Mark reported that the Ellensburg Business Development Authority (EBDA) submitted a letter to Public Works requesting the 2017 Sales and Use Tax funding early to do repairs to the incubator building roof they own in the Bowers Field Industrial area. Commissioner Osiadacz suggested that it go before the Conference of Government (COG) for recommendation. Commissioner O'Brien inquired if they asked for emergency funding and Mark replied that they didn't. Board Direction: Place the item on the next Agenda for the COG meeting to make a recommendation to the BOCC. SURPLUS PROPERTY. Mark presented a letter from a citizen that has been attempting to construct a covered storage area at his residence. After hiring a contractor and erecting the structure it was found by Code Enforcement to be in violation of building setbacks. The homeowner removed the structure to avoid enforcement action. After speaking with the previous Public Works Director it was suggested that the homeowner purchase a surplus property adjacent to his parcel. This would allow the setbacks necessary to construct the covered storage area. Currently, the homeowner is maintaining the property and has been for several years. He is now requesting to purchase the property at a reduced price not the current minimum bid as required by the County. Board Direction: The Board agreed not to offer the surplus property at any reduced price. 411 N. Previous to this inquiry the City of Ellensburg contracted with TerraGraphics Environmental Engineering through the Brownfields program to identify potential soil and/or groundwater contamination at the site. A Phase 2 Environmental Site Assessment identified some contamination and called for the installation of groundwater monitoring wells and continued sampling. The depth of the well was drilled at 15 feet, however, the well did not produce groundwater, and therefore no sampling could be conducted. Mark suggested checking the groundwater levels before responding to DOE's request to retest. Board Direction: Check groundwater levels and then contact DOE. PROJECT UPDATES: Luke reported that Via Kachess Road would be closing tonight to start the Lodge Creek culvert replacement. Culvert delivery is scheduled for tomorrow and will work around the WSDOT construction to get it delivered. Staff did received some phone calls saying they were not informed but the Department sent out letters and conducted a meeting at the Homeowner's Association Club House and placed signage. The Forest Service gave approval to improve one of the Forest Service Roads to act as a detour route and one person complained about the state of the road. Staff will meet onsite with the Forest Service next week to discuss the issues. Luke stated that the Mt. Daniels Drive extension was in final design. Letters were sent to the neighboring property owners and staff has received no questions. We were able to preserve some trees and the Lower County Crew will begin brushing the site next week. Staff is waiting for the SEPA approval and he is hoping to get started on October 1st. It should be a one (1) to two (2) week project. Luke was able to get WSDOT to review the Westside Road project documents and the STIP updated. Funds should be obligated soon and will be placing a Notice of Call for Bids on Tuesday's agenda for consideration. Silica Road Bridge Plans have been approved and staff is looking at an October 10, 2016 delivery date. The WSDOT 411 N. Cook RECOMMENDATION: Direct staff to contact the Chamber of Commerce and advise that the Conference of Governments (COG) must recommend immediate funding to the Board of County Commissioners (BOCC). Request staff schedule time with the COG for a presentation of the funding request. BACKGROUND: Recently, the BOCC took action formalizing the COG 2017 Public Facilities funding recommendations. The COG annually makes recommendations for project funding to the BOCC utilizing Distressed County Sales and Use Tax monies. DISCUSSION: The Chamber of Commerce is now requesting immediate release of the requested $63,685 for replacing the roof of the Prospect Street Incubator. The 2017 awards are slated to begin expensing January 1, 2017. The fund is carrying approximately one million in funding reserve at this time. FISCAL IMPACTS: The requested early expenditure of $63,685 can be absorbed by current fund reserve. The money would flow back to the fund no later than January 1, 2017. Ruby St., Ste #1 Ellensburg, WA 98926 RE: Distressed County Sales and Use Tax Grant Award — Emergency funds request Mark, I am writing in regards to the Distressed County Sales and Use Tax award EBDA just received for roof replacement at the Prospect Street Incubator. Since we applied for this grant in June, the roof replacement has become an emergency situation where numerous bays of the building are leaking