AUTHORIZATON AND ACKNOWLEDGEMENT ACKNOWLEDGED BY: AUTHORIZED BY: ESA 5309 Shilshole Avenue NNV Suite 200 Seattle, WA 98107 By: Name: Title: Date: Kittitas County Department of Public Works 411 North Ruby Street Suite 1 Ellensburg, WA 98926 By: Name: Title: Date: Attachments: Attachment "I" —Scope of Work Detail Attachment "2" — Cost of Services ESA - 5309 Shilshole Avenue NW, Ste. 200, Seattle, WA 98107 Task Order 02 Attachment 1 Page 1 of 4 Attachment 1— Scope of Work Detaif ESA understands that Kittitas County (County) proposes to replace four existing fish -bearing stream culverts under Teanaway Road. One of culverts (Mason Creek) will be replaced with a bridge, while the other three culverts (Story Creek, John Creek, and Musser Creels) will be replaced with wider, fish passable culverts. The project has received grant R nrl from the Federal Highway Administration (FHWA). The County has asked ESA to prepare permitting documents in support of the project. A detailed Scope of Work is provided below, which outlines ESA's responsibilities under this Task Order. Task 1– Project Management: This task includes on-going project management and client coordination. ESA will attend one on-site project coordination meeting, if requested by the County and/or permitting agencies. Deliverables: Monthly invoices and progress reports/work summaries. Task 2--Wedand/OHWM Delineation: ESA will delineate wetland boundaries (if present) and the Ordinary High Water Mark (OHWM) within 50 feet of the culverts to be replaced. We anticipate requiring one day of fieldwork to complete the delineations, which includes travel time to and from the project site. Wetlands will be delineated in accordance within the Regional Supplement to the U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual (Version 2.0): Arid West Region. The OHWM will be delineated in accordance with the guidelines provided in the Washington State Department of Ecology (Ecology) Publication # 08-06- 001: Determination the Ordinary High Water Mark on Streams in Washington State. OHWM and wetland boundaries will be marked with sequentially numbered pin flags and/or ribbon tape. Wetlands (ifpresent) will be rated using the Washington State Department of Ecology (Ecology) wetland rating system for Eastern Washington. Deliverables: Sketch map showing the location of all OHAIM and stream boundaries. Assumptions: a The County is responsible for providing a professional land survey of flagging locations. The County will make the necessary arrangements for ESA to access private properties, if required. A utility locate must be performed prior digging wetland sample plots. ESA will coordinate with Utility Notification Center to schedule the utility locate. ESA assumes that the project area can be readily accessed by the utility locators, and will not require meeting locators on-site. Task 3 ,DARPA (including HPA): ESA will prepare a Joint Aquatic Resources Permit Application (JARPA). The JARPA will serve as the permit application for a USACE—Clean Water Act (CWA) Section 404 permit, Washington Department of Fish and Wildlife (WDFW) Hydraulic Project Approval (HPA), and Ecology CWA Section 401 Water Quality Certification. ESA will prepare a draft JARPA for review by the County. After County review ESA will make one set of revisions and submit to the County and the applicable permitting agencies. Deliverables: County Draft (electronic) and. final DARPA (hard copy). Task Order 02 Attachment 1 Page 2 of 5 Assumptions: • The County will provide project design drawings and wetland and stream boundary information in electronic format (i.e. CAD). ESA will use the drawings to create the JARPA figures. • No project restoration design work is anticipated, and is not included in this task If requested, ESA will provide a task order supplement for restoration design assistance. • The County will provide a single set of consolidated review comments on the Draft DARPA. • We have assumed one revision of the DARPA, as specified above. Additional revisions may require a task order amendment. Task 4 — Endangered Species Act Coordination, ESA will prepare a Biological Assessment (BA) for the project. The BA will be prepared to support consultation efforts under Section 7 of the Endangered Species Act among the federal lead agency (FHWA) and the United States Fish and Wildlife Service (USFWS) and National Marine Fisheries Service (MHS). This task includes a visit to the project site, which will coincide with the wetland/OHWM delineation (see Task 2). This task also includes coordination with NfFS, USFWS, WDFW, and the Washington Department of Natural Resources (WDNR) as necessary to obtain habitat and species information. ESA will prepare a draft BA for review by the County. After County review ESA will make one set of revisions and submit a revised draft BA to to FH1WA's On -Line File Cabinet. After WSDOT/FHWA review, ESA will prepare a final BA to be submitted to USFWS and NMFS. Deliverables: County draft (electronic), revised draft (electronic), and final BA (Lard copy). Assumpttians: • This task does not include plant or animal surveys. • To minimize added cxpenditums