NOVEMBER 6, 2018 Board members present: Chairman Laura Osiadacz; Vice-Chairman Obie O’Brien; and Commissioner Cory Wright. Others: Julie Kjorsvik, Clerk of the Board; Dan Carlson, CDS Director; Mark Cook, Public Works Director/Interim Engineer; Mike Folk, Building Inspector; Neil Caulkins, Deputy Prosecutor and 4 members of the public. CALL TO ORDER Chairman Osiadacz called the meeting to order. PLEDGE OF ALLEGIANCE Chairman Osiadacz led the Pledge of Allegiance. INTRODUCTION OF NEW COUNTY EMPLOYEES Dan Carlson, CDS Director introduced Mike Folk as their new Building Inspector. PROCLAMATIONS PROCLAMATION FLOOD AWARENESS MONTH PUBLIC WORKS Commissioner O’Brien moved to approve a Proclamation Designating November as Flood Awareness Month in Kittitas County. Commissioner Wright seconded. Motion carried 3-0. AWARDS & RECOGNITIONS – NONE APPROVAL OF AGENDA Chairman Osiadacz announced Consent Item G had been removed from the Agenda. Commissioner O’Brien moved to approve the Agenda, as amended. Vice-Chairman O’Brien seconded. SET PUBLIC HEARING 2018 ANNUAL DOCKET CDS Approve Setting a Public Hearing to consider the 2018 Kittitas County Annual Docket Amendments to be held on December 4, 2018 at 6:00 p.m. at 205 West 5th Avenue, Room 109, Ellensburg, WA and to authorize the Clerk to publish said notice. SET PUBLIC HEARING CRITICAL AREAS REGULATIONS CDS Approve Setting a Public Hearing to consider updating the Critical Areas Regulations to be held on Tuesday December 10, 2018 at 6:00 p.m. at 205 West 5th Avenue Ellensburg, WA and to authorize the Clerk to publish said notice. REQUEST TO SET A JOINT PUBLIC HEARING BETWEEN THE BOARD OF COUNTY COMMISSIONERS AND THE BOARD OF HEALTH TO CONSIDER AMENDING THE 2018 KITTITAS COUNTY PUBLIC FEE SCHEDULE – ITEM REMOVED FROM THE AGENDA. RESOLUTION 2018-173 COMMUNITY RATING SYSTEM PUBLIC WORKS Approve Resolution No. 2018-173, to Ratify the Chair’s Signature on the Federal Emergency Management Agency Annual Community Rating System Report Documents. CALL FOR BIDS PETROLEUM & LUBRICANT PRODUCTS PUBLIC WORKS Approve a Notice of Call for Bids to Furnish Petroleum and Lubricant Products for the 2019 Calendar Year, to be accepted and opened at 2:00 p.m. on November 29, 2018 at the Kittitas County Public Works Department 411 North Ruby Street, Suite 1, Ellensburg, WA and to authorize the Clerk to publish said notice. RESOLUTION 2018-174 CONSERVATION DISTRICT PUBLIC WORKS Approve Resolution No. 2018-174, to Ratify the Public Works Director’s Signature on the Project Closeout Invoice with the Kittitas County Conservation District for Updating the 2018 County Wildfire Protection Plan. CORRESPONDENCE - NONE ADMINISTRATIVE MATTERS – NONE 11/06/2018 MINUTES 4 CITIZEN COMMENTS ON NON-AGENDA ITEMS - NONE BOARD DISCUSSION/DECISION ITEMS - NONE MISCELLANEOUS PRESENTATION GRASSROOTS SUMMIT COMMISSIONERS On behalf of the Japan-America Society of the State of Washington, Ms. Josephine Hoyne, Grassroots Summit Event Coordinator and Mr. Takeshi Murazawa, Senior Consul of the Consulate General of Japan in Seattle, thanked Kittitas County and the Sanda City Relations Committee for their involvement with the Grassroots Summit and local session which was held in September. The said it was a very successful event and would not have been possible without the assistance of the local sessions. EXECUTIVE SESSION At 10:19 a.m. Chairman Osiadacz announced the Board would recess into Executive Session for 10 minutes with Neil Caulkins, Deputy Prosecutor regarding to discuss with legal counsel representing the agency matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. Possible action was anticipated. At 10:29 a.m. the Board reconvened out of Executive Session. No action taken. At 10:29 a.m. Chairman Osiadacz announced the Board would recess back into Executive Session for 5 minutes to discuss with legal counsel representing the agency matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. Possible action was anticipated. At 10:34 a.m. the Board reconvened out of Executive Session. Direction was given to Staff to pursue an appeal of the Tuusso decision. At 10:37 a.m. Chairman Osiadacz announced the Board would recess into Executive Session with Mark Cook, Public Works Director/Interim Engineer for 5 minutes to evaluate the qualifications of an applicant for public employment or to review the performance of a public employee. However, subject to RCW 42.30.140 (4), discussion by a governing body of 11/06/2018 MINUTES 5 salaries, wages, and other conditions of employment to be generally applied within the agency shall occur in a meeting open to the public, and when a governing body elects to take final action hiring, setting the salary of an individual employee or class of employees, or discharging or disciplining an employee, that action shall be taken in a meeting open to the public. No action was anticipated. At 10:42 a.m. the Board reconvened out of Executive Session. No action was taken. At 10:43 a.m. Chairman Osiadacz announced the Board would recess into Executive Session with Mark Cook, Public Works Director/Interim Engineer for 10 minutes to consider the selection of a site or the acquisition of real estate by lease or purchase when public knowledge regarding such consideration would cause a likelihood of increased price. Possible action was anticipated. At 10:53 a.m. the Board reconvened out of Executive Session. The Board provided direction to Staff to follow the recommendation and go with the stated amount with no variables to allow for more security for citizens. Urban Eberhart, Kittitas County Reclamation District, announced the Kittitas County Public Works Department’s application for Flood Plain By Design application for work in the South of Ellensburg came in #2 out of a Statewide list which will provide for approximately 2 million dollars. He said it was a team approach and the Board should be proud of the Public Works Department’s application and said it was a great testament to the kind of projects that are here in the County along with a collaborative approach to solving resource problems.
