBIT 3). The various rights of
way depicted on the face of the plat were no constructed in their entirety following final plat.
The portions of the various plat roadways being requested for vacation have not been
constructed since 1973. The rights of way are dedicated to the County for public use
although the internal road network is private.
2. The roadway portions being sought for right of way vacation (Nelson Creek Road, Little
Creek Road and Timber Road) have never been in use (roads never built).

Dept. of Public Works
Page 2
3. There is no road condition to report on.
4. As there has been no road constructed since 1973, there appears to be no need to preserve
the rights of way for public use. The proposed vacation allows unification of separate lots for
the requestor (Benson) and the added property will add to the tax parcel calculation for the
requestor providing additional property tax revenue for the County.
5. The public is benefited by the vacation as an increase is property tax revenue results from
the vacation action.
6. There is no fair market valuation associated with this request as there is no adverse financial
impact to the County (no historic or current expense to the County for the rights of way).
7. There have been no expenditures on any of the rights of way by the County.
8. There are no utilities of record contained in any of the requested vacation of rights of way.
9. The requestor (Benson) has paid the Public Works 'Road Vacation Application Fee" of
$4,205. This amount is expected to cover all costs associated with processing of the
application.
The Department of Public Works recommends the Board approves the proposed vacation of portions
of Nelson Creek Road, Little Creek Road and Timber Road (EXHIBIT 2) as requested.
Dated this 20th day of April 2021.
