01/05/2016 MINUTES 1 <br />COMMISSIONERS' MINUTES <br />KITTITAS COUNTY, WASHINGTON <br />COMMISSIONERS AUDITORIUM <br />SPECIAL MEETING <br /> <br />TUESDAY 2:00 P.M. JANUARY 5, 2016 <br /> <br />Board members present: Chairman Obie O’Brien; Vice-Chairman Paul <br />Jewell; and Commissioner Gary Berndt. <br /> <br />Others: Julie Kjorsvik, Clerk of the Board; Neil Caulkins, Deputy <br />Prosecutor and 1 member of the public. <br /> <br />PUBLIC HEARING COUNTY ADMISSIONS TAX COMMISSIONERS <br /> <br />At 2:00 p.m. CHAIRMAN O’BRIEN opened a Public Hearing continued from <br />December 8, 2015 to consider the implementation of a County <br />Admissions Tax. He noted the record was open. <br /> <br />COMMISSIONER BERNDT said at the last Public Hearing there had been a <br />few concerns expressed including who would be qualified as exempt <br />from the tax. He said he had not been able to complete the work yet <br />and suggested continuing the hearing to allow additional time for <br />review. <br /> <br />COMMISSIONER BERNDT moved to continue the Public Hearing to Tuesday <br />January 19, 2016 at 2:00 p.m. in the Commissioners Auditorium, <br />noting the record to remain open. COMMISSIONER JEWELL seconded. <br />Motion carried 3-0. <br /> <br />PUBLIC HEARING NOISE CONTROL ORDINANCE COMMISSIONERS <br /> <br />At 2:03 p.m. CHAIRMAN O’BRIEN opened a Public Hearing to consider <br />Amending Kittitas County Code Chapter 9.45, Noise Control Ordinance. <br /> <br />NEIL CAULKINS, DEPUTY PROSECUTOR presented draft language which <br />would amend Kittitas County Chapter 9.45 - Noise Ordinance. He said <br />the Ordinance first went into effect in 1995 and needs to be updated <br />to standards that are legally enforceable and not too vague. A <br />portion of the current Ordinance had been declared unconstitutional <br />by Lower District Court Judge James Hurson, stating it was vague. He <br />noted the violations would be a civil infraction rather than a <br />criminal act. The Sheriff’s Department had been provided a copy of <br />the proposed amendments but he had not received any response back <br />from them with any issues and/or recommended changes. Any issues <br />would not be code enforcement but rather the responsibility of the <br />Sheriff’s Department. <br /> <br /> <br />
