REQUEST TO APPROVE A RESOLUTION TO AWARD MASS X CONSTRUCTION THE BOWERS FIELD UTILITY EXTENSION CONTRACT Mark Cook gave background on the project and stated that Century West provided the contract plans and secured the building permit for this project. Mark Cook continued that this was a small works project and contractors listed on the MRSC Roster were solicited for bids. Mark Cook added that three (3) bids were received with Mass X Construction being the low bidder. Mark Cook stated that the bid amount is lower than the Engineer's Estimate, however, the contractor did contact staff with questions on the project. Vice -Chairman Laura Osiadacz inquired as to why the Public Works study session agenda was regarding all Bowers Field items. Mark Cook stated that the items on today's agenda were time sensitive and he still has the contracting authority for Bowers Field and additional training for staff needs to be completed. Chairman Brett Wachsmith made a motion to approve Resolution 2020-155 Awarding Mass X Construction the Bowers Field Utility Extension Contract. Vice -Chairman Laura Osiadacz seconded the motion. Motion passed 2-0. REQUEST TO APPROVE A RESOLUTION FOR THE BOWERS FIELD WSDOT CARB LOAN Benjamin West stated he had been working with Public Works on updating the Binding Site Plan and that he has received deposits for ten (10) lots. Benjamin West continued that with the update to the Binding Site Plan the taxi lanes need to be extended and there is additional funding through the WSDOT CARB Loan program available for this project. Vice -Chairman Laura Osiadacz inquired if the Airport budget can support the payments for the payback of the loan. Benjamin West replied that there was funding left from the previous WSDOT budget. Discussion was held. Chairman Brett Wachsmith made a 2020-09-28 MINUTES motion to approve Resolution 2020-156 approving the Bowers Field WSDOT CARB Loan. Mark Cook stated that the project team met to discuss the next steps for the wetland delineation and the mitigation strategy for Bowers Field. Mark Cook continued that there are two ways to move forward with the project; "preliminary jurisdictional determination" or "approved jurisdictional determination". Mark Cook added that the US Army Corp of Engineers (Corp) was scheduled to make a site visit last fall but then fell under a non -travel status and now with COVID-19 a site visit soon is unlikely. Mark Cook stated that waiting for the approved determination could take up to six (6) months and timelines for this project are tight. Mark Cook added that the project team feels in a better position now to move forward with a preliminary determination. Discussion was held. Staff was directed to move the item for discussion to the October 6th agenda session under Board Discussion and Decision so Commissioner Cory Wright to participate in the discussion. Kittitas County Regional Airport -Bowers Field 205 West 5`h Ave. Suite 105 n Ellensburg, WA 98926 eowee FlED 509-312-2017 9/24/2020 Dear Mr. Chenaur, Bowers Field is applying for the Aviation Revitalization Loan to extend our eastern hangar taxiway, allowing for development of five hangar lots and extending utilities to another seven hangar lots. We currently have high demand for hangar development and this loan will help us meet that need and bring in needed revenues for the airport. Here is a brief overview of our current situation. The Kittitas County Board of Commissioners (BOCC) and Airport Advisory Committee determined that, because of airport growth needs, it was instrumental to find a full-time Airport Manager and support staff. They also recently decided to create a new county airport department, removing jurisdiction from public works. This new department is managed by the Director of Airport Operations and Airport Coordinator. Bowers Field Airport has become a priority for county growth and development and therefore is working on a Strategic Business Plan Process. This will include a fee analysis and a market study to position Bowers Field as the leading Central Washington General Aviation Hub. Bowers Field is the closest eastern GA airport to Seattle, with the facilities and land to take on industrial business growth and small business jet traffic. Bowers Field has a 175 -acre Business/Industrial Park, 50 acres for Aeronautical Development, and an additional 800 acres of land available for future development. New operations at Bowers Field in 2020 include: AirPac Airlines which provides UPS cargo support and NetJets which provides unscheduled passenger service. The airport is currently developing 20 new lots for individual and corporate hangars. We have taken deposits to develop 17 new hangers. (Exhibit #1). Three of those are corporate lots that can house