BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />ORDINANCE NO. ______________ <br />AN ORDINANCE EXTENDING LOCAL CONTROL OVER <br />RURAL COUNTY SALES AND USE TAX FUNDS <br />Whereas:In 1998, Kittitas County approved Resolution No. 98-45, which allowed Kittitas County, pursuant to RCW 82.14.370, to take a credit of .08% against the State’s portion of the <br />sales and use tax, to finance local public facility projects in rural counties that serve economic development purposes and/or finance local personnel in economic development offices, <br />for a period of 25 years-expiring June 30, 2023; <br />Whereas:Kittitas County’s credit did not impose a new tax, but instead shifted control over a portion of the sales and use tax imposed by the State, from the State to Kittitas County; <br /> <br />Whereas:Substitute House Bill 1751, Chapter 511, Laws of 2009 amended RCW 82.14.370(4) to reset the start of the 25-year period during which rural counties may take a credit, to the <br />date the county increased its credit from .08% to .09%; <br />Whereas:On July 30, 2007, Kittitas County adopted Ordinance No. 2007-23, which increased Kittitas County’s credit from .08% to .09%; <br />Whereas:Because of the amendment to RCW 82.14.370(4), Kittitas County is authorized to extend the period in which it receives this credit, from June 30, 2023 to July 30, 2032; <br />Whereas:Extending the duration of Kittitas County’s credit is not a new tax, nor is it extending a tax; <br />Whereas:If Kittitas County does not extend the duration of its credit, this would not result in a decrease in the total tax rate, but would instead mean the State would control all future <br />sales and use tax revenue; <br />Whereas:Kittitas County uses its credit to fund local projects that benefit Kittitas County by encouraging further economic development of Kittitas County; <br />NOW, THEREFORE, BE IT ORDAINED,the Board of Kittitas County Commissioners will extend the imposition of its credit of .09% against theState’s sales and use tax to July 30, 2032, so that <br />Kittitas County can continue to fund local economic development projects; <br />BE IT ALSO ORDAINED, Kittitas County Code Section 3.05.060 shall be amended to reflect thisextension, and shall read, in pertinent part, (additions to this text are shown by underline <br />and deletions by strikeout; the rest of chapter 3.05 shall remain in full force and effect) as follows: <br />3.05.060.Effective Date and Expiration Date.The tax imposed by KCC 3.05.010 shall take effect August 1, 2007 and shall expire June 30, 2023July 30, 2032. <br />BE IT ALSO ORDAINED, the Information Technology Department is charged with incorporating and updating the amendment authorized herein on the Kittitas County web page. <br />BE IT FURTHER ORDAINED, the Prosecuting Attorney’s Office is charged with correcting any scrivener’s errors arising out of the amendment process. No further authorization will be needed <br />from the Kittitas County Board of Commissioners for the Prosecuting Attorney’s Office to effect correction of scrivener’s errors relating to this Ordinance.
