Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria, including adoption of the FIS report and FIRM, and the modifications made by this LOMB, are the minimum requirements for continued NFIP participation and do not supersede more stringent State/Commonwealth or local requirements to which the regulations apply. We provide the floodway designation to your community as a tool to regulate floodplain development. Therefore, the floodway revision we have described in this letter, while acceptable to us, must also be acceptable to your community and adopted by appropriate community action, as specified in Paragraph 60.3(d) of the NFIP regulations. COMMUNITY REMINDERS We based this determination on the I -percent -annual -chance discharges computed in the submitted hydrologic model. Future development of projects upstream could cause increased discharges, which could cause increased flood hazards. A comprehensive restudy of your community's flood hazards would consider the cumulative effects of development on discharges and could, therefore, indicate that greater flood hazards exist in this area. Your community must regulate all proposed floodplain development and ensure that permits required by Federal and/or State/Commonwealth law have been obtained. State/Commonwealth or community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction or may limit development in floodplain areas. Ifyour State/Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take precedence over the minimum NFIP requirements. We will not print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders, instead, the community will serve as a repository for the new data. We encourage you to disseminate the information in this LOMB by preparing a news release for publication in your community's newspaper that describes the revision and explains how your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit from the information. This determination is based on the flood data presently available. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria, including adoption of the FES report and FIRM, and the modifications made by this LOMB, are the minimum requirements for continued NFIP participation and do not supersede more stringent State/Commonwealth or local requirements to which the regulations apply. COMMUNITY REMINDERS We based this determination on the 1 -percent -annual -chance discharges computed in the submitted hydrologic model. State/Commonwealth or community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction or may limit development .in floodplain areas. If your State/Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take precedence over the minimum NFIP requirements. We will not print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data. This determination is based on the Rood data presently available. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NF1P criteria. Therefore, the floodway revision we have described in this letter, while acceptable to us, must also be acceptable to your community and adopted by appropriate community action, as specified in Paragraph 60.30) of the NFIP regulations. COMMUNITY REMINDERS We based this determination on the I -percent annual -chance discharges computed in the submitted hydrologic model. Future development ofprojects upstream could cause increased discharges, which could cause increased flood hazards. A comprehensive restudy of your community's flood hazards would consider the cumulative effects of development on discharges and could, therefore, indicate that greater flood hazards exist in. this area. Your community must regulate all proposed floodplain development and ensure that permits required by Federal and/or State/Commonwealth law have been obtained. State/Commonwealth or community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction or may limit development in floodplain areas, Ifyour State/Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take Precedence over the minimum NFIP requirements. We will not print and distribute this LOMB to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data. This determination Is based an the flood data presently available. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria, including adoption of the FIS report and FIRM, and the modifications made by this LOMR, are the minimum requirements for continued NFIP participation and do not supersede more stringent State/Commonwealth or local requirements to which the regulations apply. COMMUNITY REMINDERS We based this determination on the 1 -percent -annual -chance discharges computed in the submitted hydrologic model. State/Commonwealth or community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction or may limit development in; floodplain areas. This determinatlon is based on the flood data presently available. Cook RECOMMENDATION: Direct staff prepares RID enabling documents and return to schedule formation public hearing. BRIEFING SUMMARY: • Recent outreach to residents results in four stating NO; two affirming YES. • The four represent approximately six percent of the proposed district participants. • Staff suggest preparing enabling legislation and returning to the Board with a project schedule and list of action items. BACKGROUND: For the past several years, Public Works has been attempting to resolve long standing access issues associated with Weihl Road. During a July study session, the Board requested staff re -solicit potential district participants affirming their desire to move forward with district formulation. DISCUSSION: The project appears to have wide support from potential district participants. The formulation process requires noticing and scheduling a public hearing. Once the hearing is complete, the Board can reject formulation, amend the district boundaries, or choose to formulate the Road Improvement District as presented. FISCAL IMPACTS: The Board of County Commissioners is currently suggesting a Board contribution in the amount of $274,000 is appropriate. District participants will share project costs of $750,000 based on an equal benefit derived by each lot owner. Using an interest rate of 3% (three percent), 15 year cost recovery period and allocated project costs of $750,000 — the resulting cost per year per lot is estimated to be $740/year. To KITTITAS COUNTYT-+ July 30, 2018 Weihl Road Resident Dear Weihl Road Resident: ='XTTZTgB CO DEPARTMENT OF PUBLIC WORKS Mark R. Cook, PE Director For several years, Kittitas County Public Works has been working with area residents attempting to improve Weihl Road and bring it onto the public road system. We have completed engineering design and revised project costs. We have been discussing the potential forming a Road improvement District (RID) for constructing improvements. The Kittitas County Board of County Commissioners desires hearing from potentially impacted residents prior to proceeding with RID formulation actions. You may recall that we sent a letter to you in October, 2017 (attached). In that letter we proposed a cost structure that would require approximately $740 per year for each property owner over a 15 year cost recovery period. At that time, we received a majority of owner support for the project. Final engineering results in a project cost of approximately $874,000 — well above the previous cost estimate of $750,000. The Board of County Commissioners recently committed to holding the previously identified cost structure for benefitted property owners at the funding level identified in our October, 2017 letter. Maintaining that cost structure requires the Board to fund approximately $274,000 of project costs (approximately 30%). This contribution allows us to maintain the cost structure we presented in October, 2017. Please contact me (Mark R. Cook) at 509-962-7523 if you are opposed to the Board moving forward formulating the RID. We anticipate, in the absence of significant opposition, to scheduling RID formulating actions in late August/early September 2018. Sincerely, XZIZ64, Mark R. Cook, PE Director October 27, 2017 Weihl Road Resident RE: Proposed Road Improvement District Dear Resident: Kittitas County Department of Public Works notices you that the Board of County Commissioners has determined that it is in the interest of the County to initiate a Road Improvement District (RID) for Weihl Road in the near future. The Board is required by Washington State law to notice its intention to formulate the district by resolution. Following this notice, we will send a separate notice to all residents advising of the meeting time and date for passage of the resolution of intent to formulate. We will further explain the process in our next notice to residents. Public Works has completed an improvement design for Weihl Road and delivered a cost estimate to the Board of County Commissioners. We have also prepared a preliminary financial plan supporting improvement construction. Cost estimates are provided below for your consideration. Welhl Road Improvement District Financial Plan Total project cost $ 750,614.00 Board of County Commission contribution $ 150,000.00 Remaining improvement cost to residents $ 600,614.00 Proposed cost recovery period 15 years Assumed interest rate 3 percent Assessment basis Number of lots benefited Total number of lots benefited 66 Annual assessment per lot $ 740.09 Previously, residents responded with a petition requesting formulation of the RID using an estimated annual per lot assessment of $776 for a period of ten (10) years. Subsequently, the Prosecuting Attorney Office determined that the roadway requires dedication onto the public 411 N. Ruby St, Suite #1 TEL (509) 962-7523 Ellensburg, WA 913926 FAX (509) 962-7663 Dept. of Public Works Page 2 road system once improvements are completed. This decision has driven the project cost to the current estimated $750,614. Attempting to maintain previous costs to benefited residents, the Board of County Commission elects to contribute towards total project cost. The contribution lowers the resident share to $600,614. Maintaining a ten (10) year cost recovery period results in an annual lot cost of $1,035.75. Discussing the costs with several area residents suggests that the annual cost is too high. Extending the cost recovery period to fifteen (15) years affords a reduced annual payment of $740.09. We are anxious to hear the community's response to our financial proposal — prior to moving forward with Board of County Commission action.
