ACTION REQUESTED: Request to Approve a Resolution to Suspend Procurement
Procedures (RCW Chapter 39) and Authorize the Public
Works Director to Negotiate a Bridge Procurement
Contract with KnifeRiver and Sign Same Upon Successful
Negotiations
BACKGROUND: Recent attempts to procure a fish passage structure for CRP
299-19 (Coleman at Vantage Highway) produced no
responders. One company, KnifeRiver Precast, did request
to submit an electronic bid owing to travel restrictions
imposed by the Governor's Office. Public Works declined
to accept an electronic bid. The declared State of
Emergency allows the suspension of standard procurement
(RCW Chapter 39) procedures (DPA Caulkins) enabling
direct negotiations with KnifeRiver on a suitable bridge
structure. Public Works is requesting authorization for the
Director to negotiate and sign the bridge procurement
contract. Time is of the essence as work in water windows
are short and rapidly approaching. WA Department of Fish
and Wildlife have qualified this project under RCW
77.55.181 as a fish barrier removal project — giving it high
priority status.
INTERACTION: Public Works.
RECOMMENDATION: Suspend RCW Chapter 39 procurement procedures
allowing the Director of Public Works to negotiate and sign
a bridge procurement contract with KnifeRiver Precast for
CRP 299-19.
HANDLING: Return one original to Public Works.

RESOLUTION NO. 2020 -
SUSPENDING PUBLIC WORKS PROCUREMENT PROCEDURES (RCW 39) AND
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE AND SIGN
A BRIDGE PROCUREMENT CONTRACT WITH KNIFERIVER PRECAST
SUPPORTING THE COLEMAN CREEK FISH PASSAGE BARRIER REMOVAL
PROJECT AT VANTAGE HIGHWAY — CRP NO. 299-19
WHEREAS: The Board of County Commissioners declared a Countywide State of Emergency
in Resolution 2020-042 responding to the COVID-19 pandemic; and
WHEREAS: The Governor of the State of Washington did declare a "Stay at Home" order
statewide on March 23`d, 2020; and
WHEREAS: The Department of Public Works did solicit material suppliers for a fish passage
structure supporting the Coleman Creek Fish Passage Barrier Removal Project at
Vantage Highway (CRP 299-19); and
WHEREAS: During solicitation KnifeRiver Precast requested providing an electronic bid in
response to that solicitation stating that the State "Stay at Home Order" prohibited
the delivery of the requested bid and Public Works does not currently support
electronic bid submittals; and
WHEREAS: Public Works received no bids pursuant to its solicitation for bridge structure
submittal CRP No. 299-19; and
WHEREAS: Removal of fish barriers is a high priority for the State of Washington and the
Washington State Department of Fish and Wildlife qualifies this project as a
barrier removal project pursuant to RCW 77.55.181;
NOW, THEREFORE BE IT RESOLVED that, pursuant to RCW 39.04.280, competitive
bidding is suspended as to this project. The COVID-19 outbreak has caused vast economic
disruption and damage due to the necessary social distancing precautions and associated government -
imposed lockdowns. This economic consequence is a part of the emergency. To combat that aspect
of the emergency the county wishes to stimulate the economy by continuing to pursue various public
works which are essential construction under the Governor's Stay At Home Order.
BE IT FURTHER RESOLVED that the Director of Public Works is authorized to negotiate
with KnifeRiver Precast for providing the necessary bridge structure removing the fish barrier on
Coleman Creek at Vantage Highway and sign the bridge procurement contract with KnifeRiver
Precast pending successful negotiations.