resulting from plan changes, ESA recommends that the County provide ESA with project information containing as much detail as possible. • We have assumed two revisions of the BA, as specified above. Additional revisions may require a task order amendment. • Based upon a review of existing habitat information, ESA assumes that Endangered Special Act -listed species may be present within the proj ect area (e.g. Mid -Columbia FSU steeihead trout and northern spotted owl). Depending upon project design, construction methods, and construction timing, we assume that project "may affect, but is not likely to adversely affect" or "may affect, and likely to adversely affect" Endangered Species Act - listed species, and therefore a full BA would be required. • The County will provide a single set of consolidated review comments on the Draft BA. • ESA will adjust the BA as required within the limitations of the budget. Changes to the project or report requirements, particularly as a result of new species information or changes to listing status atter work has been initiated will required added services or additional revisions and may require a task order amendment. Task Order 02 Attachment 1 Page 3 of 5 Task 5 — National Historic Preservation Act; Section 1.06 Coordination: ESA will prepare correspondence for County signature to define the Area of Potential Effects (APE) and initiate Section 106 consultation for the project. The County will finalize the correspondence and submit it to WSDOT; WSDOT will send the correspondence to Consulting Parties which will begin a 30 -day comment period. ESA will conduct background research using Washington State Department of Historic Preservation (DAHP) database, other online sources, and our own archives to identify recorded and potential archaeological and historic resources in and around the project APE. ESA will also review available environmental and geological background information_ A preliminary review of the DAHP database indicates that cultural resources (a historic irrigation canal) may be present within the project APE. Once the 30 -day comment period has elapsed, ESA will conduct a surface and subsurface survey of the APE, outside of the paved road area. Subsurface survey will be conducted using up to 16 hand -dug shovel probes (4 probes at each culvert location) advanced to a range of depths; depth of probe will be relative to the soil type and the expected disturbance. Spoils will be screened through 1/4 inch mesh. Probe locations will be recorded using GPS. Prehistoric and historic artifacts (if encountered) will be described and photographed in the field, and returned to the find location; no artifacts will be collected. ESA will summarize the findings of our work in a Technical Report that meets WSDOT and State Historic Preservation Officer (SHPO) standards. The report will also include a Historic Property Inventory for the irrigation canal including a National Register eligibility recommendation. ESA will prepare a draft Cultural Resources Technical Report for review by the County. After County review ESA will submit a draft for review by WSDOT. After WSDOT review, ESA will incorporate comments and submit a revised dram for Consulting Party review; this will be a 30 day comment period. Following receipt of comments from Consulting Parties, ESA will prepare a final draft and submit hard copies to the County. The County will be responsible for sending the hard copies to WSDOT for their distribution. Deliverables: County Draft (electronic), WSDOT Draft (electronic), Consulting Party Draft (electronic), and final Cultural Resources Technical Report (hard copies and CD). Assurnotions WSDOT will lead all Section 106 consultation. • Field schedule is dependent on the County's submittal of APE correspondence to WSDOT; no field work can be conducted until the 30 -day comment period has elapsed. • The County will provide copies of any geotechnical report or logs for review, if available_ A utility locate must be performed prior to subsurface survey. ESA will coordinate with Utility Notification Center to schedule the utility locate. ESA assumes that the project area can be readily accessed by the utility locators, and will not require meeting locators on-site. • If cultural resources besides the historic irrigation canal are identified, documentation of the resources may require a task order amendment. • The County will provide a single set of consolidated review comments on the draft Technical Report. Task Order 02 Attachment I Page 4 of 5 • Archaeological construction monitoring is not included in this task if requested, ESA will provide a task order supplement for construction monitoring. Task 6— Wetland & Stream Report ESA will prepare a wetland and stream report which satisfies requirements for submittal to the USACE and 1{ittitas County Community Development Services. The report will include a detailed project description; description of the site; wetland size, classification and ratings (if wetlands are present); stream classification and ratings, regulatory implications, and an assessment of impacts to both streams and wetlands (if