Regular Meeting
MONDAY 1:30 PM FEBRUARY 25. 2019
Board members present: Chairman Cory Wright; Vice Chairman Brett
Wachsmith; Commissioner Laura Osiadacz
Others: Mark Cook, Candie Leader, Public Works; Dan Carlson, Calvana
Carper, Lindsey Ozbolt, Pat Nicholson, Community Development Services
At 1:43 pm Chairman Cory Wright opened the Public Works Study Session.
DRIVEWAYS) AND THE ADOPTED INTERNATIONAL FIRE CODE DISCUSSION
Mark Cook stated at a previous study session he explained the issue
staff is facing with apparent conflicting requirements for driveways
between Kittitas County Code and the adopted International Fire Code.
Mark Cook continued that he is bringing the issue back for the full
Board of County Commissioners to direct staff on how to proceed. Mark
Cook added that recently himself, Dan Carlson with Community
Development Services and also Pat Nicholson, Fire Marshal, met to find
a solution for the discrepancy between the codes. Mark Cook stated
that they are proposing to add a clear zone requirement to driveway
permits so the total width of a driveway would be sixteen (16) feet
and require an additional two (2) feet on either side of the driveway
for the clear zone to allow fire apparatus enough room to access in
case of an emergency. Discussion was held. Staff was directed to
implement the change now on driveway permits and submit documentation
for code amendments in the summer.
2019 ROAD WEIGHT RESTRICTIONS
Mark Cook gave background on previous business practice by the
Department placing weight restrictions on county gravel roads due to
becoming saturated with moisture during thawing conditions causing
roadway damage from heavier vehicle traffic. Mark Cook stated that
the previous business practice was not functional and is requesting to
prepare enabling documentation for Board of County Commissioner
approval to defer to Public Works to handle the posting and noticing
of weight restrictions when the issue arises. Mark Cook added that
this would allow staff to post and notice on short timelines and would
not require waiting for BOCC sessions for approval on specific roads.
Discussion was held. Staff was directed to prepare enabling
documentation for BOCC consideration at future agenda session.
2019-02-25 MINUTES
HARTMAN ROAD VACATION REQUEST
Mark Cook stated that recently property owners on Micheletto Road have
placed a gate at the end causing issues for county staff to maintain
the roadway. Mark Cook continued that he previously discussed with
the BOCC doing a road vacation for the roadway and staff is moving
forward with the process. Mark Cook added that property owners on
Hartman Road sent a letter requesting the vacation of that roadway as
well. Mark Cook stated that there are only two (2) property owners on
Hartman Road and the roadway is not used as an access for recreational
use. Mark Cook commented that staff is looking for direction to move
the two (2) vacation requests forward for BOCC consideration.
Discussion was held. Staff was directed to set public hearings for
the vacation requests for BOCC consideration.
OTHER BUSINESS
MANASTASH ROAD BRIDGE REPLACEMENT PROJECT UPDATE
Mark Cook stated that the project team along with the Contractor met
regarding an ice jam above the temporary bridge that formed recently.
Mark Cook continued that the Contractor was able to get the temporary
bridge removed to avoid potential flooding.
MIKE BARROW
Chairman Cory Wright stated that he received a phone call from
Representative Tom Dent regarding Mike Barrow. Chairman Cory Wright
continued that Representative Dent was concerned that Mr. Barrow is
representing himself as a Lobbyist for Kittitas County and issues at
Bowers Field. Chairman Cory Wright asked the Board if they were
willing to agree to having Chairman Cory Wright set up a meeting with
Mr. Barrow and Mark Cook to discuss concerns. vice -Chairman Brett
Wachsmith and Commissioner Laura Osiadacz both agreed to the meeting.
Meeting adjourned at 2:05 pm.

DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
STUDY SESSION DATE: February 25, 2019
TOPIC: Driveways and the Adopted International Fire Code
ACTION REQUESTED: Support Staff's Recommendation
LEAD STAFF:
Mark R. Cook
RECOMMENDATION:
Direct that Public Works (PW) add language to KCC 12.04.080, Table 4.4 footnote #6
and Community Development Services (CDS) add the same language to KCC 20.02.030.
BRIEFING SUMMARY:
• Adoption of the International Fire Code creates an apparent conflict in County
Code at two separate locations dealing with driveways in Kinitas County
• Adding clarification language to KCC 12.04.080 (Table 4.4) and to KCC
20.02.030 to state that an additional two foot clear zone on each side of the
driveway is required.
KCC currently requires sixteen (16) foot wide driveways in excess of 150 foot in
length. The fire code states 20 feet of unobstructed width. Adding the clear zone
requirement provides consistency between all code references.
BACKGROUND:
Recently, staff briefed the Board of County Commissioners (BOCC) on apparent
conflicts in county code (Fire Code and Driveways). PW staff was directed to consult
with CDS and the Fire Marshall, returning to the BOCC with a proposed course of action.
DISCUSSION:
PW, CDS and the FM all agree the solution is relatively simple, add clarification
language to two parts of County Code bringing them into consistency with fire code
language. There is no reason to drop the twelve (12) foot driveway width for driveways
under 150 foot in length as these are within the allowed fire hose lay length in fire code.
One quick solution is to have PW add the clarification language to its access permit
application and follow on with a code amendment adding the clarification with KCC
20.02.030. Staff believes the BOCC can take action on the PW permit ahead of the code
amendment, because the adding the clear zone allows for.compliance with both the
International Fire Code and the applicable sections of Kittitas County Code.

