ACTION REQUESTED: Request to Approve a Resolution to Affirm the County
Engineer's Decision Paying an Administrative Settlement
Resolving Right of Way Acquisition Supporting the
Fairview Road Bridge Replacement Project, CRP No. 279-
18
BACKGROUND: Two bridges have failed at Fairview Road. Attempts to
replace the structures and realign Coleman Creek stalled
last year owing to unsuccessful right of way negotiations.
The recent failure of responders to a request for bridge
suppliers supporting the Coleman Creek Fish Barrier
Removal project requires additional flexibility settling
outstanding right of way issues at Fairview. Public Works
desires moving forward with this permitted project getting
construction money into the local economy. To that end,
the County Engineer recommends the Board support his
decision paying an administrative settlement of $1,700
($0.29/square foot rather than the market appraised value of
$0.24/square foot) concluding right of way negotiations.
The final cost of right of way acquisition is $9,850.
INTERACTION: Public Works.
RECOMMENDATION: Approve the Resolution to Affirm the County Engineer's
decision paying an administrative settlement finalizing
right of way acquisition supporting the Fairview Road
Bridge Replacement Project, CRP No. 279-18.
HANDLING: Return one original to Public Works.

RESOLUTION NO. 2020 -
AFFIRMING THE COUNTY ENGINEER'S DECISION PAYING AN
ADMINISTRATIVE SETTLEMENT FINALIZING RIGHT OF WAY NEGOTIATIONS
FOR FAIRVIEW ROAD BRIDGE REPLACEMENT — CRP NO. 279-18
WHEREAS: Two bridges have failed on Fairview Road at Coleman Creek, and
WHEREAS: Public Works has completed a replacement design for the failed bridges and
requires acquisition of right of way supporting the project; and
WHEREAS: In 2019 negotiations with an area property owner failed to resolve the necessary
acquisition owing to disagreement in property value; and
WHEREAS: The current economic climate dictates settlement of right of way allowing the
improvement project to proceed to construction this construction season;
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the
best interest of the public, does hereby affirm the County Engineer's decision paying an
administrative settlement of $1,700 settling the right of way acquisition supporting the Fairview
Road Bridge Replacement Project, CRP No. 279-18.
BE IT FURTHER RESOLVED that the County Engineer is directed to sign necessary right of
way documents acquiring necessary right of way for the project.