applicable). ESA will prepare a draft wetland and stream report for review by the County. After County review, ESA will provide a final report. Deliverables: County draft (electronic) and final wetland and stream report (hard copy)_ Assumptions: As the project involves replacement of fes -barrier culverts and that impacts to regulated wetlands are unlikely, it is assumed that no compensatory wetland or stream mitigation will be required. if mitigation work is required, ESA would be happy to provide a task order supplement if project design assistance is requested. • The County will provide a single set of consolidated review comments on the draft Wetland and Stream Report. Task 7 —NEPA Based upon our understanding of the proposed project, ESA assumes that the project will require an Environmental Classification Summary (ECS) Form. The ECS is the NEPA document that WSDOT uses for projects that are categorized as Documented Categorical Exclusions (DCEs)_ ESA shall prepare a WSDOT ECS Form, which will be completed per the guidance and requirements in WSDOT Local Agency Guidelines (LAG) Manual in effect at the time a notice to proceed is received by the project. ESA will complete the ECS form using information from the County and other supporting information. The BA, cultural resources technical memorandum, and wetland and stream reportwill be appended to the ECS form, as necessary. ESA will prepare a draft ECS form for review by the County. After County review, ESA will prepare a revised draft form for submittal to WSDOT. After WSDOTIFHWA review, ESA will prepare a final ECS form Deliverables: County draft (electronic), revised draft (electronic), and final ECS form (hard copy). Assumptions: • We assume that the project will qualify for a categorical exclusion under NEPA. If, during the preliminary design process it is determined that the environmental impacts are such that the project would not qualify for a categorical exclusion, an amendment to the scope of work may be required. • Based on the understanding and initial evaluation of the project area, it is assumed that separate technical memoranda will not be required for environmental justice, hazardous materials, Section 4(f)16(f) lands, visual resources, air quality, noise, air quality, or traffic. These topics will be covered within the WSDOT ECS forth, without separate documentation. If, during completion of the project design, it becomes apparent that Task Order 02 Attachment I Page 5 of 5 additional documenta#ion for one or more of these resource areas will be require, then a task order amendment may be required. We assume that the ECS form can be adopted by reference to fulfill the County's SEPA requirements (per WAC 197-11-610). If separate SEPA documentation is required (i.e. a SEPA checklist); a task order amendment may be required s The County will provide a single set of consolidated review comments on the draft ECS form. KITTITAS COUNTY DEPARTMENT OF PUBLIC WORKS PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT WORK SESSION DATE June 13, 2016 TOPIC FEMA CTP Agreement ACTION REQUESTED Affirm Staff's Grant Submittal Request for FEMA CTP Whiskey Creek Floodplain Modeling Project LEAD STAFF: Mark R. Cook RECOMMENDATION: Affirm staff's grant submittal to FEMA CTP Whiskey Creek Floodplain Modeling Project. BACKGROUND: Previously, staff has briefea tree Boara on FEMA's Cooperative Technical Partnership program. The Board may recall this program exists for local agencies to contract with FEMA for technical assistance re -mapping floodplain rate insurance maps. Earlier this year, we obtained commitment through this program supporting remapping activities for approximately seven miles of Currier Creek. Last month FEMA contacted our consultant (Watershed Science and Engineering) advising them that they would match our contribution ($60,000) towards Currier Creek and requested we select another system for match. We have selected Whiskey Creek and propose a similar modeling effort (seven or so miles of creek reach). The deadline for CTP grant submittal was 06-10-2016. Staff was able to put together the application and submitted it last Friday. DISCUSSION: Whiskey Creek flooding this spring underscores the need for additional evaluation of floodplain extent. The FEMA CTP grant moves us closer to validating new technologies that hold significant promise towards wide scale county deployment — remapping numerous miles of Digital Federal Insurance Rate Maps (DFIRMs). FISCAL IMPACTS: We anticipate a planning level cost estimate of approximately $60,000 supporting the mapping effort. It is anticipated that FEMA will make our contribution. The PTS QC process is nationally funded and required on each non -PTS study. In cooperation with the FEMA Project Officer, a Project Management Team (PMT) will be established by the CTP consisting of representatives from the CTP, FEMA's Regional Engineer, and other appropriate parties (e.g., FEMA contractors) at the discretion of FEMA. The PMT will be responsible for coordinating the activities identified in this MAS. The FEMA Region will be provided with documentation identifying the established PMT. The