JUNE 4, 2019 Board members present: Chairman Cory Wright & Vice-Chairman Brett Wachsmith. Excused: Commissioner Laura Osiadacz. Others: Julie Kjorsvik, Clerk of the Board; Mark Cook, Public Works Director/Interim Engineer; Chris Horner, Deputy Prosecutor; and 1 member of the public. CALL TO ORDER Chairman Wright called the meeting to order. PLEDGE OF ALLEGIANCE Chairman Wright led the Pledge of Allegiance. INTRODUCTION OF NEW COUNTY EMPLOYEES – NONE PROCLAMATIONS - NONE AWARDS & RECOGNITIONS – NONE APPROVAL OF AGENDA Commissioner Wachsmith moved to approve the Agenda, as presented. Chairman Wright seconded. Motion carried 2-0. CONSENT AGENDA Chairman Wright noted Consent Item F had been removed from the Agenda. Commissioner Wachsmith moved to approve the Consent Agenda, as amended. Chairman Wright seconded. Motion carried 2-0. SET PUBLIC HEARING SOLID WASTE FEES SOLID WASTE Approve Setting a Public Hearing to consider a Resolution for Fees in the Solid Waste Department, to be held on Tuesday June 18, 2019 at 2:00 p.m. in the Commissioners Auditorium, Room 109, Kittitas County Courthouse 205 West 5th Avenue Ellensburg, WA and to authorize the Clerk to publish said notice. REQUEST TO SET A PUBLIC HEARING TO CONSIDER THE LEASE OF KITTITAS COUNTY WATER RIGHTS THROUGH AUCTION – ITEM REMOVED FROM THE AGENDA 06/04/2019 MINUTES 3 AGREEMENT EVERBRIDGE SERVICES SHERIFF Approve an Agreement between Everbridge Services and the Kittitas County Sheriff’s Office in the amount of $16,254.21, for Mass Notification Pro. Ruby Street, Suite 1, Ellensburg, WA and to authorize the Clerk to publish said notice. RESOLUTION 2019-088 COUNCIL OF GOVERNMENTS PUBLIC WORKS Approve Resolution No. 2019-088, Amending the Council of Governments Public Facilities Fund 108, Policy Number 2018-01, Project Award Process. RESOLUTION 2019-089 FEMA RATING SYSTEM FORM PUBLIC WORKS Approve Resolution No. 2019-089, Authorizing the Chair’s Signature on the Community Rating System CC-230 Verification FEMA Form 086-0-35A. RESOLUTION 2019-090 WEIHL ROAD IMPROVEMENT PROJECT PUBLIC WORKS Approve Resolution No. 2019-090, Authorizing the Director of Public Works to Publish a Notice of Call for Bids for the Weihl Road Improvements Project, to be accepted until June 20, 2019 at 2:00 p.m. at the Kittitas County Public Works Department, 411 North Ruby Street, Suite 1, Ellensburg, WA and to authorize the Clerk to publish said notice. 06/04/2019 MINUTES 4 RESOLUTION 2019-091 ANNUAL PAINT STRIPE PROGRAM PUBLIC WORKS Approve Resolution No. 2019-091, Awarding a Contract to Stripe Rite, Inc., in the amount of $267,526.00 for the 2019 Annual Paint Stripe Program, and to authorize the Director of Public Works to sign the contract documents. REQUEST FOR QUALIFICATIONS CULVERT AT KACHESS LAKE ROAD PUBLIC WORKS Approve a Request for Qualifications Supporting Design and Environmental Permitting for Replacing the Road Culvert at Kachess Lake Road (MP 2.30 – MP 2.70), to be accepted until 10:00 a.m. on June 27, 2019 at the Kittitas County Public Works Department 411 N. Ruby Street, Suite 1, Ellensburg, WA and to authorize the Clerk to publish said notice. RESOLUTION 2019-092 AMENDMENT HOMELESS HOUSING GRANT COMMISSIONERS Approve Resolution No. 2019-092, Correcting a Scriveners Error on Resolution No. 2019-075, Allowing an Amendment to Grant Agreement HH- 2018-002. RESOLUTION 2019-093 AMENDMENT TO LODGING TAX GRANT COMMISSIONERS Approve Resolution No. 2019-093, Authorizing an Amendment to Lodging Tax Grant and Small Scale Capital Project Agreement LT-2017-04 with the City of Cle Elum. CORRESPONDENCE - NONE ADMINISTRATIVE MATTERS - NONE CITIZEN COMMENTS ON NON-AGENDA ITEMS – NONE BOARD DISCUSSION/DECISION ITEMS - NONE MISCELLANEOUS - NONE EXECUTIVE SESSION At 10:04 a.m. Chairman Wright announced the Board would recess into an Executive Session for 10 minutes with Deputy Prosecutor Chris Horner to discuss with legal counsel representing the agency matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. Possible action anticipated. 06/04/2019 MINUTES 5 At 10:09 a.m. the Board reconvened out of Executive Session. No action was taken. At 10:09 a.m. Chairman Wright announced the Board would recess back into an Executive Session for 5 minutes to discuss with legal counsel representing the agency matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. Possible action anticipated. Commissioner Osiadacz entered into the Executive Session at 10:12 a.m. At 10:14 a.m. the Board reconvened out of Executive Session. No action was taken. At 10:14 a.m. Chairman Wright announced the Board would recess back into an Executive Session for 5 minutes to discuss with legal counsel representing the agency matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. Possible action anticipated. At 10:19 a.m. the Board reconvened out of Executive Session. The Board provided direction to the Prosecutors office to prepare supportive documentation for Becky Sherley. At 10:20 a.m. Chairman Wright announced the Board would recess into Executive Session for 10 minutes with Mark Cook, Public Works Director/Interim Engineer, to consider the minimum price at which real estate will be offered for sale or lease when public knowledge regarding such consideration would cause a likelihood of decreased price. However, final action selling or leasing public property shall be taken in a meeting open to the public. Possible action anticipated. At 10:30 a.m. the Board reconvened out of Executive Session. The Board gave Staff Direction to place the topic on the next Public Works Study Session (June 10, 2019).
