CLE ELUM
THIS AGREEMENT is entered into on this 15th day of December 2020 between
the City of Cle Elum; Library Board of Trustees (hereinafter referred to as the “Board”)
and Kittitas County (hereinafter referred to as the “County”); and consented to by the
City of Cle Elum City Council (hereinafter referred to as “City Council”).
WHEREAS, pursuant to RCW 27.12.280, the Board of Cle Elum Public Library
has the power to make available to Kittitas County residents living outside the city limits
of Cle Elum the materials of said Library, upon such terms and conditions as may be
agreed upon; and
WHEREAS, the County desires to contract for library services from the Cle Elum
Public Library, and the Board is granted the reciprocal power to contract to render such
services with the consent of the City Council; and
WHEREAS, the County desires to assist in providing library services from the
Cle Elum Public Library for County residents living outside the city limits of Cle Elum;
NOW THEREFORE, the parties hereto agree as follows:
1. Services. The usual public library services provided by the Cle Elum Public
Library will be provided to Kittitas County patrons who come to said Library to
use its facilities in accordance with the rules, regulations and operating policies
and procedures applicable at any given time. Assistance in registering for the
book borrowing service will be provided for anyone requesting that service when
said service is regularly available for registered patrons of the library so long as
the person making the request lives in Kittitas County.
2. Compensation. Kittitas County shall pay directly to the City the sum of
$23,000.00 as a subsidy to the City for Library services provided annually to
unincorporated County residents from January 1 through December 31. Payment
shall be made on a quarterly basis on the last day of January, April, July and
October of 2021.
3. Records. The following statistics shall be compiled and maintained by the Cle
Elum Public Library and reported to the Kittitas County Board of Commissioners
annually:
(a) Statistics on library materials circulation comparative to the previous
years’ circulation figures.
(b) Comparative statistics reflecting the services received by residents of
unincorporated Kittitas County to the total services provided by the
Library.
4. Amendments. Any amendment to this agreement shall be in writing and shall be
only as specifically authorized by the Kittitas County Board of County
Commissioners and the Cle Elum Board of Library Trustees as consented to by
the Cle Elum City Council.
5. Duration of Agreement. This agreement shall take effect January 1, 2021 and
shall continue in effect for a period of one year until December 31, 2021;
SUBJECT, HOWEVER, to the County’s right to cancel or terminate the
agreement, without penalty or obligation by the County for further payment, at
any time for any reason during said period on a prorated basis and to recover as
refund from the City of Cle Elum any prepayment made by the County for
remaining unused portions of the County’s quarterly payment, upon Thirty (30)
Days written notice by the County to the City of Cle Elum, sent certified mail,
return receipt requested.