PMT will be identified within {insert number of days} days of the award. Responsible Mapping Partner: Kittitas County Public Works Scone: Project Management is the active process of planning, organizing, and managing resources toward the successful accomplishment of predefined project goals and objectives. The CTP will coordinate with the FEMA Regional Office with respect to Project Management activities and technical mapping activities. Changes to Scope of Work: Requests for changes to the scope of work (SOW) after award are permissible and must be supported by adequate justification from the Recipient in order to be processed. The justification is a description of the proposed change, a written explanation of the reason or reasons for the change; an outline of remaining funds available to support the change; and a full description of the work necessary to complete the activity. National FY16 Flood Risk Project MAS Template Version 1.0 Mapping Activity Statement No. {MASNo ) Earned Value Data Entry: The MIP Workflow is designed to track the Earned Value of Flood Project Management Risk Projects. This information is automatically calculated by the MIP, using the actual cost and schedule of work performed, or "actuals," and comparing them to the expected cost and schedule of work performed, or "baseline." Once the FEMA Regional Office has funded a project, FEMA or its contractor will complete the "Obligate Project Funds" screen in the MIP. This step establishes the baseline for the project in the MIP, using the cost and schedule information for each task as outlined in this document. The MIP study workflow allows FEMA and the CTP to manage the status of these projects at a task level. The cost and schedule information, updated monthly by the CTP for each contracted task, is compared to the baseline established for those tasks. This information is rolled up to a project level and monitored by the FEMA Region to assess progress and Earned Value. Earned Value data entry involves updating cost, schedule and performance (physical percent complete) in the MIP by the CTP each month for each assigned task. The CTP may contact the region to obtain the guidance document Risk MAP Products in the MIP, which explains how Flood Risk Products shall be submitted through the MIP. The guidance also explains how performance will be tracked for Flood Risk Products. Once the baseline has been established in the MIP, the CTP shall input the performance and actual cost to date for all tasks within each project for which the CTP is responsible. This must be completed at a minimum once every 30 days and at the completion of the task. When a task is completed, including all QA/QC activities in this MAS, plus the Quality Control Reviews required by FEMA standards, the CTP shall enter 100% complete, enter the actual completion cost, and the actual completion date within the Manage Data Development, Manage Preliminary Map Production, or Manage Post -Preliminary Processing tasks as applicable. The "Manage" tasks remain open and accept updates for up to 90 days after the completion of the last producer task in each module. The MIP shall also be populated with appropriate leverage information regarding who (CTP or community) paid for the data provided and the amount of data used by the FIood Risk Project. The CTP will maintain a Schedule Performance Index (SPI) and Cost Performance Index (CPT) of at least 0.92. Special Problem Reports (SPR) explaining any variance must be submitted in a timely manner as required. The CTP is required to report on the earned value of projects that are in the MIP on a monthly basis and must give explanations for variances outside of the tolerance defined above. FEMA Regional Offices must implement a Corrective Action Plan (CAP) when a CTP partner is outside of the tolerance. A CAP must define the reason for the variance and the intended resolution. FEMA Regional Offices must coordinate with FEMA Headquarters when CAPs are developed. As Program Management tasks are not conducted in the MIP, cost and schedule performance measures must be defined and documented in the MAS or scope of work statement. These measures must be used to monitor partner performance and to determine future funding eligibility. This exception only applies to tasks not able to be conducted or tracked in the MIP National FY16 Flood Risk Project MAS Template Version 1.0 Mapping Activity Statement No. (MASNo 1 6 The Project Officer, as needed, may request additional information on status of the project on an ad hoc basis. <Add additional details regarding the scope of this activity, as appropriate> Standards: All Project Management work shall be performed in accordance with the standards specified in Section 5 — Standards. <Add, modify or delete deliverables below, as necessary (e.g., an Integrated Baseline Review for the project as required by the Regional Office)> Deliverables: • Monthly Earned Value data reporting through the MIP with variance explanations to support management of technical mapping activities within specified time frame, for both Regulatory and Flood Risk Products. • Management of SPI/CPI performance for an organization. • Overall project QA/QC maintenance information, such as maintaining a QA/QC log and providing a QA/QC approach to FEMA for review and approval. • Management of adherence to scope of work and quality of work for an organization. Risks should be identified during the planning phase and monitored throughout the project, so that potential impact can be assessed and solution strategies developed and implemented as needed. <Add risk, impact and solution strategy information in this paragraph and the table below, as necessary, including an Integrated Baseline Review for the project as required by the Regional Office.