Cessna Citation size jet aircraft (see Exhibit 45 and 6). In the last year, one new corporate hangar and two general aviation hangars have been built (see Exhibit #2, #3 and 4). Additionally, the airport is adding a pilot lounge with restroom facilities in the next 45 days. This projected development and growth at Bowers Field is exciting and shows the interest in revitalizing this great asset. We appreciate all that Washington DOT Aviation Division does for our airports and look forward to working with you in 2021. Let me know if you have any questions and thank you for this opportunity through the Aviation Revitalization Loan program. Sincerely, Benjamin A. KITTITAS COUNTY DEPARTMENT OF PUBLIC WORKS PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS STUDY SESSION STAFF REPORT STUDY SESSION DATE: September 28, 2020 TOPIC: Wetland Delineation at Bowers Field ACTION REQUESTED: Direct Staff on Desired United States Army Corps of Engineers Wetland Delineation Process LEAD STAFF: Mark R. Cook RECOMMENDATION: Pursue a "Preliminary Jurisdictional Determination" with the Army Corps of Engineers (USACE) delineating wetland extend impacting the Bowers Field (ELN) capital improvement plan with the Federal Aviation Administration (FAA). BRIEFING SUMMARY: • Preliminary wetland delineation for ELN have been reduced from original extent. • Two options exist to formalize the delineation process with the USACE: "preliminary jurisdictional determination" or "approved jurisdictional determination". • Whiskey Creek's connection to the Yakima River will likely result in USACE taking jurisdiction of delineated wetlands, resulting in an "Individual Permit" process mitigating wetland impacts. • The approved jurisdictional determination option could delay the individual permit application submittal, and permit issuance, by six months. • Timelines are tight for environmental assessment National Environmental Policy Act (NEPA) finding from the FAA supporting parallel taxiway construction (EXHIBIT 1). • The Environmental Assessment (EA) team is seeking a NEPA finding from the FAA by January 2022. • While there are political advantages to waiting on an "Approved" determination from USACE, there is an associated adverse impact on the EA project timeline. BACKGROUND: Century West Engineering (CW) is working towards completing a sixty percent (60%) design of the parallel taxiway, runway 11/29 and flood improvements at ELN. The Board will recall that recently staff secured significant additional funding from the FAA supporting the design effort. Attempting to meet the tight timeline for ELN improvement construction, Public Works has embarked on a process seeking to create wetland mitigation credits ahead of taxiway construction in 2024. ESA (wetland consultant Page 1 of 4 PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT subcontractor to CW) recently re -delineated project wetlands reducing the estimated area of wetland impact from 8.3 acres to a current estimated impact of 2.6 acres. CW is currently developing project alternatives with the goal of reducing this area further, to the greatest extent possible while still meeting project objectives. DISCUSSION: The EA team has been waiting for months for a USACE site visit. This site visit would initiate the approved jurisdictional determination process. The pandemic and associated travel restrictions have not produced the desired site visit. It now appears that a site visit by the USACE is not likely until spring 2021. The EA team was hoping for an Approved Jurisdictional Determination eliminating the need for the team to make assumptions about USACE wetland jurisdiction. The value politically would be having the USACE make the call on EA wetlands, so that the team does not have to suppose jurisdiction. Local politics could define the EA team as being "overly" supportive of wetland delineation extent. Delays and travel restrictions upon USACE staff are creating the crisis we are now facing on project timeline. Given that Whiskey Creek flows to the Yakima, there is a high likelihood that the USACE will claim jurisdiction of the delineated wetlands. Assuming USACE jurisdiction and moving forward as "Preliminary Jurisdictional Determination" allows the team to keep moving towards applying for the individual permit and ultimate wetland mitigation. The EA team is concerned that waiting until spring of 2021 for a determination from the USACE, the entire project timeline will slide by approximately six months. Missing our construction window for the taxiway, could result in funding being moved away from ELN and sent to another airport in the FAA region. FISCAL RAPACTS: Currently, $2,350,000 is programmed for wetland mitigation starting in 2022 and completing in 2023.
