Mark Cook requested to add one item to the agenda under Other Business - MS4 Permit Update. Mark Cook presented a Resolution to Prohibit Federal Highway Administration Truck Classes Four (4) and Above on Fowler Creek Road (MP 8) to the end of Pasco Road from April 9, 2018 ending June 18, 2018. Mark Cook stated that due to rapid thawing the roadway is experiencing heaving in places and is at risk for sizable damage if the restrictions are not placed. Commissioner Jewell inquired as to the amount of residents on the road and if there will be any impacts to them and if notification letters will be sent. Mark Cook replied that a physical posting was to be done but not notification letters. Further discussion was held. Two (2) members of the public commented on the topic. Commissioner Jewell made a motion to approve Resolution 2018-062 to Prohibit Federal Highway Administration Class Four (4) and Above on Fowler Creek Road (MP 8) to the end of Pasco Road from April 9, 2018 to June 18, 2018 with the Resolution amended to read April 11, 2018 to allow sufficient notice to the residents in the area. Commissioner O'Brien seconded said motion. Motion carried 3-0. Further direction was given to staff to bring forward a draft process for discussion. 2018-04-09 MINUTES PROHIBITING HEAVY TRUCK TRAFFIC ANNUALLY ON CERTAIN COUNTY ROADS DISCUSSION Mark Cook gave background on previous discussions held regarding the increase in truck traffic and weekend traffic bypassing I90 by using county roads specifically in Upper County. Mark Cook continued that he drafted a Resolution for Board of County Commissioner review and sent the Resolution over for legal opinion. Mark Cook added that the Resolution does include the need of occasional travel on said roads for local deliveries if necessary. Discussion was held. Staff was directed to correct the typos, send a draft to the Washington State Department of Transportation and Washington State Patrol for review prior to submitting on the May 1st agenda for Board consideration. DISADVANTAGED BUSINESS ENTERPRISE POLICY FOR BOWERS FIELD Mark Cook stated that currently staff is working on grant applications for Bowers Field specifically the pavement break project. Mark Cook continued that in this process the Federal Aviation Administration (FAA) requires a current Disadvantaged Business Enterprise (DBE) policy for Bowers Field. Mark Cook added the current DBE policy needs to be updated to the new template provided by FAA and after initial review staff felt that legal review was appropriate before Board of County Commissioner approval. Discussion was held. No direction was given. BOARD OF COUNTY COMMISSIONERS RESPONSE TO AN OFFER TO TRADE REAL ESTATE Mark Cook stated that Kittitas County recently acquired real estate in Upper Kittitas County and has since received correspondence from a local resident proposing a potential land swap. Mark Cook continued that initial conversations with the Board of County Commissioners (BOCC) prompted a response rejecting the proposal and after receiving further correspondence asking the BOCC to reconsider, a site visit of the property was conducted by Mark Cook and Commissioner Osiadacz. Discussion was held regarding the condition of the property and three (3) easements that affect the property. Mark Cook presented a letter to the local resident declining the offer. Discussion was held. Commissioner O'Brien made a motion to approve the letter as written with Commissioner Jewell seconding the motion. The Board expressed appreciation to staff for their work on this issue. Motion passed 3-0. 2018-04-09 MINUTES OTHER BUSINESS MS4 PERMIT UPDATE Mark Cook commented that at the last study session he provided background information on the MS4 stormwater permit from the Department of Ecology (DOE). Mark Cook continued that he had a meeting with DOE last Thursday and Kittitas County met only one (1) of the nominating criteria for the potential of being subjected to the permitting process. The final decision will be made by the local authority of DOE. Discussion was held. No direction was given. RECOMMENDATION: Direct that staff docket a resolution prohibiting heavy truck traffic (FH WA Class 9 and above) on Nelson Siding Road, Westside Road, Upper Peoh Point Road and Thorp Prairie Road annually from May 27'h to September 7th. BRH.IFING SUMMARY: • Heavy truck traffic avoiding 1-90 is damaging County roads • RCW 36.75.270 allows the Board of County Commissioners (BOCC) to restrict truck traffic A resolution is required to implement the desired restriction Staff has added a resolution clause recognizing the need to maintain local deliveries to area businesses BACKGROUND: During summer 2017, the 13000 and Public Works (PW) received numerous complaints from county residents regarding heavy truck traffic avoiding Interstate 90. Staff has been directed by the 13000 to prepare appropriate legislation restricting heavy truck traffic over Nelson Siding Road, Westside Road, Upper Peoh Point Road and "fhorp Prairie Road. DISCUSSION: Staff has revised a preliminary resolution (EXHIBfT 1) for BOCC consideration prohibiting heavy traffic over Nelson Siding Road, Westside Road, Upper Peoh Point Road anti "fhorp Prairie Road. The legislation seeks to prohibit all Federal Highway Administration trucks class 9 and above. This will allow dump trucks and concrete deliveries along with smaller panel trucks. The larger trucks are particularly troublesome Page I of3 PI1131,1('WORKS BOARD OF COON IN COMMISSIONERS WORK SESSION STAFF RITOR I during periods of i-90 closure and exacerbate traffic congestion. Restricting heavy truck traffic by resolution should allow GPS services to pick up on the restriction (publish in the paper of record). Publishing the restriction and signing the route carries a penalty of misdemeanor for all violators. The proposed resolution has been sent to the Prosecuting Attorney's office for evaluation. FISCAL. Mark R. Cook RECOMMENDATION: Support legal review of the current FAA DBE Policy for airport sponsors. BRIEFING SUMMARY: • Our current DBE is expiring • The new model DBE policy contains additions not previously reviewed by legal • 'the new model, along with the old model, have been sent to legal for review BACKGROUND: Our current FAA Disadvantaged Business F.uterprise (DBE) policy for Bowers Field is expiring. FAA is making available a new model policy that contains slight additions to the existing policy adopted by the Board of County Commissioners (BOCC). DISCUSSION: Staff has compared the new model policy with the current policy and has identified a handful of additions scattered throughout the document. While none appear to be overly onerous, staff believes legal should evaluate in the best interest of the BOCC. A copy of the current policy, and the new model policy, has been sent to legal for evaluation. We are being pressured by the FAA to adopt the new policy prior to grant award of the I?nvironmental Assessment (EA) for Bowers Field. In a related action, we are applying to WSDOT Aviation for a 15% grant match for the cost of the I:A expected is in the 5300.000 range. Cook RECOMMENDATION: Reject the offer to land swap Public Works real estate in Upper County, BRIEFING SUMMARY: • Mr. Doug Weis has proposed a land swap for Public Works six acres (*/-) along No. 5 Mine Road in Cie Flum • The Board of County Commissioners declined the offer • The Board subsequently agreed to meet onsite • The Board is now formally responding to the offer following the site visit BACK6ROI ND: In early February 2018, the Board of County Commissioners (BOCC) responded to an offer from Mr. Douglas Weis to trade twenty (20) acres of land near Public Works six (6) acres 1/- of land located along No. 5 !Mine Road in Cie Elum. The Board received a response from Mr. Weis dated February 15, 2018 (EXHIBIT 1). Following receipt of' that letter, the Board agreed that Commissioner Osiadacz and the Director of Public Works meet on site with representative of Mr. Weis touring the proposed land for land swap. DISCUSSION: On Friday, March 16, 2018 we met with representative of Mr. Weis touring the land proposed for land swap. Nearly all of the twenty acres are impacted by coal mine tailing. In addition, the only buildable area on the site is burdened by three separate easements across the parcel. Additional land beyond the proposed site creates significantly more cost in utility and road construction. At the conclusion of the meeting, we declared our non-interest in the proposed land swap. You mention that the BOCC is not interested in moving forward with our proposals as "presented": this leads me to believe that there might be interest in some form. If this is the case, we are open to discussions involving how a land swap may take form. We are willing to trade upward of 20 acres of current industrial zoned land for the 6 acres under Public Works ownership on Highway 903. We also need to be very clear that the 6 acres involved in the land swap will be donated for community use. At this point, we do not know what entity is in place for this donation but discussions with fellow citizens center on this location as a likely location for the Upper County/City of Cie Elum Pool Complex. This would be our hope. Many of my fellow upper county residents, including myself do not wish to see the county public works facility move onto this 6 -acre site bordering Highway 903. Likewise, in the long-term, we are hoping that any expansion of the existing county transfer station would be off of the Highway allowing for the conversion of this land into more suitable community uses but this provision is '.not" involved with this proposal. Recently, we worked with the State of Washington toward road improvements on Highway 903 and the County for improvements to Alliance Road in preparations for these road surfaces to service our industrial land. These road improvements include left hand turn lanes onto Alliance Road from 903 and improvements to Alliance Road. Additionally, we have installed an extension of a 12" water main from the City of Cie Elum to service the needs of properties north of Crystal Creek. We were somewhat shocked when we learned that County Public Works closed on Rural zoned land which will then be converted to industrial uses without reaching out to adjacent land owners that were zoned for this use. In recent research toward annexing our properties into the City of Cie Elum, it is noted that the City of Cie Elum's population has increased by 3 people since 2010. (Washington state oFM - April 2017 populations Projections). This is coupled with a net loss of 5 citizens over this time frame for Roslyn and South Cie Elum. These facts illustrate the importance of economic development within the upper county and providing for affordable commercial — industrial zones for new businesses to locate into. We are hopeful that with careful planning on a short and long-term basis with the City and County, existing businesses will have areas to expand into and new business will see the value of relocation. On our part, we do not view this proposed land swap as giving property away; rather as putting the building blocks in place for lands north of Crystal Creek to be put into profitable production. With that said, it is a blessing that we have the opportunity and, are in the position, to give back to the community that has been our home for 50 plus years. It is also a blessing that the community would be the recipient of such a gift. So, what can we do? Currently I know that public works is anxious to break ground in efforts to move their shop and yard. We do not wish to stop progress but also would like to see transparent and open discussions within the local community regarding how these lands will be put to future use. Highway 903 is transitioning from a vacant transportation corridor into main street between the Cities of Cle Elum and Roslyn. It is important that this valuable resource be carefully planned and considered for future uses which we question will be best served with County Industrial use. We ask that the BOCC reconsidered its position regarding this land swap and open discussion for how current County lands along 903 are to be used into the future. We also think it prudent for the County to allow for public input on how the community sees the build out of the 903 corridor. I look forward to your response and can be available to meet with you or county representatives after my return in early March.
