RESOLUTION
NO. 2015 - 116
DECLARATION OF EMERGENCY — Ryegrass Septage Lagoon
WHEREAS: Kittitas County Solid Waste, during the process of cleaning and testing the Ryegrass
Septage lagoons has found a liner failure in one of the lagoons; and
WHEREAS: The Kittitas County Solid Waste Department notified the Department of Ecology of this
failure; and
WHEREAS: The Department of Ecology has allowed the Kittitas County Solid Waste Department to
temporarily make an otherwise non -conforming use of the remaining lagoon capacity
until repairs can be made; and
WHEREAS: The non -conforming use is not consistent with sound waste water treatment practice; and
WHEREAS: The Kittitas County Solid Waste Department has requested approval to repair the lagoon
using the original engineering design; and
WHEREAS: Approval to use the original design has been denied since WAC 173-308 and WAC 173-
304 has changed since the design was done and updated engineered documentation would
be required before repairs could be made; and
WHEREAS: Kittitas County is experiencing and upturn in the sale of homes which in turn is resulting
in an increased volume of septage being received at the facility; and
WHEREAS: Our remaining lagoon is being pushed to its capacity; and
WHEREAS: without proper capacity this will result in a community health hazard; and
WHEREAS: a design engineer or associate who did the review and approval of the original plans
would be able to conduct that process in the most rapid manner of the options available to
the Kittitas County Solid Waste Department; and
WHEREAS: The period of time during which weather conditions are likely to be favorable for the
repair process is limited and time is thus of the essence; and
WHEREAS: the time urgency renders the bidding process unusable; and
WHEREAS: declaring a State of Emergency, by which the Solid Waste Department is able to both
directly contact the original design engineer for review and approval of the plans, and
then contract directly with that company capable of making the repairs as quickly as
possible, is necessary for the preservation of public health in a manner consistent with the
time urgency of this repair project. Justification falls under RCW 36.40.180 – Immediate
preservation of public health and RCW 36.32.270 and RCW 39.04.280 which allow for
competitive bids to be waived in the event of the emergency.
RESOLVED: That it is hereby declared that there is an emergency due to the urgent
need to make these repairs, and that the Solid Waste Department and Commissioners are
authorized to enter into contracts and incur obligations necessary to combat such
emergency to protect the health and safety of the community and property.
