May20213version11KITTITASCOUNTYSHERIFFBysigningthisAgreementoractivatingaNumiPrepaidMastercard®cardonbehalfofanindividual,FacilityherebyacknowledgesandagreestocomplywithallthetermsandconditionscontainedinthisFacilityAgreement.PURPOSEistoensurethattheCardProgramisdistributedandadministeredinamannerthatcomplieswiththeFinancialRegulations.CapitalizedtermsusedbutnotdefinedhereinhavethemeaningsetforthinthesectionofthisAgreemententitled"Definitions".APPLICABILITYistoFacility,andallFacility'spersonnel,contractors,andagentsthatadministertheCardProgramfororonbehalfofFacility.THECARDPROGRAM.ByparticipationintheCardProgram,FacilitywillbeabletoreturninmatetrustfundsandotherpropertytopersonsreleasedfromincarcerationthroughtheuseofprepaidNetworkBrandedcards.ThisAgreementestablishestherequirementsandstandardsapplicabletoFacilityinparticipatingintheCardProgram.CARDHOLDERFEES.ThefeesassociatedwiththeCardProgram(s)coveredbythisAgreementareattachedasExhibitBandincorporatedhereinbyreference.FacilityacknowledgesthatithasselectedtheCardProgram(s)foritsconstituents.FacilityfurtheracknowledgesthatithasreviewedallofitsoptionsandalternativestotheCardProgramselectedandhaschosentheProgram(s)attachedheretoasExhibitB.CARDPROGRAMSUBSIDIES.AtanytimeaFacilitymayselectaCardProgramthatprovidesfortheFacilitycoveringalloraportionofthetotalcostoftheCardProgramsuchthattheCardholderfeesarereducedoreliminated.IntheeventthataFacilityselectssuchaCardProgram,thetermsofpaymenttoNumiforthesecostsareoutlinedinExhibitC,ifapplicable.MANDATORYCARDDISTRIBUTIONGUIDELINES&PROCEDURESOperatingGuidelines.NumiacceptsFacilityasanindependentdistributoroftheCardssubjecttothetermsandconditionsofthisAgreement.FacilitywillcomplywithapplicableFinancialRegulations,includingbutnotlimitedtoregulationssetforthbytheOfficeofForeignAssetsControl(OFAC).FacilitywillcooperatewithNumitotheextentnecessaryinordertoensurecontinuedcompliancewiththeFinancialRegulations.FacilityacknowledgesthatFinancialRegulationsaresubjecttochange,andshouldamaterialchangetotheseregulationsoccur,NumiwillnotifyFacilityofthatchangeandFacilitywillcomplywiththeFinancialRegulations,aschanged.CONFIDENTIALANDPROPRIETARYINFORMATION:ThecontentofthisdocumentcontainsProprietaryInformationandisnotreleasablewithouttheexpressconsentofNumiFinancial.Page1of11
