ACTION REQUESTED: Approve Resolution to Execute a Revised Interlocal for
CARES Funding Allocation and Execute Revised
Interlocal. Rescind Original Interlocal.
BACKGROUND: In order to apply for the variance to enter phase 2 of the
reopen Washington Plan, Kittitas County was required to
submit a plan detailing our capabilities regarding testing,
quarantine and isolation, case investigation and contract
tracing, data management, tracking, and other related
tasks, which all require funding. Public health reached out
to the local municipalities seeking funding contributions to
share in the required expenses that impact the entire county.
The other municipalities understood the need and request
and gave assurances to provide 25% of their CARES
allocation from the state as provided in the attached
interlocal. After the BOCC executed the Interlocal as
described, the Washington State Department of Commerce
issued new requirements effecting such agreements. As
such, the Interlocal had to be amended to incorporate the
new regulations which included creating subcontracts
between the Cities and the County for the pass-through
funding. The revised interlocal and the subcontract was
developed cooperatively with the City of Ellensburg
attorney, Terry Weiner.
Requirements for CARES Act Funding, include each local
government entering Interagency agreements with the
Washington State Dept. of Commerce (DOC) for
Coronavirus Relief funds. A pass-through of those funds
from the receiving agency to another agency requires an
interlocal agreement detailing the terms as well as a
subcontract authorizing the transfer of the funds. The
interlocal between the municipalities expressly authorizes
the execution of the subcontracts upon approval of each
party’s legislative body.
INTERACTION: The Prosecutor’s office was directed to draft the attached
resolution, revised interlocal
RECOMMENDATION: Approved the attached resolution and execute the attached
interlocal that is revised.