> Table 1.3: Project Risk Identification National FY16 Flood Risk Project MAS Template Version 1.0 Mapping Activity Statement No. {MASNo } Perform Community Engagement and Project Outreach NOTE: The performance of community engagement and outreach takes place throughout the life of the flood risk project. Work with your Region to develop a Project Outreach and Communication Plan (POOP). An alternate tracking method is acceptable with approval from the FEMA Regional Office. Up to 10 percent of the total budget can be used for Community Engagement. An additional (up to) 10 percent of the total budget can be used for Project Outreach. The activities identified here are for project specific community engagement and outreach. The overarching CERC MAS can be used for broader program wide engagement activities. Responsible Mapping Partner: Kittitas County Public Works Scope: Community Engagement This task includes activities for the CTP to provide supplementary support to the Mapping Partner responsible for the Community Engagement activities funded through the Project Management MAS or other contracts. Community Engagement activities funded through this MAS shall not supplant or duplicate Community Engagement activities funded through other grants or contracts. There is a separate Statement of Work document used to document additional program wide Community Engagement and Risk Communication activities performed by CTPs. The activities listed below are intended to support on-going project efforts that foster working relationships between ffederal, state, tribal and local governments with private and public interests in order to reduce the impact of natural disasters where a community's interaction with a natural hazard may be altered or averted. These activities should be reviewed for implementation throughout the Risk MAP lifecycle, including the defined meetings within it. It is expected that including these approaches will assist in increased risk awareness and the development of actionable measures to reduce risk within the Flood Risk Project footprints. These activities should be implemented as directed by the Project Officer to: • Increase the understanding of natural hazard risk within a community. • Support local efforts to reduce natural hazard risk within a community or watershed area. • Increase the effectiveness of meetings and engagement opportunities with communities throughout the Risk MAP life cycle. Note: Community mitigation action cannot be purchased (meaning, mitigation projects cannot be purchased through a Risk MAP project); however, it can be influenced and advanced by proper project and communications planning throughout the Risk MAP process. Strategic communication planning can be assisted by the tools and tactics identified below. Watershed and Community Assessment. Activities include assessing a watershed and high priority communities to understand what is important to them, their mitigation priorities, and their existing National FY16 Flood Risk Project MAS Template Version 1.0 Mapping Activity Statement No. JMASNo 1 8 relationships with FEMA. May include holding telephone discussions with local officials and residents to understand the watershed and identify key stakeholders. Will include local planners, floodplain administrators (FPAs), elected officials, community leaders, local levee/dam/coastal leadership/business owners and others, based on local needs. Meetings This Flood Risk Project will include in-person opportunities to engage communities, build risk awareness, increase capabilities for risk communication, and stimulate mitigation action at the local level. The overarching goal is to create a climate of understanding and ownership of the mapping process at the state and local levels. Well-planned and executed community engagement and project outreach can reduce political stress, confrontation in the media, and public controversy, which can arise from lack of information, misunderstanding, or misinformation. These engagement and outreach activities also can assist the CTP, FEMA, and other members of the PMT in responding to congressional inquiries. The actual number of meetings will be determined based on the risk and need at the local level and determined as part of developing the project -based communication plan. Provisions may be made for remote access video/audio feeds for those that cannot attend in person. These opportunities consist of: {Remove meetings that will not be included/funded by this MAS} Final Consultation