Huck (DPW); Dan Carlson, Stephanie Mifflin, Lindsey
Ozbolt (CDS)
WIEHL ROAD IMPROVEMENT DISTRICT UPDATE:
Luke stated that staff has been working for the last couple years on a road improvement district
for Wiehl Road residents. Originally, staff was working under the direction of formulating the
road as a private road at the onslaught of the improvements. Earlier this year after researching
the RCW's it was discovered that the road would have to be taken on system as a county road.
This resulted in a higher cost than anticipated. Staff went back and redesigned the road, came up
with additional costs, had further conversations with the Board about potential contributions
from the county to help alleviate some of the costs. Luke continued that Director Cook has been
looking into the formulation methods for establishing the district and informal conversations
have been had with the Prosecuting Attorney's office and is suggesting to the Board that more
formal conversations be held. Luke added that while he has not been completely involved in this
project he did spend some time this morning looking into the different methods of establishment
including reaching out MRSC and other counties. He found that are three avenues that can be
used to formulate the district. These include the petition process, by resolution and by ballot.
Discussion was held.
Board Direction:
Submit a request to the Prosecuting Attorney's office for support and schedule a special
meeting for discussion.
FLOOD CONTROL ZONE DISTRICT ADVISORY COMMITTEE UPDATE:
Luke stated that outreach has been done over the last six months with a total of eleven
applications being received with five from District 1, four from District 2 and two from District
3. It was pointed out that one application was placed in the incorrect district and will be
considered for the appropriate district. Commissioner Jewell inquired as if we are making
appointments today. Luke commented that Director Cook was looking for direction as to next
steps including continued outreach or accept what applications have been submitted for
consideration. Commissioner Jewell suggested that appointments be made at today's meeting.
Discussion was held.

Board Direction:
Commissioner Jewell nominated Scott Nicolai and Karen Poulsen for District 1.
Commissioner O'Brien made a motion to appoint Scott Nicolai and Karen Poulsen to the
Flood Control Zone District Advisory Committee representing District 1 with
Commissioner Osiadacz seconding the motion. Motion passed with no discussion.
Commissioner Osiadacz made a motion to appoint Jerry Martens, Patrick G. Deneen and
Holly English representing District 2 to the Flood Control Zone District Advisory
Committee. Commissioner O'Brien seconded the motion. Motion passed with no
discussion. And Commissioner O'Brien made a motion to appoint Jeff Dunning and Ryan
Lyyski representing District 3 to the Flood Control Zone District Advisory Committee.
Commissioner Osiadacz seconded the motion. Motion passed with no discussion. Staff was
directed to present a Resolution for consideration at the next agenda session.
OTHER BUSINESS:
PROJECT UPDATES:
Bar 14 Road Bridee:
Luke updated on the Bar 14 Road project stating that staff has received all permits and work is
going on today, installing the bypass for the stream. Some of this work will be done in
collaboration with Kittitas Reclamation District (KRD). Public Works permitted work is for 200
feet up and down the stream from the bridge. KRD's permitting is from their structure
downstream all the way up to where our 200 feet begins. Discussion was held.
Mercer Creek:
Luke reported that staff is about a week or two away from receiving the necessary permits to
start this project. We are working with the City of Ellensburg on this and are identifying who is
going to secure the equipment needed to do the project. The City of Ellensburg has volunteered
to complete some of the brushing that is needed since they have boom trucks and the necessary
staff that is familiar with this type of work. Discussion was held.
Teanawav Bridge Rail:
Luke stated that the Teanaway Bridge Rail project is completed and is now open to traffic. The
cost was around $115,000 and it looks like we will not get any cost recovery from the driver's
insurance company to reimburse for this project.

PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS
STUDY SESSION STAFF REPORT
STUDY SESSION DATE: :November 27, 2017
TOPIC: Wiehl Road Improvement District Update
AC'T'ION REQUESTED: Request the Prosecuting Attorney's Office to Brief the
Board on District Formulation
LEAD STAFF:
Mark R. Cook
RECOMMENDATION:
Request the Prosecuting Attorney's Office brief the Board of County Commissioners
(BOCC) on ,Road Improvement District Formulation pursuant to RCW 35.85.020
BREIFING SUMMARY:
• County road improvement district legislation is found at RCW 36.88
• RCW 36.88.065 allows the use of RCW 35.43
• Using RCW 35.82.020 avoids requiring an election
• Staff has received few comments from our October 27. 2017 letter
BACKGROUND:
For the past two years, the Public Works Department (PW) has been working with
residents in the Wiehl Road area towards forming a road improvement district (RID).
Residents responded to a petition effort in early 2017 favorably (90%-1- ). The
Prosecuting Attorney's Office (PA) subsequently determined that any RID improvement
requires dedication onto the public road network following improvement construction.
PW redesigned the proposed Wiehl Road improvements and briefed the Board on cost
issues. The BOCC has previously committed to cost share (5150,000 and any cost over-
runs) and staff noticed all potential district residents by mail on October 27, 2017
(EXHIBIT 1). 1 o date, I have received one email and had one conversation regarding
our letter. The email is attached as EXHIBIT 2. The phone conversation (11-20-2017)
informed me of opposition from one proposed district resident.
Proponents for RID forniulation are anxious to move forward with the process.
DISCISSION:
PW believes it is time for the BOCC to receive legal advice from the PA's Office.
Specifically, PW desires the BOCC understand RID formulation process (resolution) and
render an opinion on the proposed district cost recovery model based on the number of

lots served. Additionally, PW desires that the PA inform the [OCC on the use ofRCW
35.43 as a potential formulating vehicle avoiding an election.
PIS_CAI, IMP_AC:rS:
The BOCC has offered to cover S 150,000 of RID construction via the Road Fund.

Weihl Road Resident
RE: Proposed Road Improvement District
Dear Resident:
Kinitas County Department of Public Works notices you that the Board of County
Commissioners has determined that it is in the interest of the County to initiate a Road
Improvement .District (RID) for Weihl Road in the near future. The Board is required by
Washington State law to notice its intention to formulate the district by resolution. Following
this notice, we will send a separate notice to all residents advising of the meeting time and date
for passage of the resolution of intent to formulate. We will further explain the process in our
next notice to residents. Public Works has completed an improvement design for Weihl Road
and delivered a cost estimate to the Board of County Commissioners. We have also prepared a
preliminary financial plan supporting improvement construction. Cost estimates are provided
below for your consideration.
Weihl Road Improvement District Financial Plan
Total project cost
$
750,614.00
Board of County Commission contribution
$
150,000.00
Remaining improvement cost to residents
$
600,614.00
Proposed cost recovery period
15 years
Assumed interest rate
3 percent
Assessment basis
Number of lots benefited
Total number of lots benefited

Annual assessment per lot
$
740.09
Previously, residents responded with a petition requesting formulation of the RID using an
estimated annual per lot assessment of $776 for a period of ten (10) years. Subsequently; the
Prosecuting Attorney Office determined that the roadway requires dedication onto the public

road system once improvements are completed. This decision has driven the project cost to the
current estimated $750,614. Attempting to maintain previous costs to benefited residents, the
Board of County Commission elects to contribute towards total project cost. The contribution
lowers the resident share to $600,614. Maintaining a ten (10) year cost recovery period results in
an annual lot cost of $1,035.75. Discussing the costs with several area residents suggests that the
annual cost is too high. Extending the cost recovery period to fifteen (15) years affords a reduced
annual payment of $740.09.
We are anxious to hear the community's response to our financial proposal — prior to moving
forward with Board of County Commission action. You may call me at: 509-962-7523 or send a
response to 411 North Ruby, Suite I ; Ellensburg, WA 98926. You may also email a response

Subject: Feedback - Proposed Road Improvement District - Weihl Road
I received your letter of Oct 27,2017. 1 read it thoroughly. I attended the last meeting as well at the
Grange. I'm in favor of the project.
I manage 3 lots in the proposed area -a 13 acre with 2 houses on it, 11.75, and a 6.0 acre (the latter two owned
by my mother).
I want to tell you how very much I appreciate your experienced skill and effort in working on a difficult
complicated project with the Wiehl road residents through the handful of dedicated representatives. Thank you
for all the direction you've taken on this issue of safety for residents.
Thanks,
Jack Talley