even during a short sprinkle. It's clear that the roof won't survive another winter without severe damage to the building and, worse, to the products and equipment of the tenants housed there. I am respectfully requesting that this project be considered an "emergency" similar to the Roslyn sidewalk repair that was also approved by the BOCC. In the alternative, we could perhaps front the expense and be reimbursed when grants are dispersed in early 2017. Attached is a photo of water from a minor sprinkle in July and how close it came to ruining very expensive custom cabinetry just completed by one of the tenant businesses. Please let me know if this request is feasible and if you need any other information Thank you. Please don't hesitate to contact me if you have questions. STAFF REPORT STUDY SESSION! DATE: September 12, 2016 TOPIC: Surplus Property Requested Discount Price ACTION REQUESTED: Provide Direction to Staff LEAD STAFF: Mark R. Cook RECOMMENDATION: Direct staff to respond to the applicant's request to discount the price of surplus property (18-18-27069-0057). BACKGROUND: The applicant (Mr. David Duvall) has been attempting to construct covered storage at his residence adjacent to tax parcel 18-18-27069-0057 for the past several years. An initial attempt at construction resulted in removal of a covered facility as a result of threatened code enforcement action. Mr. Duvall contends that he was not made aware of required side yard setback requirements when originally inquiring about exempt structures several years back. After hiring a contractor and constructing the improvement, the side yard setback violation was discovered by CEDS and enforcement action began. Mr. Duvall voluntarily removed the structures and is convinced that process failed him by not making him aware of the side yard setback restriction prior to constructing the improvement. DISCUSSION: Adjacent to this property 2110 West Clearview Drive, is a surplus property (18- 18-27069-0057). Mr. Duvall has been maintaining the property for several years (watering/mowing) and has invested personal funds in grounds maintenance. The property is believed to be sufficient for the desired covered storage adjacent to his property. FISCAL IMPACTS. Mr. Duvall contends that the financial burden associated with his failed original attempt at constructing covered storage was his alone and that the County erred by not informing him of the required side yard setback. He further asserts that his personal investing on the parcel should be considered when addressing the minimum bid value of tax parcel 18-18-27069-0057. The current minimum bid price is $2,092.03. Mr. Duvall desires paying $500.00. Page 1 of 3 PUBLIC WORKS BOARD OF COUNTY COMMISSIONERS WORK SESSION STAFF REPORT ATTACHMENTS: EXHIBIT 1: Letter request from Mr. David Duvall, 06-03-2013. Ruby St. Suite 2 Ellensburg, WA 98926 1A`; June 3, 2013 DEFT OF PUBUI Tax Parcel 18-18-27069-0001 Location: 2110 West Clearview Drive Ellensburg, WA 98926 To whom it may concern: I would like to propose the following to the appropriate officials of Kittitas County for consideration. We purchased the property and home at the address above in 2006, parcel 069-0001. There is an additional small strip of property due west of our property, parcel 069-0057. This parcel lies between our property and the entrance to Currier Creek Estates; off Old Highway Ten (see enclosure). This property was originally owned by the previous developer. Since that time, the title has been returned to Kittitas County. For the past several years, we have been maintaining this land by way of watering, mowing, and weeding (see photograph). Our proposal is for Kittitas County to grant us title to parcel 069-0057 as compensation for our efforts in maintaining said parcel these past few years. The benefits to Kittitas County in making this boundary exchange/title transfer is 1) that Kittitas County will not need to maintain this land into the future, 2) will remove parcel from county ownership and responsibility, and 3) provide additional county revenue in the form of property tax. We have been maintaining this property with mowing and watering for the last 8 years or so. Prior to you taking over, I had been working with the former Director for many years on the same issue. So far, the county has done little, if anything to fix this situation. How long do you expect us to keep up this maintenance? We have been told many times of a potential boundary line adjustment (or something similar) that would make the property ours, put it on the tax records (benefit to the county) and then we would be responsible for maintenance. Please tell me there has been/will be some development on this as we are to the point that we no longer will be taking care of the maintenance if nothing is done. Sincerely, David Duvall