and Coordination Officer Meeting and Public Meeting (or Open House). If regulatory products are included in a Flood Risk Project, these meetings will provide local officials an opportunity to verify the appropriate revisions have been made to previously demonstrated information, take ownership of the products, and deliver the results of the project to the local citizenry. Activities include planning, presenting and facilitating discussions with community officials for awareness and acceptance of regulatory products. The purpose of the meeting will be review data inputs to a flood study, preview changes to preliminary FIRM data and maps, discuss newly identified flood risk and community actions to reduce risk, and provide information about the appeals period, map adoption, and insurance impacts. The CTP will support the local officials, or deliver the messages, at the Public Meeting if the local officials are unwilling. Also, communities will be encouraged to identify short- and long-term efforts to progress towards increasing flood risk awareness and management. These meetings can be held concurrently or separately at the region and community's discretion. For all meetings, provisions may be made for remote access video/audio feeds for those that cannot attend in person. Status Reports In addition to Risk MAP meetings, in order to facilitate information sharing and a continuing dialogue between the PMT and the community, the CTP will provide communities with regular status reports outlining the current project status, key accomplishments to date, identified risks, if any, and next steps including estimated next meeting date and meeting content (template to be provided from FEMA or can be created by Mapping Partner). These status reports will be provided to FEMA for review before electronic distribution. Project update status reports will be distributed to communities at mid -points between each of the meetings, and between the Final Meeting and effective date (if included in this VIAS), to help introduce and prepare the communities for upcoming discussions. National FY16 Flood Risk Project MAS Template Version 1.0 Mapping Activity Statement No. {MASNo } Project Outreach and Communication Pian The CTP will work with the Regional Office during the initiation of this activity to develop the POCP to support the implementation of the mapping project. The Regional Office will have access to many customizable outreach tools that have been developed for this process to support each touchpoint that the PMT has with the community. Standards: All Community Engagement and Outreach work shall be performed in accordance with the standards specified in Section 5 — Standards. Cook RECOMMENDATION: Support staff negotiating an alternate project with FEMA settling Ringer Loop November flood damage claim. BACKGROUND: The November 2015 flooding event resulted in significant damage to Ringer Loop Road. Immediately prior to the road flooding, Public Works completed the 2011 FEMA project armoring the roadway with rip rap and Reno blankets. FEMA requires cost estimating supporting restoration to pre-existing condition. Last month, during a site visit with FEMA and WA Military Department, staff identified the complexity of providing a cost estimate restoring Ringer Loop to pre-exiting condition. The Yakima River has removed the river bank and roadway ditch. During moderate flow events, the river is now at the edge of pavement. FEMA allows claimants to pursue an "alternate project" meaning a financial settlement in lieu of construction (90% cost recovery). DISCUSSION: Staff has successfully defined for FEMA the construction method needed to re- establish river bank and roadside ditching. A preliminary cost estimate recently provided to FEMA was approximately $812,000. The County Road Engineer recently independently estimated the project at approximately $860,000. The Director and County Engineer agree on probable project cost within acceptable variance (6%). Page 1 of 2 PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT A final cost proposal now is required (sealed and signed by the County Engineer) so that FEMA can begin the alternate project process. The Director has used this process in previous flooding events with FEMA. We propose negotiating a final settlement value and applying the money towards the acquisition of equipment (this is easiest for FEMA). Public Works has identified two primary equipment needs: midsize trackhoe and survey truck. The existing survey truck does not meet our current need. We do not have a trackhoe of the size routinely needed by Public Works (we are constantly renting). The cost of the midsize trackhoe and survey truck is approximately $400,000. Once final FEMA settlement value is defined, Public Works may be able to add additional equipment to the request. FISCAL IMPACTS: The Road Fund must purchase new equipment and then place it into ER&R (equipment rental and replacement fund). All money spent will be repaid to the fund once FEMA provides alternate project funding. The estimated cost of the midsize trackhoe is $350,000. The survey truck cost is estimated at $35,000.
