During routine bridge inspection this past year significant damage was found at the near shore abutment. Public Works immediately launched into a design effort targeting bridge replacement in 2019. Environmental permitting timelines and the recent shut down of key government resource agencies imperils project delivery in 2019. Procuring the bridge ahead of awarding project construction is essential to maintaining delivery viability in 2019. Public Works is requesting to solicit for bridge suppliers attempting to obtain delivery by early summer 2019. Providing environmental permitting does not experience any further delays, procuring the bridge now appears to offer the best chance of 2019 project delivery. Public Works will be replacing the damaged bridge with Title 1 Funding and the sixteen (16) foot bridge width is consistent with current road standards. Public Works anticipates spending approximately $140,000 in bridge procurement. BRIEFING SUMMARY: • Public Works has been working on a Whiskey/Mercer Creek floodplain model for the past two years • Following a three month delay allowing the City of Ellensburg to hire a third party review of the model, the City accepted modeling results in early December 2018 • Shortly thereafter, two local land developers met with PW staff on numerous occasions discussing modeling results • Both developers suggested additional data would likely be beneficial to the effort • PW agreed and has been gathering cost data supporting a more detailed modeling effort in the northern most portions of Ellensburg • Recently, PW received a letter from the City withdrawing their support for the mapping effort BACKGROUND: PW proposed submitting a new flood model for Whiskey and Mercer Creeks in late summer 2018. After briefing City of Ellensburg staff, the City requested that they hire their own mapping expert for a third party review. PW agreed to allow sufficient time for the process to play out. In late November, the City's consultant recommended "concurrence" with the County's mapping effort and the City responded with a letter of concurrence (EXHIBIT 1). In mid December 2018, two local land developers contacted PW expressing their concern for the new model results. PW agreed to pursue a scope of work and fee estimate for updating the model LiDAR data set. Both developers expressed their desire lobbying City decision -makers against map adoption. DISCUSSION: In a letter from the City dated 02/05/19; Community Development Director Sackett requests that the County withdraw the signed concurrence letter from December 2018 Page 1 of 5 PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT (EXHIBIT 2). It appears that lobbying efforts from local developers are successful in prompting this City action. PW will have final cost estimates for increased LiDAR accuracy during the second full week in February. Given the recent letter from the City, it is likely the City will decline cost sharing the effort. There is little value to the County to conduct the effort on our own. Following a declination from the City to cost share, PW will give direction to our modeling consultant to submit the model to FEMA for final review — with no further investment. Failure on the part of the City will likely be met with dissatisfaction from FEMA's Cooperative Technical Partnership program. It is unknown at this time what options exist for the County adopting model results in rural Kittitas County and within the Urban Growth Boundary of the City of Ellensburg. Given that our current modeling effort (Reecer Creek) is intended to support pending floodplain actions in the City of Ellensburg. PW will conference with our CTP grant officer and determine what options exist for abandoning the Reecer Creek modeling effort and re -tasking remaining grant fiends to Crystal Creek in the Cle Elum/Roslyn area. Given the recent action by the City, is unlikely that any further modeling in the Ellensburg basin impacting City floodplains will be met with favorable results in model adoption. PW proposes shifting our modeling efforts away from the Ellensburg area and focus on rural Kittitas County. FISCAL IMPACTS: To date, $120,083.58 has been invested on model creation (grant plus consultant fees). Ruby Street Ellensburg, WA 98926 Dear Mark and Karen REFERENCE: Whiskey and Mercer Creek LOMR Submittal Materials A copy of the above -referenced materials have been received by the City of Ellensburg and reviewed by Staff from the City's Community Development and Public Works & Utilities Departments. We understand that the County is seeking a coordinated County -City response to FEMA in order to make the LOMR request which would alter the existing (1981) FIRM maps. We appreciate the County's desire to provide accurate flood mapping, as we also encounter areas of inaccuracy when utilizing the outdated 1981 maps. However, upon review of the proposed LOMR materials, City staff feel that there may be areas that are not represented accurately, and we would appreciate the opportunity to conduct a peer review of the materials prior to signing off on the FEMA Overview and Concurrence form. We will be in touch in the very near future to discuss a timeline for moving forward, after we have made arrangements for the peer review to be completed. At that point we would very much appreciate having a joint meeting to discuss the outcomes of the peer review, and to discuss any issues or discrepancies that may arise. In this way, the City hopes to develop and submit a coordinated request to FEMA that is in the best interest of the community members within both incorporated and unincorporated areas of the County. Ruby Street Ellensburg, WA 98926 Dear Mr. Cook REFERENCE: Whiskey and Mercer Creek LOMR Submittal Materials The purpose of this letter is two -fold. The first purpose is to respectfully and formally withdraw the previously -signed concurrence form for the proposed Whiskey/Mercer Creek LOMB. The signed form was emalled to Karen Hodges and Chris Frei of Watershed Science on December 3, 2018. However, the December 4, 2018 response received from Mr. Frei, as the County's contractor, indicated that his firm would be making some updates to the LOMR application, and that an updated acknowledgment form would also be forwarded to the City for a signature. A copy of that email exchange is attached. Since that December 2018 correspondence, the City has not received any updates from County Staff, or from Watershed Science. However, after further review of the LOMR submittal and accompanying scientific methodology, as stated above, the City is withdrawing its concurrence. City Staff would ask that the previously -signed form NOT be included in any future submittals to FEMA. The second purpose of this letter is to advise the County that the City will not be signing a concurrence form for inclusion in the application to FEMA even if updates are made to the LOMR submittal. We wanted to make you aware of this decision, as it may impact any County decisions to expend additional funds to obtain updated LIDAR imagery. While the City has the same desire to provide accurate flood mapping for our residents, we would respectfully point out that our valley is located in an alluvial fan, and that the irrigation systems located north of town greatly impact the direction and flow of any flooding that may or may not occur to the south. These impacts affect properties within both the City limits and the County. The City would prefer to work with the County in devising a means for improved monitoring of the irrigation activities occurring north of town, and/or developing any other appropriate solutions to the flooding, prior to submitting any changes to FEMA. When a property is added into FEMA's FIRM maps, it is at great expense to the affected property owners who then have to obtain flood insurance. If this LOMR is adopted by FEMA in its present state, 1298 parcels within the City and the Urban Growth Area (UGA) would be negatively impacted by this flood map. The City has also calculated that another 130 properties located outside the UGA would also be impacted. This is not a matter to be taken lightly, and as such, the City would want to be very certain that any updates to the flood maps are as accurate as possible, prior to agreeing to any kind of LOMR submittal to FEMA. Febwary 6, 2019 MeroeriW iiskey LOMR Response to County Poge 2 of 2 The City would appreciate receiving an acknowledgement that the concurrence form signed on December 3, 2018 will be discarded.