• The BOCC has authority (Revised Code of Washington 36.75.270) to impose weight
restrictions on County roads
• Public Works (PW) implements weight restrictions during periods of thaw on gravel
roads subject to seasonal damage
• PW has confirmed with the Prosecuting Attorney's Office that the Department cannot
impose weight restrictions on select roadways on behalf of the BOCC
• PW proposes drafting enabling legislation imposing seasonal weight restrictions on
known problem roadways; directing PW to post roadways as appropriate given field
thaw conditions
BACKGROUND:
RCW 36.75.270 provides BOCC authority that cannot be transferred to PW. All gravel roads
in the County are subject to potential damage during winter thaw from heavy vehicle traffic.
Not all roads require restrictions given individual winter conditions throughout the County.
Weight restrictions require posting and publishing and can manifest themselves on short
timelines.
DISCUSSION:
Given restraints in state law, PW proposes having the BOCC authorize weight restrictions on
all gravel roads in the County prior to spring thaw. PW will monitor roadways and then
publish and post those reflecting concern ahead of damage from heavy vehicle traffic. PW
suggests having this proposal reviewed by the Board's attorney for compliance with state law
prior to bringing enabling legislation.
FISCAL IMPACTS:
The proposed activity is budgeted in PW road maintenance 2019 budget.

DEPARTMENT OF PUBLIC WORKS
PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
STUDY SESSION DATE: February 25, 2019
TOPIC: Hartman Road Vacation Request
ACTION REQUESTED: Schedule the Public Hearing Considering the Vacation of
Hartman Road
LEAD STAFF:
Mark R. Cook
RECOMMENDATION:
Direct staff docket a request for the Board to set a public hearing considering the vacation of
Hartman Road.
BRIEFING SUMMARY:
• Public Works (PW) recently received a request from Martha Wycoff requesting the
vacation of Hartman Road
• PW supports the vacation of Hartman Road
• PW advocates that no financial compensation be sought from the Wycoff s as road
maintenance cost savings more than offset any anticipated value received from the
vacation
BACKGROUND:
Hartman Road is a thirty (30) feet wide gravel surface— dead-end length roadway of 2,940
feet. Two owners (Section 20 LLC and Micheletto Road LLC) are impacted by the proposed
vacation — both support vacation. PW currently maintains Hartman Road, grading as
necessary maintaining a smooth driving surface.
DISCUSSION:
PW attempted vacation of Hartman Road in 1996. That effort failed due to lack of public
support. The road does not provide access to water or recreation land. Ownership issues
now allow for vacation and PW supports the vacation request.
FISCAL IMPACTS:
PW recommends that no financial compensation be sought by the County as eliminating
ongoing maintenance costs are expected to offset any revenue generated from the vacation
action.

RE: 1051 Hartman Rd. Cie Elum, WA 98922
Dear Director Cook,
FEB 072019
I-
')EPTnY" rp it t It^?r.(nPj'>:
We understand that the County from time to time evaluates its road system and whether
certain roads should be vacated and abandoned because of non-use.
We would ask that the County consider whether it should abandon Hartman Road because of
non-use, and what we and our neighbors (Micheletto Road LLC), the only owners of land
bordering Hartman Road and only users of Hartman Road, may do to cause such vacation.
Hartman Road is a dead-end road off of Swauk Prairie Road that separates the southern
portions of Sections 20 and 21. Hartman Road provides road access to only one residence, a
residence owned by Section 20 LLC.
Section 20 LLC and Micheletto Road LLC own all of the land bordering Hartman Road, with
Section 20 LLC owning nearly all of the land in the western portion of Section 21 and the
eastern portion of Section 20 (all the way to Section 16 and 17) and Micheletto Road LLC
owning a much smaller portion along the southwest corner of Section 21. We and Micheletto
Road LLC support the vacation and abandonment of Hartman Road, and are willing to
assume responsibility for the road should it become private due to vacation and abandonment
by the County.
Let us know what we may do to move this along. Feel free to give me a call if you have any
questions or desire more information.
Sincerely,iger,
Martha Wyckoff, MaS t 20 LLC
