A RESOLUTION REGARDING LEASE AMENDMENT WITH ELLENSBURG
PALLETS LLC
WHEREAS: Kittitas County and Ellensburg Pallets LLC entered into a lease December 1,
2020; and
WHEREAS: the parties desire to amend that lease in the form of Attachment "A"; and
WHEREAS: at a public hearing, duly noticed, the Board of County Commissioners determined
it to be in the best interest of the public to amend the lease with Ellensburg pallets LLC.
NOW THEREFORE BE IT RESOLVED that chairman of the Board of County
Commissioners is authorized to execute an amendment to the lease with
Ellensburg Pallets LLC.

AIRPORT/INDUSTRIAL AREA LEASE AMENDMENT
THls LEASE AMENDMENT is made and dated this _[tha v ofVttuuy,2o2!,
by and between KITTITAS COUNry, a municipal corporation in tfrettate df
Washington, hereinafter referred to as the Cou nty, and
e ereinafter referred to as the Lessee. This
amendment s a ll be effective Janua rv fffZOZt.
WITNESSETH:
WHEREAS, the county and the Lessee entered into a lease on January 1_,
2020; and
wHEREAS, section 26 of said lease contemplates amendment; and
WHEREAS, Lessee would prefer to be making monthly rather than annual
payments; and
wHEREAS, the Kittitas County Airport Department supports the change in
lease provision to provide for monthly payments; and
WHEREAS, the parties desire to amend the lease to allow for monthly
payments.
Now, THEREFORE, lr ls HEREBY AGREED by and between the parties to
amend the lease terms as follows:
section 2 of said lease shall be amended to read as follows:
"Rent shall be paid on or before the first day of each month forthe
term of this lease (until Decembe r 31,, 2025) as follows:
Ground Lease-5t,t62.35 per month
Buildine Lease-260.65 per month for January through November, and
SZSO.IO for December.
Additionally, Lessee shall pay any applicable leasehold tax. payment
shall be made to the Kittitas county Airport Department. Any rental
payment received after the L0th day of any given month shall accrue a
delinquency charge of twelve percent (r2%) per annum, levied monthly.
on the first day of January of each year of the lease term (202t,2022,
2023, 20241these rental amounts, both the ground lease rate and the
building lease rate, shall increase by I.5% each year as a set rate increase."
All other terms and conditions of the aforementioned lease shall remain
in full force and effect.

and affixed their seals the day and year first written above.
